PRESENT WERE MAYOR JAMES P. NIX; COUNCILMEMBERS JOHN V. DUCK, MICHAEL A. FORD, JEANETTE PUCKETT, AND WILLIAM H. JONES; CITY ATTORNEY MARION E. WYNNE, AND CITY CLERK GENIECE W. JOHNSON. COUNCILMEMBER DEBBIE W. QUINN WAS ABSENT. THERE BEING A QUORUM PRESENT, MAYOR NIX CALLED THE MEETING TO ORDER. COUNCILMEMBER JONES MOVED TO APPROVE MINUTES OF THE 28 MAY 1 998 REGULAR MEETING. SECONDED BY COUNCILMEMBER PUCKETT, MOTION PASSED UNANIMOUSLY. COUNCILMEMBER DUCK INTRODUCED IN WRITING, AND MOVED FOR THE ADOPTION OF THE FOLLOWING RESOLUTION. SECONDED BY COUNCILMEMBER FORD, MOTION PASSED UNANIMOUSLY. 2171 RESOLUTION NO. 596-98 The City of Fairhope WHEREAS, Section 402(p) of the Clean Water Act (CWA) Amendments of 1987 require pollutant controls in stormwater discharges which include permit compliance conditions forvarious categories of stormwater discharges; and, WHEREAS, in compliance with the requirements of Section 402(p) of the CWA, the US Environmental Protection Agency (EPA) has established and published regulations governing stormwater discharge permit requirements under the National Pollutant Discharge Elimination System (NPDES) program; and, WHEREAS, these aforesaid permit requirements pertain to stormwater discharges associated with industrial activity, discharges from large municipal stormwater systems, and discharges from medium municipal separate stormwater systems; and, WHEREAS, the Alabama Department of Environmental Management (ADEM) is the Alabama State agency charged with the delineation of municipal areas that must obtain a NPDES permit for stormwater discharge, as well as with the approval and subsequent management of this permit; and, WHEREAS, ADEM has delineated a metropolitan area in Mobile County that includes the Cities of Mobile, Prichard, Chickasaw, Saraland, Satsuma, and Creola and part of the unincorporated area of Mobile County; and an area in Baldwin County that includes the Cities of Daphne, Fairhope, and part of the unincorporated area of Baldwin County; and, WHEREAS, each of the aforesaid local entities agreed by resolution to participate, under the coordination of the South Alabama Regional Planning Commission (SARPC), in a single metropolitan NPDES stormwater permitprocess on ashared cost basis which resulted in the issuance by ADEM of the Final Five Year NPDES Permit numbered ALS000002 and titled Mobile Area Municipal Separate Storm Sewer System (MS4) Mobile and Baldwin Counties; and, WHEREAS, the aforesaid NPDES Permit requires the implementation of a storm event sampling and analysis of stormwater program at each of the seven (7) outfalls identified in the NPDES Permit on an annual basis over the required time frame; and, WHEREAS, the annual cost basis for compliance with the final permit is also a pro rata share based on the 1990 US Census population of each local entity in the designated metropolitan stormwater management area as indicated in the following table; and 2172 Mobile County 39,457 11.9 Mobile City 19627$ 59.3 Prichard 34,311 10.4 Chickasaw 6,6492.0 Saraland Satsuma 11,751 3.5 5,194, 1.6 Creola 1,896 0.6 -Baldwin 15,691 Daphne 11,290 3.4 TOTAL 331,002 2.6 100.0 WHEREAS, the cost for the aforesaid