PRESENT WERE MAYOR JAMES P. NIX; COUNCILMEMBERS JOHN V. DUCK, MICHAEL A. FORD, DEBBIE W. QUINN, JEANETTE PUCKETT, AND WILLIAM H. JONES; CITY CLERK GENIECE W. JOHNSON. CITY ATTORNEY MARION E. WYNNE WAS ABSENT. THERE BEING A QUORUM PRESENT, MAYOR NIX CALLED THE MEETING TO ORDER. COUNCILMEMBER JONES MOVED TO APPROVE MINUTES OF THE 26 LJANUARY 1 998 REGULAR MEETING, AND 30 JANUARY 1 998 SPECIAL MEETING. SECONDED BY COUNCILMEMBER PUCKETT, MOTION PASSED UNANIMOUSLY. COUNCILMEMBER PUCKETT MOVED FOR THE ADOPTION OF THE FOLLOWING RESOLUTION. SECONDED BY COUNCILMEMBER QUINN, MOTION PASSED UNANIMOUSLY. RES0LU110N NUMBER 583-98 A RESOLUTION LIFTING THAT CERTAIN MORATORIUM ESTABLISHED BY RESOLUTION 574-97, ADOPTED 22 SEPTEMBER 1997: WHEREAS, THE CITY COUNCIL, ON 22 SEPTEMBER 1997. ESTABLISHED A MORATORIUM ON ISSUANCE OF BUILDING PERMITS WITHIN CERTAIN PORTIONS OF THE CENTRAL BUSINESS DISTRICT AS THE SAME EXISTED ON SEPTEMBER 22, 1 997 TO ALLOW THE FAIRHOPE PLANNING COMMISSION TIME TO STUDY CERTAIN PARKING CONSIDERATIONS, AND; WHEREAS, THE FAIRHOPE PLANNING COMMISSION HAS CAUSED SUCH STUDY TO MADE AND COMPLETED AND HAS FOUND NO NEED FOR CHANGES OF PARKING WITHIN THE CENTRAL BUSINESS DISTRICT AT THIS TIME, AND; WHEREAS, ThE MEMBERS IF SAID PLANNING COMMISSION HAVE VOTED UNANIMOUSLY THAT THE MORATORIUM NO LONGER SERVES A PURPOSE AND THAT ITS DISSOLUTION IS RECOMMENDED TO THE CITY COUNCIL; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA THAT THE MORATORIUM ESTABLISHED BY RESOLUTION NUMBER 574-97 BE AND THE SAME HEREBY IS LIFTED AND THE SAME IS HEREBY DECLARED TO BE VOID AND OF NO FORCE OR EFFECT HEREAFTER. SECONDED BY COUNCILMEMBER QUINN, MOTION TO SUSPEND THE RULES PASSED UNANIMOUSLY BY THE FOLLOWING VOTE: AYE -DUCK, FORD, QUINN, NIX, PUCKETT, AND JONES. NAY -NONE. COUNCILMEMBER DUCK MOVED FOR FINAL ADOPTION OF ORDINANCE NO. 1026. SECONDED BY COUNCILMEMBER JONES, MOTION FOR FINAL ADOPTION PASSED UNANIMOUSLY BY THE FOLLOWING VOTE: AYE -DUCK, FORD, QUINN, NIX, PUCKETT, AND JONES. NAY -NONE. COUNCILMEMBER FORD MOVED TO AUTHORIZE MAYOR, JAMES P. NIX TO SIGN AN AGREEMENT WITH AMEA SHOWING INTEREST IN A SCADA SYSTEM (SUPERVISORY CONTROL AND DATA ACQUISITION). SECONDED BY COUNCILMEMBER DUCK, MOTION PASSED UNANIMOUSLY. THE FAIRHOPE BAHA'I CENTENNIAL COMMITTEE ADDRESSED TO COUNCIL REQUESTING PERMISSION TO COMMEMORATE AND CELEBRATE THEIR I OOTH ANNIVERSARY OF THE BAHA'I FAITH IN FAIRHOPE. COUNCILMEMBER DUCK MOVED TO GRANT THE BAHA'I CENTENNIAL COMMITTEE REQUEST TO USE THE HENRY GEORGE PARK FOR A BROWN -BAG PICNIC ON 9 MAY 1 998, AT 1 2:00 NOON, AND TO CO-ORDINATE WITH THE CITY POLICE DEPARTMENT TO PARADE FROM THE PICNIC SITE TO THE CIVIC CENTER AT 2:30 PM. SECONDED BY COUNCILMEMBER FORD, MOTION PASSED UNANIMOUSLY. COUNCILMEMBER DUCK MOVED TO GRANT THE BALDWIN COUNTY COMMUNITY BAND'S REQUEST TO PLAY MAY 3Ro AND MAY 7TH AT 5:00 PM ON THE BLUFF OVERLOOKING THE ROSE GARDEN, AND APPROVED THEIR REQUEST TO PLAY AT THE 4TH OF JULY FESTIVITIES PROVIDED ALL LOGISTICS ARE WORKED OUT. SECONDED BY COUNCILMEMBER JONES, MOTION PASSED UNANIMOUSLY. COUNCILMEMBER FORD MOVED TO APPOINT MS. DARRELYN BENDER TO SERVE AS THE CITY'S FIRST APPOINTEE AND MR. Tim ROSSON TO SERVE AS THE CITY'S SECONDED APPOINTEE ON THE BALDWIN COUNTY ECONOMIC DEVELOPMENT ALLIANCE INCUBATOR COMMITTEE. SECONDED BY COUNCILMEMBER PUCKETT, MOTION PASSED UNANIMOUSLY. COUNCILMEMBER JONES MOVED TO APPROVE INSURANCE COVERAGE ON THE FOLLOWING VOLUNTEER FIRE PERSONS: DOBSON BROWN, TOMMY MCDONALD, AND JASON GANDY.
