PRESENT WERE MAYOR JAMES P. Nix; COUNCILMEMBERS JOHN V. DUCK, MICHAEL A. FORD, DEBBIE W. QUINN, JEANETTE PUCKETT; CITY ATTORNEY MARION E. WYNNE, AND CITY CLERK GENIECE W. JOHNSON. COUNCILMEMBER WILLIAM H. JONES WAS ABSENT. THERE BEING A QUORUM PRESENT, MAYOR NIX CALLED THE MEETING TO ORDER. COUNCILMEMBER DUCK MOVED TO APPROVE MINUTES OF THE 0 JANUARY 2000, REGULAR MEETING. SECONDED BY COUNCILMEMBER QUINN, MOTION PASSED UNANIMOUSLY. A PUBLIC HEARING WAS HELD AS ADVERTISED ON A PROPOSED ORDINANCE TO AMEND THE ZONING ORDINANCE 557. COUNCILMEMBER DUCK INTRODUCED IN WRITING AN ORDINANCE TO ZONE HAROLD THOMPSON PROPERTY AS R2-SINGLE FAMILY RESIDENTIAL CONCURRENT WITH ANNEXATION. THE PROPERTY IS LOCATED SOUTH OF MOSLEY ROAD ON THE WEST SIDE OF COUNTY ROAD 27, AND NORTH OF GAYFER STREET, 1 5.9 ACRES MORE OR LESS FOR THE PROPOSED PURPOSE OF 32 LOTS, SINGLE FAMILY 1 800 SO FT MINIMUM. THE PLANNING & ZONING COMMISSION RECOMMENDS APPROVAL OF THIS ORDINANCE. MS. KATHIE BRYD WAS PRESENT AND EXPRESSED CONCERN OF THE DRAINAGE PROBLEMS THAT SHE IS CURRENTLY EXPERIENCING. CHRISTOPHER BAKER DIRECTOR OF PLANNING AND BUILDING EXPRESSED THAT MR. THOMPSON COULD DEVELOP THE PROPERTY WITHOUT BEING ANNEXED INTO THE CITY. MR. BAKER ALSO EXPLAINED THE ZONING AND ANNEXING OF THIS PROPERTY DOES NOT PERTAIN TO THE DRAINAGE ISSUES. THE DRAINAGE ISSUES WILL BE HANDLED ONCE THE SUBDIVISION PLANS ARE PRESENTED. THIS ITEM WILL BE CONTINUED AT THE NEXT REGULAR COUNCIL MEETING OF MONDAY, 14 FEBRUARY 2000. MARION E. WYNNE ARRIVED 5:38 PM. 2416 24 JANUARY 2000 COUNCILMEMBER QUINN INTRODUCED IN WRITING ORDINANCE NO. 1076. AN ORDINANCE ANNEXING JOHNNIE L. AND WANDA M. MOSELEY PROPERTY, LOCATED AT 25 PIRATE DRIVE, FAIRHOPE, ALABAMA, .67 ACRES MORE OR LESS. IN ORDER TO TAKE IMMEDIATE ACTION COUNCILMEMBER QUINN MOVED TO SUSPEND THE RULES. SECONDED BY COUNCILMEMBER PUCKETT MOTION TO SUSPEND THE RULES PASSED UNANIMOUSLY BY THE FOLLOWING VOTE: AYE -DUCK, FORD, QUINN, NIX, AND, PUCKETT. NAY -NONE. COUNCILMEMBER DUCK THEN MOVED FOR FINAL ADOPTION OF ORDINANCE NO. 1076. SECONDED BY COUNCILMEMBER PUCKETT, MOTION FOR FINAL ADOPTION PASSED UNANIMOUSLY BY THE FOLLOWING VOTE: AYE -DUCK, FORD, QUINN, NIX, AND PUCKETT. NAY -NONE. COUNCILMEMBER DUCK INTRODUCED IN WRITING, AND MOVED FOR THE ADOPTION OF THE FOLLOWING RESOLUTION. SECONDED BY COUNCILMEMBER QUINN, MOTION PASSED UNANIMOUSLY. 24 JANUARY 2000 RESOLUTION NO. 678-00 MORATORIUM ON ANNEXATION 2417 WHEREAS, The City of Fairhope currently conduct annexations on a quarterly basis. The Second City Council meeting of January, April, July and October; and, WHEREAS, It is required by law to have a clearance letter from the U. S. Department of Justice, Civil Rights Division, Voting Section, Washington, DC on all annexations; and, WHEREAS, A Municipal Election is scheduled for August 22, 2000, and a Run-off Election is scheduled for September 12, 2000, and the City's regular scheduled annexation is July 24, 2000. There is not ample time to receive the required clearance letter from the U.S. Department of Justice; and, THEREFORE, The City Clerk is requesting that the Governing Body of the City of Fairhope, Alabama place a moratorium on annexation effective May 1, 2000 - January 1, 2001. The City will conduct regular annexations on April 24, 2000. BE