permit requirements for second year stormwater monitoring program and associated administrative cost is Thirteen Thousand Two Hundred Fifty Three Dollars ($13,253.00) to be shared on a pro rata basis by the participating Mobile -Baldwin Stormwater Consortium member governments; NOW THEREFORE, BE IT RESOLVED, as follows: The City of Fairhope shall continue to actively participate in the Mobile -Baldwin Stormwater Consortium, including the data collection portion of the stormwater monitoring programs of the SWMP, the public education portion of the SWMP, the inter jurisdictional agreement, and the annual report required by the ADEM NPDES Permit Number ALS000002. 2. The City of Fairhope shall pay its pro rata share of its annual permit implementation in the amount of $345.00 to the South Alabama Regional Planning Commission, local coordinator of the Mobile -Baldwin Stormwater Consortium. THESE ACCOUNTS TOTAL $2-8,905.0 1 . SECONDED BY COUNCILMEMBER JONES, MOTION PASSED UNANIMOUSLY. ONE 5-YEAR TERM ON THE PERSONAL BOARD. COUNCILMEMBER PUCKETT MOVED TO REAPPOINT CHARLES JOHNSON. THERE BEING NO OTHER NOMINATIONS, COUNCILMEMBER DUCK MOVED TO CLOSED THE NOMINATION AND REAPPOINT MR. JOHNSON, BY ACCLAMATION. SECONDED BY COUNCILMEMBER JONES, MOTION PASSED UNANIMOUSLY. MAYOR NIX OPEN THE FLOOR FOR NOMINATIONS TO FILL THE LATE JOHN BEASLEYS POSITION ON THE INDUSTRIAL BOARD. MAYOR NIX NOMINATED RUSTY WINFREE. COUNCILMEMBER JONES MOVED TO APPOINT MR. WINFREE. SECONDED BY COUNCILMEMBER PUCKETT, MOTION PASSED UNANIMOUSLY. THIS IS A 6-YEAR TERM; HOWEVER, MR. WINFREE WILL SERVE UNTIL MAY, 2002. COUNCILMEMBER FORD REPORTED ON THE RESULTS OF THE SURVEY MAILED TO THE RESIDENTS LIVING ALONG SCENIC HIGHWAY 98 AND COUNTY ROAD ONE. THE SURVEY WILL DETERMINE THE INTEREST IN HAVING SEWER LINES INSTALLED. COUNCILMEMBER FORD REPORTED THAT OF THE 652 SURVEYS MAILED, 354 SURVEYS HAS BEEN RETURNED. 78% ARE INTERESTED AND 22% ARE NOT INTERESTED IN HAVING SEWER LINES INSTALLED. A SECOND NOTICE WILL BE MAILED WITH A CUT-OFF DATE OF 22 JUNE 1 998, UPON RECEIVING THE SECOND NOTICES COUNCILMEMBER FORD WILL BE ABLE TO DETERMINE IF THE REQUIRED 60% LAND FOOTAGE IS RECEIVED. MR. GLEN WILSON ADDRESSED THE COUNCIL STATING THAT THE FIRST SURVEY WAS MISLEADING. MR. WILSON'S UNDERSTANDING OF THE FIRST SURVEY WAS THAT THE SEWER LINES WOULD BE INSTALLED REGARDLESS OF THE RESULTS OF THE SURVEY. MAYOR NIX AND COUNCILMEMBER FORD EXPLAINED THAT THE FIRST SURVEY WAS MAILED ONLY TO SEE IF THERE WAS ENOUGH INTEREST IN THIS PROJECT. THE LINES WILL NOT BE INSTALLED IF THERE IS NOT ENOUGH INTEREST. COUNCILMEMBER JONES SO MOVED TO PAY BILLS AS PRESENTED. SECONDED BY COUNCILMEMBER PUCKETT, MOTION PASSED UNANIMOUSLY. MAYOR NIX ANNOUNCED THAT THE SEWER TREATMENT PLANT MAY POSSIBLY GO ON LINE 0 1 JULY 1 998. 217'4 08 JUNE 1 998 MR. SHEP SHEPHERD ASKED THAT COUNCIL HAVE NO U TURN SIGNS PLACED ALONG FAIRHOPE AVENUE BETWEEN BANCROFT STREET AND CHURCH STREET. TOO MANY CARS ARE MAKING U-TURNS BETWEEN THIS AREA. MAYOR Nix STATED THAT HE WOULD HAVE THE POLICE DEPARTMENT TO ADDRESS THIS PROBLEM. THERE BEING NO FURTHER BUSINESS TO COME BEFORE THE COUNCIL THE MEETING WAS DULY ADJOURNED AT 5:53 P.M. ES P.
