PRESENT WERE MAYOR JAMES P. Nix; COUNCILMEMBERS JOHN V. DUCK, MICHAEL A. FORD, JEANETTE PUCKETT, AND LAYTON OVERSTREET; AND CITY CLERK EVELYN P. PHILLIPS. COUNCILMAN DAVID ED BISHOP AND CITY ATTORNEY MARION E. WYNNE WERE ABSENT. THERE BEING A QUORUM PRESENT, MAYOR NIX CALLED THE MEETING TO ORDER. MINUTES OF THE 24 JUNE 1996 REGULAR SESSION WERE DULY APPROVED. COUNCILMAN OVERSTREET INTRODUCED IN WRITING, AND MOVED FOR THE ADOPTION OF, THE FOLLOWING RESOLUTION. SECONDED BY COUNCILMAN DUCK, MOTION PASSED UNANIMOUSLY: RESOLUTION NO. 52 1 -96 WHEREAS, THE OWNERS OF PHASE I, BELLE CHASE SUBDIVISION ARE DESIROUS OF HAVING THE STREETS AND THE UTILITIES THEREIN ACCEPTED FOR MAINTENANCE BY THE CITY COUNCIL IN ORDER THAT BUILDING PERMITS MAY LAWFULLY ISSUE; AND WHEREAS, THE GENERAL SUPERINTENDENT OF THE CITY REPRESENTS THAT THE PHYSICAL IMPROVEMENTS IN THE NATURE OF STREETS, DRAINAGE AND UTILITIES HAVE BEEN INSTALLED IN SUBSTANTIAL CONFORMITY WITH CITY REQUIREMENTS; AND WHEREAS, CITY HAS RECEIVED ENGINEERS CERTIFIED AS -BUILT PLANS, TEST REPORTS AND LATERAL LOCATIONS SUBSTANTIALLY AS REQUIRED BY CHAPTER 19 OF THE CODE OF ORDINANCES; AND WHEREAS, THE OWNERS HAVE PROVIDED TO THE CITY CLERK A BOND FOR MAINTENANCE OF THE IMPROVEMENTS AS REQUIRED BY THE CITY'S CODES AND REGULATIONS; AND WHEREAS, THE PLAT OF SAID PHASE I, BELLE CHASE, HAVING BEEN RECORDED IN THE BALDWIN COUNTY PROBATE RECORDS AT SLIDE No. 1659-A, DELINEATES THEREON THE SUBJECT STREETS THEREIN AS PUBLIC WAYS; NOW, THEREFORE BE IT RESOLVED BY THE Cf1Y COUNCIL OF THE Cr Y OF FAIRHOPE, ALABAMA, THAT THE SAID STREETS AND THE UTILITIES WITHIN SAID PHASE 1, BELLE CHASE SUB- DIVISION BE AND THE SAME HEREBY ARE ACCEPTED FOR PUBLIC MAINTENANCE, SUBJECT TO THE BOND POSTED. THIS RESOLUTION OF ACCEPTANCE SHALL NOT OBLIGATE THE CITY OF FAIRHOPE TO MAINTAIN ANY UTILITY OR DRAINAGE FACILITIES OUTSIDE THE LIMITS OF THE RIGHT-OF-WAY OF THE PUBLIC STREETS, WHETHER OR NOT SUCH MAY BE LOCATED WITHIN DEDICATED EASEMENTS. ADOPTED THIS 8TH DAY OF JULY, 1996. JAMES P. IX, MAYOR ATr sT EVELY PHILLIPS 8 JULY 1996 1798 COUNCILWOMAN PUCKETT MOVED TO APPROVE CHANGE ORDER # I , J.S. WALTON & COMPANY CONTRACT ON '95-'96 PUBLIC IMPROVEMENT ASSESSMENTS PROJECT, ROCK CREEK IV DIVISION. THIS WILL ADD 40 CALENDAR DAYS AND $40,309.84. SECONDED BY COUNCILMAN FORD, MOTION PASSED UNANIMOUSLY. COUNCIL DISCUSSED CULVERT REPAIRS NEEDED, MOSTLY ALONG FAIRHOPE AVENUE, ALL OVER TOWN. THE CULVERT, HAVING BEEN INSTALLED AS LONG AS FORTY OR FIFTY YEARS AGO, HAS DETERIORATED TO THE POINT WHERE IT MUST BE REPAIRED OR REPLACED. DUE TO THE DEPTH OF THE CULVERT, SOME OF IT 24-FEET DEEP, AND ITS LOCATION, HEAVY -TRAFFIC AREAS, QUOTES WERE OBTAINED FROM TWO COMPANIES THAT CAN DO THE JOB WITHOUT DIGGING UP THE CULVERT. THIS IS EXPENSIVE. AFTER SOME DISCUSSION, MAYOR NIX APPOINTED COUNCILMEN OVERSTREET AND FORD TO LOOK INTO THIS AND OBTAIN SOME FIGURES ON HOW MUCH IT WILL COST FOR THE CITY TO DO THE REPAIRS. THEY ARE TO REPORT AT THE NEXT REGULAR SESSION. COUNCIL MADE THE FOLLOWING APPOINTMENTS: ONE 6-YEAR TERM, MEDICAL CLINIC BOARD NORTH. COUNCILWOMAN PUCKETT MOVED TO REAPPOINT J. HILLMAN GRIGGS. THERE BEING NO OTHER NOMINATIONS, COUNCILMAN DUCK MOVED TO CLOSE THE NOMINATIONS AND REAPPOINT GRIGGS BY ACCLAMATION. SECONDED BY COUNCILMAN OVERSTREET, MOTION PASSED UNANIMOUSLY. THREE 6-YEAR TERMS, INDUSTRIAL BOARD. COUNCILMAN OVERSTREET MOVED TO REAPPOINT LONNIE PARDUE, JOHN BEASLEY, AND BOBBIE THOMAS. THERE BEING NO OTHER NOMINATIONS, COUNCILMAN OVERSTREET MOVED TO CLOSE THE NOMINATIONS AND REAPPOINT PARDUE, BEASLEY, AND THOMAS BY ACCLAMATION. SECONDED BY COUNCILMAN FORD, MOTION PASSED UNANIMOUSLY. COUNCILWOMAN PUCKETT MOVED TO PAY BILLS AS PRESENTED. SECONDED BY COUNCILMAN OVERSTREET, MOTION PASSED UNANIMOUSLY. AT THE END OF THE MEETING, MS. CLAUDINE MCCLINTOC ASKED IF THE CITY STILL HAD A POLICY AGAINST YARD SALE SIGNS BEING PUT ON UTILITY POLES. WHEN ASSURED THE POLICY IS STILL IN FORCE, SHE ASKED THAT SOMEONE ENFORCE IT, SHE HAS BEEN SEEING MORE AND MORE SIGNS TACKED TO UTILITY POLES RECENTLY AND SHE USE TO NEVER SEE THEM. 8 JULY 1996 1799 THERE BEING NO FURTHER BUSINESS, MEETING WAS DULY ADJOURNED AT 5:50 PM.