IT FURTHER RESOLVED, That the City of Fairhope shall resume annexation at the regular quarterly scheduled January 1, 2001. This duly adopted Resolution shall be published once in the local Gulf Coast Newspaper. Adopted and Approved this the 24th Day of January—, 2000. Attest: eniece W. Johnson,Or 2418 24 JANUARY 2000 COUNCIL REVIEWED AN APPLICATION FOR A BEER/WINE OFF PREMISES LICENSE BY CLARENCE EUGENE TILLMAN, DBA TILLMAN'S SUPER STOP, LOCATED AT 859 FAIRHOPE AVENUE. COUNCILMEMBER FORD MOVED TO APPROVE THE ISSUANCE OF THE LICENSE. SECONDED BY COUNCILMEMBER PUCKETT, MOTION PASSED UNANIMOUSLY. COUNCIL REVIEWED AN APPLICATION FOR A SPECIAL RETAIL LICENSE (MORE THAN 30 DAYS) BY JAMES G. TANNER III, DBA THE CLUB AT ROCK CREEK - CABANA, LOCATED AT 1 42 CLUBHOUSE DRIVE. COUNCILMEMBER DUCK MOVED TO APPROVE THE ISSUANCE OF THE LICENSE. SECONDED BY COUNCILMEMBER QUINN, MOTION PASSED UNANIMOUSLY. MR. RICHARD WILLARD REQUEST TO ALLOW DEBRIS FROM A HOME DEMOLITION TO BE PLACED IN THE CITY OF FAIRHOPE LAND FIELD. THE HOUSE BEING DEMOLISHED IS LOCATED AT 202 SOUTH MOBILE STREET. THIS STRUCTURE IS LOCATED IN THE CITY LIMITS AND IS BEYOND REPAIR. THE CURRENT ORDINANCE INDICATE THAT DEBRIS FROM DEMOLISHED STRUCTURES MIST BE TAKEN TO MAGNOLIA LAND FIELD. COUNCILMEMBER PUCKETT MOVED TO DENY THE REQUEST. SECONDED BY COUNCILMEMBER QUINN, MOTION PASSED UNANIMOUSLY. COUNCILMEMBER DUCK MOVED TO GRANT THE REQUEST OF THE CHILDREN OF THE WORLD TO HAVE A SMALL PARADE TROUGH TOWN ON SATURDAY, FEBRUARY 5, 2000 AT 2:00 P.M. TO CELEBRATE CHINESE NEW YEAR. THE CELEBRATE WILL TAKE PLACE AT THE K- I CENTER. SECONDED BY COUNCILMEMBER FORD, MOTION PASSED UNANIMOUSLY. COUNCILMEMBER FORD MOVED TO GRANT THE REQUEST OF THOMAS HOSPITAL TO USE THE STREETS OF DOWNTOWN FAIRHOPE AND THE PARK ON MOBILE STREET FOR THE 22ND ANNUAL SPRING FEVER CHASE ON SATURDAY, 1 8 MARCH 2O00 AT 8:00 AM. SECONDED BY COUNCILMEMBER DUCK, MOTION PASSED UNANIMOUSLY. COUNCILMEMBER FORD ADDRESSED THE CITY COUNCIL ON BEHALF OF THE RECREATION BOARD REQUESTING PERMISSION TO LEASE A REEL MOWER. TO BE PAID BY THE RECREATION IMPROVEMENT FUND. COUNCILMEMBER FORD MOVED TO GRANT THE REQUEST. SECONDED BY COUNCILMEMBER DUCK, MOTION PASSED UNANIMOUSLY. 2419 24 JANUARY 2000 TWO 3-YEAR TERM ON THE BOARD OF ADJUSTMENT AND APPEALS AS AN ALTERNATE. COUNCILMEMBER QUINN MOVED TO APPOINT MR. BOBBY MANNICH. THE SECOND ALTERNATE POSITION WAS NOT FILLED AT THIS TIME. SECONDED BY COUNCILMEMBER FORD, MOTION PASSED UNANIMOUSLY. WAYNE SMITH PURCHASING AGENT ADDRESSED TO CITY COUNCIL REQUESTING THAT THE CITY COUNCIL REJECT THE CURRENT EMPLOYEE UNIFORM BID OF UNI-FIRST, GIVING A 30 DAY NOTICE (AWARDED AUGUST 16, 1999), AND AWARD THE BID TO RUS UNIFORMS. UNI-FIRST HAS NOT MET SPECIFICATIONS, AND THERE HAVE BEEN SEVERAL PROBLEMS WITH UNI- FIRST. COUNCILMEMBER FORD MOVED TO TAKE THE NEXT LOWEST BID SUBJECT TO IT BEING LEGAL, IF NOT GO OUT ON BIDS AGAIN. SECONDED BY COUNCILMEMBER DUCK, MOTION PASSED UNANIMOUSLY. CITY ATTORNEY MARION E. WYNNE WILL RESEARCH THE BID LAWS AND PROVIDE A RULING TO WAYNE SMITH. MAYOR NIX ANNOUNCED THAT CENSUS WILL START APRIL 1, 2000 AND ENCOURAGE ALL CITIZENS TO PARTICIPATE. MAYOR NIX RECOGNIZED BOY SCOUT MIKE FUQUA, AND HIS FATHER MR. DAVID FUQUA WITH TROOP #i 47. MIKE IS WORKING ON HIS COMMUNICATION BADGE.
