SECONDED BY COUNCILMEMBER JONES, MOTION PASSED UNANIMOUSLY. COUNCILMEMBER JONES INTRODUCED IN WRITING, AND MOVED FOR THE ADOPTION OF THE FOLLOWING RESOLUTION. SECONDED BY COUNCILMEMBER PUCKETT, MOTION PASSED UNANIMOUSLY. 27 MARCH 2O00 RESOLUTION NO. 688-00 2446 WHEREAS, THE OWNERS OF PLANTATION PINES UNIT 2 DESIRE TO HAVE ALL PUBLIC STREETS AND RIGHTS -OF -WAY DEDICATED ON THE PLAT FILED FOR RECORD IN THE PROBATE RECORDS OF BALDWIN COUNTY, ALABAMA AS SLIDE 1 992-B AND ALL UTILITIES LOCATED IN EASEMENTS AND IN RIGHTS -OF -WAYS ACCEPTED FOR MAINTENANCE BY THE CITY OF FAIRHOPE, ALABAMA, AND; WHEREAS, THE GENERAL SUPERINTENDENT OF THE CITY OF FAIRHOPE, ALABAMA REPRESENTS THAT THE PUBLIC IMPROVEMENTS IN PLANTATION PINES UNIT 2 HAVE BEEN INSTALLED IN SUBSTANTIAL CONFORMITY WITH CITY REQUIREMENTS, AND; WHEREAS, THE CITY OF FAIRHOPE, ALABAMA HAS RECEIVED NOTICE FROM THE ENGINEERS OF THE PROJECT THAT THE DESIGN AND CAPACITY OF THE PUBLIC IMPROVEMENTS HAVE BEEN DESIGNED IN CONFORMANCE WITH CITY REQUIREMENTS AS INDICATED ON THE RECORDED PLAT, AND; WHEREAS, THE CITY OF FAIRHOPE, ALABAMA IS NOT AND IN NO MANNER WILL BE RESPONSIBLE FOR THE MAINTENANCE OF COMMON AREAS IN THE SUBDIVISION AS INDICATED ON THE RECORDED PLAT, AND; WHEREAS, THE CITY OF FAIRHOPE, ALABAMA HAS RECEIVED FROM THE OWNERS OF PLANTATION PINES UNIT 2 A MAINTENANCE BOND FOR THE PUBLIC IMPROVEMENTS CONSTRUCTED FOR A PERIOD OF 2 YEARS FROM THE DATE OF THE APPROVAL OF THIS RESOLUTION, AND; NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE Cf1Y OF FAIRHOPE, ALABAMA THAT THE PUBLIC IMPROVEMENTS FOR PLANTATION PINES UNIT 2 ARE HEREBY ACCEPTED FOR PUBLIC MAINTENANCE SUBJECT TO THE BOND POSTED. THE OBJECTS OF THE FAIRHOPE RECYCLING PROGRAM: PAPER TO PARKS Recycling saves the city money in disposal costs and generates revenue from the sale of recycled goods. The City commits to allocate one half of the increase in receipts to the City's parks. TURN RECYCLABLES INTO FUNDING FOR PARKS. TRASH TO CASH The City's new collection procedures allow more limbs, unbagged yard debris and environmentally bagged yard debris to be chipped and mulched, saving the dollar and environmental costs of landfill consumption and providing mulch for use by the City and its citizens. TURN YARD TRASH INTO TAX DOLLAR SAVINGS. COMPOST TO CALADIUMS Residents can significantly reduce the amount of waste entering the City's solid waste disposal system by composting yard and kitchen debris. The results can include less need for chemical fertilizers and healthier lawns and gardens. TURN COMPOST INTO BETTER LAWNS AND GARDENS. RESOLUTION ON NEXT PAGE 27 MARCH 2O00 RESOLUTION NO. 689-00 2448 WHEREAS, the City of Fairhope's 1999 "Fairhope Recycles" program resulted in: 1. the recycling of over 1,148 tons of material, 2. the generation of almost $25,000 from the sale of recycled material, 3. the reduction of landfill consumption by 19%, and 4. the saving of tipping fees of more than $34,000; WHEREAS, the City of Fairhope's grinding and mulching of yard debris has: 1. reduced landfill consumption, 2. conserved City revenues and tax dollars, and 3. produced mulch for the use of the City and its citizens in beautifying the City; WHEREAS, home composting can: 1. reduce the amount of solid waste entering the City's system, 2. reduce the need for chemical fertilizers in Fairhope's gardens, and 3. save landfill tipping fees; and WHEREAS, the City of Fairhope desires to: 1. increase both the number of households and businesses participating in the "Fairhope Recycles" program and the amount of material recycled per household and per business, 2. increase the amount of yard debris that can be mulched by the City, and 3. decrease the amount of compostable materials that enters the City's solid waste disposal system by encouraging household composting. NOW THEREFORE, be it resolved by the City Council of Fairhope, Alabama that the City of Fairhope 1. Adopts the attached, expanded "Fairhope Recycles" program for the new millennium: FAIRHOPE RECYCLES -- PAPER TO PARKS TRASH TO CASH COMPOST TO CALADIUMS 2. Approves a new logo for the program incorporating the City seal and the recycling symbol; 3. Recognizes the businesses participating in the City's recycling program by encouraging them to display a decal of that new logo; 27 MARCH 2O00 2449 4. Designates the Roberts Park at the triangle formed by Fels Avenue, Liberty Street and Equity Street as the first park to be improved with funds generated from the Paper to Parks campaign and authorizes the Recycling Committee to name a committee to develop plans for the Roberts Toddlers Park at that location; 5. Authorizes signs conforming to the City's sign ordinance to be placed at the old pecan factory on Fairhope Avenue and Bancroft Street tracking the progress of the Paper to Parks campaign; 6. Requests the Public Works Department to develop collection procedures consistent with increasing the amount of yard debris mulched instead of deposited at the landfill; 7. Asks the Public Works Department to run a pilot program on the use of biodegradable trash bags; 8. Commends the Fairhope K-1 Center for agreeing to sponsor an educational composting program for the K-1 students; 9. Invites its citizens to get further information at the City's tent at the Bay Area Earth Day celebration sponsored by the Alabama Environmental Council on Sunday, April 16, 2000 from noon until 5:00 pm at the Fairhope Beach Park. COUNCILMEMBER FORD REQUESTED LOOKING INTO ADJUSTING THE LIGHT AT THE INTERSECTION OF SECTION STREET AND MAGNOLIA AVENUE. THE LIGHT SETTING IS CAUSING TRAFFIC BACK UP AND PEOPLE ARE RUNNING THE LIGHT. MAYOR NIX AGREED TO HAVE THIS ISSUE LOOKED INTO. COUNCILMEMBER FORD REQUESTED THAT THE HEIGHT OF BUILDING BE LOOKED INTO. THE CURRENT MAXIMUM HEIGHT IS 47FT. 27 MARCH 2O00 2452 RESIDENTS OF CHURCH STREET WERE PRESENT AND QUESTIONED THE COUNCIL ABOUT PLANS FOR THE NEW JUSTICE BUILDING. THE NEW JAIL WILL BE BUILT NEXT TO CITY HALL IN THE OLD REGIONS BANK BUILDING. THERE BEING NO FURTHER BUSINESS TO COME BEFORE THE COUNCIL THE MEETING WAS DULY ADJOURNED AT 5:52 P.M.
