TUESDAY, 1 2 NOVEMBER 1996.
PRESENT WERE MAYOR JAMES P. Nix; COUNCILMEMBERS JOHN V. DUCK,
MICHAEL A. FORD, DAVID E. BISHOP, JEANETTE PUCKETT, AND WILLIAM H.
JONES; AND DEPUTY CITY CLERK GENIECE W. JOHNSON. CITY ATTORNEY
MARION E. WYNNE AND CITY CLERK EVELYN P. PHILLIPS WERE ABSENT.
THERE BEING A QUORUM PRESENT, MAYOR Nix CALLED THE MEETING TO
ORDER. COUNCILMAN DUCK MOVED TO APPROVE MINUTES OF THE 28 OCTOBER
1996 REGULAR SESSION AS WRITTEN. SECONDED BY COUNCILMAN JONES,
MOTION PASSED UNANIMOUSLY.
A PUBLIC HEARING WAS HELD AS ADVERTISED ON AN ORDINANCE TO
REZONE HERBERT 0. AND RUTH L. PIERCERS, PROPERTY ON THE EAST SIDE OF
US 98 IMMEDIATELY SOUTH OF FAIRHOPE MEMORY GARDENS. FROM R I LOW
DENSITY SINGLE FAMILY RESIDENTIAL TO B4 BUSINESS AND PROFESSIONAL.
THE PLANNING be ZONING COMMISSION APPROVED THE REZONING. PROOF OF
PUBLICATION WAS PRESENTED. COUNCILMAN DUCK INTRODUCED ORDINANCE NO.
1 002 IN WRITING. IN ORDER TO TAKE IMMEDIATE ACTION, COUNCILMAN BISHOP
MOVED TO SUSPEND THE RULES. SECONDED BY COUNCILMAN FORD, MOTION TO
SUSPEND PASSED UNANIMOUSLY BY THE FOLLOWING VOTE: AYE -DUCK, FORD,
BISHOP, Nix, PUCKETT, AND JONES. NAY -NONE. COUNCILMAN DUCK THEN
MOVED FOR FINAL ADOPTION OF ORDINANCE NO. 1002. SECONDED BY
COUNCILWOMAN PUCKETT, MOTION TO FINAL ADOPT PASSED UNANIMOUSLY BY
THE FOLLOWING VOTE: AYE -DUCK, FORD, BISHOP, Nix, PUCKETT, AND JONES.

COUNCILMAN BISHOP INTRODUCED IN WRITING ORDINANCE NO. 1003, AN
ORDINANCE TO DECLARE A 251 BY 1 001 STRIP OF PROPERTY NO LONGER
NEEDED FOR PUBLIC OR MUNICIPAL PURPOSES. IN ORDER TO TAKE IMMEDIATE
ACTION, COUNCILMAN DUCK MOVED TO SUSPEND THE RULES. SECONDED BY
COUNCILMAN FORD, MOTION TO SUSPEND PASSED UNANIMOUSLY BY THE
FOLLOWING VOTE: AYE -DUCK, FORD, BISHOP, NIX, PUCKETT, AND JONES. NAY -
NONE. COUNCILWOMAN PUCKETT THEN MOVED FOR FINAL ADOPTION OF

COUNCILMAN BISHOP INTRODUCED IN WRITING, AND MOVED FOR THE
ADOPTION OF, THE FOLLOWING RESOLUTION. SECONDED BY COUNCILMAN DUCK,
MOTION PASSED UNANIMOUSLY:
RESOLUTION No. 545-96
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, THAT THE
CITY OF FAIRHOPE ELECTS TO COME UNDER THE PROVISIONS OF SECTION 10 OF ACT 96-572 OF
THE REGULAR SESSION OF THE 1996 LEGISLATURE WHICH GRANTS A COST -OF -LIVING INCREASE TO
PENSIONERS FORMERLY PARTICIPATING IN THE PRIOR RETIREMENT PLAN OF THE CITY OF FAIRHOPE.
THE CITY OF FAIRHOPE AGREES TO PROVIDE ALL FUNDS NECESSARY TO THE EMPLOYEES' RETIREMENT
SYSTEM TO COVER THE COST OF THE INCREASE AS PROVIDED BY SAID ACT FOR THOSE PENSIONERS
WHO RETIRED FROM THE CITY OF FAIRHOPE WITH THE AFOREMENTIONED INCREASE TO DE EFFECTIVE
WITH THE OCTOBER 1998 BENEFIT PAYMENTS.
ADOPTED THIS I ZTH DAY OF NOVEMBER, 1996.

COUNCIL CONSIDERED A REAPPLICATION FOR A RESTAURANT
LIQUOR LICENSE BY NOE ISLAS AND HIS PARTNERS: RAFAEL LEON,
LORENZO LEON-CAVARVUVIAS, AND JUAN JAIME-LEON, DBA EL GIRO 11,
800 NORTH SECTION STREET. (FORMERLY KK'S GRILL) NO ONE
PRESENT OBJECTED TO THE LICENSE. THERE WAS POLICE APPROVAL OF
THE REAPPLICATION. COUNCILMAN DUCK MOVED TO APPROVE THE
ISSUANCE OF THE LICENSE. SECONDED BY COUNCILMAN JONES, MOTION
PASSED UNANIMOUSLY.

FOUR-WAY STOP. AFTER DISCUSSION, COUNCILMAN JONES MOVED
AGAINST TURNING THIS INTERSECTION INTO A FOUR-WAY STOP.

COUNCILMAN JONES REPORTED THAT HE AND GENERAL
SUPERINTENDENT PHIL RUTHERFORD INVESTIGATED THE REQUEST OF
MR. NAMES BRYNE, WHITE GROVE SUBDIVISION, TO PLACE NO
ON -STREET PARKING SIGNS ON HUCKNALL & LOWERY STREETS. AFTER
DISCUSSION, COUNCILMAN JONES RECOMMENDED NOT POSTING NO
PARKING SIGNS. SECONDED BY COUNCILMAN FORD, MOTION PASSED
UNANIMOUSLY.
COUNCILMAN FORD MOVED TO PAY THE BILLS AS PRESENTED,
COUNCILMAN JONES SECONDED AND MOTION CARRIED UNANIMOUSLY.
MAYOR NIX MENTIONED THAT WE ARE PROUD OF THE FAIRHOPE
HIGH SCHOOL FOOTBALL TEAM. THEY WILL BE TRAVELING TO
BIRMINGHAM TO PLAY IN THE PLAY OFFS.
MAYOR NIX ANNOUNCED THAT THE CITY CURRENTLY HAS A BOND
RATE OF "A".
ELECTRIC SUPERINTENDENT AARON NORRIS ASKED THAT THE
DOWNTOWN MERCHANTS BEAR WITH THE ELECTRIC DEPARTMENT WHILE
PUTTING UP CHRISTMAS LIGHT FOR THE HOLIDAY SEASON. OVER ONE
MILLION LIGHTS WILL BE DISPLAYED AT THE ANNUAL "LIGHTING OF THE
TREES" IN DOWNTOWN FAIRHOPE SCHEDULED FOR THURSDAY,
NOVEMBER 2 1, 1996, AT 6:00 PM.
THERE BEING NO FURTHER BUSINESS, MEETING WAS DULY ADJOURNED AT
5:50 PM.
