Nix is hereby authorized to execute a lease agreement between the CITY and THE DEPARTMENT OF CONSERVATION AND NATURAL RESOURCES of the State of Alabama, for the construction and maintenance of public boat landing area boat ramp, located at Pier Street. The term of this agreement shall be twenty (20) years, commencing on the first day of February, 2000, with an option to renew for an additional twenty (20) years. Renewal shall be granted by notification of intent by CONSERVATION under the same terms and conditions, except those provisions pertaining to construction, as in the original agreement, and; WHEREAS, It is further understood and agreed between the Parties hereto that the properties herein described are to be used only as free public boat landing area and allied activities and for no other purposes. If CITY fail to maintain free access, CITY shall be obligated to reimburse LESSEE for all expenditures, and further details are within the Lease Agreement. Adopted this 161h Day of March , 2000. Nix is hereby authorized to execute a lease agreement between the CITY and THOMPSON TRACTOR CO., INC of Birmingham, Alabama, for the lease of a Backhoe/Loader with multi -purpose loader bucket. The term of the lease shall be for three (3) years at $10,660.00 each year with no option to purchase the equipment at the end of the lease.., This equipment will be used by the Water/Sewer Department. Resolution No. 685-00 WHEREAS, the Owners of Porchplace Subdivision desire to have all public streets and rights -of -way dedicated on the plat filed for record in the Probate Records of Baldwin County, Alabama as Slide 1990-B and all utilities located in easements and in rights -of -ways accepted for maintenance by the City of Fairhope, Alabama, and; WHEREAS, the General Superintendent of the City of Fairhope, Alabama represents that the public improvements in Porchplace Subdivision have been installed in substantial conformity with City requirements, and; WHEREAS, the City of Fairhope, Alabama has received notice from the engineers of the project that the design and capacity of the public improvements have been designed in conformance with City requirements as indicated on the recorded plat, and; WHEREAS, the City of Fairhope, Alabama is not and in no manner will be responsible for the maintenance of common areas in the subdivision as indicated on the recorded plat, and; WHEREAS, the City of Fairhope, Alabama has received from the owners of Porchplace Subdivision a maintenance bond for the public improvements constructed for a period of 2 years from the date of the approval of this Resolution, and; NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA that the public improvements for Porchplace Subdivision are hereby accepted for public maintenance subject to the bond posted. Johnson, Tity Clerk 16 March 2000 2439 Council reviewed an application for a Restaurant Liquor License by Guy Tatum Jr., dba Beach Bums Grill, Located at 924 Plantation Blvd. Councilmember Jones moved to approve the issuance of the License. Seconded by Councilmember Duck, motion passed unanimously. Council reviewed an application for a Restaurant Liquor License by F. Rutherford Smith Jr., dba Point Clear Tennis Club, LLC., located at 6832 Marlow Road, Point Clear. Councilmember Duck moved to approve the issuance of the license. Seconded by Councilmember Jones. Willie Williams addressed the City Council requesting the passing of a Resolution to allow the residents of South Fairhope to vote on being annexed into the City Limits of Fairhope. Mr. Williams expressed that the City is not responsible for checking the required material for holding a referendum. The City just need to pass a resolution and the rest will be left up to the Judge of Probate Adrian Johns. The City Attorney Marion E. Wynne explained to Mr. Williams that the League of Municipalities has advised him that the City should make sure all the legal requirements are met. Mr. Wynne further explained that he still had not received the followings: (reading from Section 11-42-2 Sub -section 10 ) Meets and Bounds of the property, and a petition with 60% of the property owner. Mr. Wynne and Mayor Pro -Temp Michael Ford encouraged Mr. Williams to work with Christopher Baker on getting the necessary maps, before the Council consider passing the resolution all status must be met. Mr. Williams stated that he will be in contact with the U.S. Justice Department about this matter. Mayor Pro -temp Michael Ford reiterated that the Council will take to advise of the City Attorney, and the League. He further stated that the Council is not denying anything, but everything that is required by Sub -section 10 must be received and the Council will go over it and proceed from there. 2440 1 6 MARCH 2O00 DENNIS NICHOLSON WITH PAPAS PIZZA ADDRESSED THE CITY COUNCIL SEEKING APPROVAL OF AN ALREADY INSTALLED AWNING TO THE BACKLIT ENTRANCE WAY, LOCATED AT 300 VILLAGE SQUARE.
