AT 5:30 P.M.; FAIRHOPE MUNICIPAL COMPLEX COUNCIL CHAMBER;
1 6 1 NORTH SECTION STREET; FAIRHOPE, ALABAMA 36532; ON
MONDAY, 8 DECEMBER 1997.
PRESENT WERE MAYOR NAMES P. Nix; COUNCILMEMBERS JOHN V.
DUCK, MICHAEL A. FORD, DEBBIE W. QUINN, AND JEANETTE PUCKETT; CITY
ATTORNEY MARION E. WYNNE AND CITY CLERK GENIECE W. JOHNSON.
WILLIAM H. JONES WAS ABSENT.
THERE BEING A QUORUM PRESENT, MAYOR NIX CALLED THE MEETING
TO ORDER. COUNCILMEMBER DUCK MOVED TO APPROVE MINUTES OF THE
24 NOVEMBER 1 997 REGULAR MEETING. SECONDED BY COUNCILMEMBER
QUINN, MOTION PASSED UNANIMOUSLY.
A PUBLIC HEARING WAS HELD AS ADVERTISED ON A PROPOSED
ORDINANCE TO AMEND THE ZONING ORDINANCE. COUNCILMEMBER DUCK
INTRODUCED IN WRITING ORDINANCE No. 1025. THE PLANNING AND ZONING
COMMISSION RECOMMENDS APPROVAL OF THIS ORDINANCE. THE ORDINANCE
ADDRESSED VARIOUS HOUSEKEEPING ITEMS. NO ONE PRESENT WAS OPPOSED
TO THE AMENDMENT. IN ORDER TO TAKE IMMEDIATE ACTION COUNCILMEMBER
DUCK MOVED TO SUSPEND THE RULES. SECONDED BY COUNCILMEMBER
QUINN, MOTION TO SUSPEND THE RULES PASSED UNANIMOUSLY BY THE
FOLLOWING VOTE: AYE -DUCK, FORD, QUINN, NIX, AND, PUCKETT. NAY -NONE.
COUNCILMEMBER DUCK THEN MOVED FOR FINAL ADOPTION OF ORDINANCE NO.
025. SECONDED BY COUNCILMEMBER PUCKETT, MOTION FOR FINAL
ADOPTION PASSED UNANIMOUSLY BY THE FOLLOWING VOTE: AYE -DUCK, FORD,
QUINN, NIX, AND, PUCKETT. NAY -NONE.
COUNCILMEMBER FORD INTRODUCED IN WRITING, AND MOVED FOR THE
ADOPTION OF THE FOLLOWING RESOLUTION. SECONDED BY COUNCILMEMBER
QUINN, MOTION PASSED UNANIMOUSLY.

RESOLUTION NO, 580-97
WHEREAS, the Owners of Quail Run Subdivision are desirous
of having the street and the utilities therein accepted
for maintenance by the City Council in order that building
permits may lawfully issue, and;
WHEREAS, the General Superintendent of the City represents
that the physical improvements in the nature of streets,
drainage and utilities have been installed in substantial
conformity with City requirements, and;
WHEREAS, the City has received Engineers Certified As -
built Plans, test reports and lateral locations
substantially as required by Chapter 19 of the Code of
Ordinances, and; I
WHEREAS, the said owners have filed with the City Clerk
a maintenance bond conditioned upon full warranty of
materials and workmanship for a period of two years after
acceptance of such improvements as required by Chapter
19 of the Fairhope Code of Ordinances, and;
WHEREAS, the Plat of said Quail Run 2 which has been
recorded in the Probate Records of Baldwin County, Alabama
at Slide No. 1775-A, delineates thereon the subject street
therein as a public way;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF FAIRHOPE, ALABAMA that the said streets and the
utilities for said Subdivision be and the same hereby are
accepted for public maintenance subject to the bond posted
and repairs on curbs and trenches on Quail Creek Drive.
This resolution of acceptance shall not obligate the City
of Fairhope to maintain any utility or drainage facilities
outside the limits of the right-of-way of the public
street, whether or not such may be located within
dedicated easements. Work undertaken on rights -of -way
outside the limits of but which was essential to
development of Quail Run is the developers responsibility
and is properly subject to such maintenance bond for
warranty of material and workmanship therein and thereon.
