PRESENT WERE MAYOR JAMES P. Nix; COUNCILMEMBERS JOHN V. DUCK, MICHAEL A. FORD, DAVID E. BISHOP, JEANETTE PUCKETT, AND LAYTON OVERSTREET; CITY ATTORNEY MARION E. WYNNE AND CITY CLERK EVELYN P. PHILLIPS. NO ONE WAS ABSENT. THERE BEING A QUORUM PRESENT, MAYOR NIX CALLED THE MEETING TO ORDER. COUNCILMAN DUCK MOVED TO APPROVE MINUTES OF THE JULY STH REGULAR SESSION AS WRITTEN. SECONDED BY COUNCILWOMAN PUCKETT, MOTION PASSED UNANIMOUSLY. A PUBLIC HEARING WAS HELD AS ADVERTISED ON THE ANNEXATION AND ZONING PETITION BY TANEY BRAZEAL & ROBERTA BENTON, WHOSE PROPERTY, OFF COUNTY ROAD 44 BY THE FAIRHOPE HIGH SCHOOL, IS TO BE ZONED B I LOCAL SHOPPING DISTRICT CONCURRENT WITH ANNEXATION. THIS ZONING WILL ALLOW THE CONSTRUCTION OF A 60-UNIT ASSISTED LIVING HEALTH CARE FACILITY. MS. CLAUDINE MCCLINTOC ASKED THE OWNERS REPRESENTATIVE WHAT HAS BEEN DONE ABOUT THE NOISE ABATEMENT FROM THE HIGH SCHOOL. SHE WAS ADVISED THAT BARRIERS OF TREES AND GROUND ELEVATION IS PLANNED, AS WELL AS EXTRA SOUNDPROOFING IN THE FACILITY. REPRESENTATIVE ALSO ADVISED FACILITY WILL BE SIMILAR TO "THE BIRCHES" AND WILL BE BUILT TO SPECIFICATIONS MAKING IT STRONG ENOUGH TO WITHSTAND HURRICANE WEATHER. AFTER SOME DISCUSSION, COUNCILMAN BISHOP INTRODUCED THE ORDINANCE TO ANNEX AND ZONE IN WRITING. THIS ORDINANCE WILL BE GIVEN FINAL CONSIDERATION AT A LATER DATE. COUNCILMAN DUCK INTRODUCED IN WRITING AN ORDINANCE TO ANNEX PROPERTY OF F. LEE AND JEANNE CAVER, LOCATED ON GAYFER AVENUE EXTENSION NEXT TO WHITE GROVE SUBDIVISION. IN ORDER TO TAKE IMMEDIATE ACTION ON THIS ORDINANCE, No. 999, COUNCILMAN DUCK MOVED TO SUSPEND THE RULES. SECONDED BY COUNCILWOMAN PUCKETT, MOTION TO SUSPEND PASSED UNANIMOUSLY BY THE FOLLOWING VOTE: AYE - DUCK, FORD, BISHOP, NIX, PUCKETT, AND OVERSTREET. NAY -NONE. AT THAT TIME, MAYOR NIX, COUNCILMAN BISHOP (PLACE I ), AND COUNCILMAN DUCK (PLACE 5), HAD NO OPPOSITION IN THEIR BIDS FOR RE-ELECTION AND THEREFORE ARE ELECTED TO NEW TERMS BEGINNING IN OCTOBER, 1 996. COUNCILMAN BISHOP MOVED TO AUTHORIZE BIDS ON A TRANSFORMER FOR THE TWIN BEECH ELECTRICAL SUBSTATION AND TO BUILD A NEW SUB -STATION ON FAIRHOPE AVENUE. SUPT. NORRIS ESTIMATES THE TOTAL COST WILL BE APPROXIMATELY $ 1 , 200,000.00. SECONDED BY COUNCILWOMAN PUCKETT, MOTION PASSED UNANIMOUSLY. COUNCILMAN DUCK MOVED TO AUTHORIZE BIDS ON HEAD WORKS FOR THE UPGRADING OF THE WASTEWATER PLANT. SECONDED BY COUNCILMAN FORD, MOTION PASSED UNANIMOUSLY. MS. MARY ANN LAPEZE MADE A STATEMENT BEFORE THE COUNCIL, ADVISING THEM OF HER PROBLEMS WITH THE BUILDING DEPARTMENT AND THE PLANNING & ZONING COMMISSION IN HAVING HER PROPERTY REZONED. MS. LAPEZE REQUESTED ZONING MAPS FOR THE PAST TWENTY YEARS AND FELT THE BUILDING DEPARTMENT'S REQUEST FOR COMPENSATION WAS EXORBITANT. SHE FELT HER REQUEST WAS REASONABLE AND THAT THE PUBLIC RECORDS, WHICH ARE OWNED BY THE PUBLIC, SHOULD BE AVAILABLE WHEN REQUESTED. MS. LAPEZE FELT SHE SHOULD ADVISE THE COUNCIL THAT THEY ARE THE ONES TO SET POLICY AND NOT DEPARTMENT HEADS. SHE ALSO FELT THE COUNCIL SHOULD "JUST FOLLOW THE LAW. " A GROUP OF EMPLOYEES FROM A NEW BUSINESS IN FAIRHOPE, SMITH TECHNOLOGY CORPORATION, WAS GREETED AND WELCOMED TO OUR CITY. BCM ENGINEERS, INC., A WHOLLY -OWNED SUBSIDIARY OF SMITH, HAS BEEN PROVIDING ENGINEERING SERVICES TO SOUTH ALABAMA SINCE 1928 FROM ITS MOBILE OFFICE.