ADOPTED this the 8th day of December 1997.

THE COUNCIL REJECTED A PROPOSAL BY RYAN S. IVEY WITH SBA, INC.
REPRESENTING SPRINT PICA, TO PLACE AN ANTENNA ON NICHOLS STREET
WATER TANK AND YENNE ROAD WATER TANK AT $600.00 PER MONTH PER
TANK. MAYOR NIX RECOMMENDED THAT SBA, INC. RENEGOTIATE THEIR OFFER
TO MATCH WHAT OTHER COMPANIES ARE CURRENTLY PAYING TO LEASE SPACE
ON THE SAME WATER TANKS.
COUNCIL REVIEWED AN APPLICATION FOR A BEER ON/OFF-PREMISES
LICENSE BY RICHARD T. BARRETT, DBA POINT CLEAR TENNIS CLUB, AT 6832
MARLOW ROAD . MR. BARRETT WAS PRESENT. NO ONE PRESENT WAS
OPPOSED TO THE LICENSE. THERE WAS POLICE APPROVAL OF THE
APPLICANT. COUNCILMEMBER PUCKETT MOVED TO APPROVE THE ISSUANCE OF
THE LICENSE. SECONDED BY COUNCILMEMBER FORD, MOTION PASSED
UNANIMOUSLY.
COUNCILMEMBER FORD MOVED TO APPROVE THE REQUEST OF THE
EASTERN SHORE CHAMBER OF COMMERCE TO HOLD THEIR ANNUAL OUTDOOR
ART SHOW ON MARCH 20, 2 1, AND 22, 1 998. SECONDED BY
COUNCILMEMBER QUINN, MOTION PASSED UNANIMOUSLY.
THE FOLLOWING STREETS WILL BE USED: MAGNOLIA AVENUE FROM BANCROFT STREET WEST TO 318
MAGNOLIA AVENUE (KEN SLADE'S OFFICE).
SECTION STREET FROM 55 N. SECTION STREET (OLD SOUTHERN VERANDA) SOUTH APPROXIMATELY TO GREERS/FOOD TIGER.
FAIRHOPE AVENUE FROM BANCROFT STREET WEST TO THE BARRICADES SET AT SUMMIT STREET.
CHURCH STREET FROM THE INTERSECTION OF FAIRHOPE AVENUE TO DE LA MARE STREET.
DE LA MARE STREET FROM CHURCH STREET TO SECTION STREET.
CHURCH STREET NORTH FROM THE INTERSECTION OF FAIRHOPE AVENUE TO THE ENTRY OF THE PUBLIC PARKING ENTRANCE FOR THE
PURPOSE OF LOCATING ONE-HALF OF THE FOOD COURT BOOTHS, PERMITTING A SMOOTHER FLOW OF TRAFFIC AND OPEN AREAS IN FRONT
OF THE MERCHANTS LOCATED THERE.
AND JOHNSON AVENUE FROM SECTION STREET EAST TO BANCROFT STREET.
COUNCILMEMBER DUCK MOVED TO APPROVE THE REQUEST FROM DR.
MARTIN LUTHER KING, JR. CELEBRATION COMMITTEE TO HOLD A MEMORIAL
MARCH ON MONDAY, 1 9 JANUARY 1 998, AT 1 0:00 AM. THE MARCH WILL
COMMENCE FROM THE FAIRHOPE FAULKNER STATE CAMPUS, EAST, ON
FAIRHOPE AVENUE TO SECTION STREET, NORTH ON SECTION STREET TO THE
FAIRHOPE CIVIC CENTER. SECONDED BY COUNCILMEMBER PUCKETT, MOTION
PASSED UNANIMOUSLY.
COUNCILMEMBER FORD MOVED TO APPROVE THE REQUEST FROM
AMERICAN DIABETES ASSOCIATION TO HOLD THEIR ANNUAL TOUR DE CURE
FUND RAISING EVENT AT FAIRHOPE CITY PIER ON SATURDAY, 1 6 MAY 1 998.
SECONDED BY COUNCILMEMBER DUCK, MOTION PASSED UNANIMOUSLY.
