PRESENT WERE MAYOR NAMES P. Nix; COUNCILMEMBERS
MICHAEL A. FORD, DAVID E. BISHOP, JEANETTE PUCKETT, AND LAYTON
OVERSTREET; CITY ATTORNEY MARION E. WYNNE AND CITY CLERK EVELYN
P. PHILLIPS. COUNCILMAN JOHN V. DUCK WAS ABSENT.
THERE BEING A QUORUM PRESENT, MAYOR NIX CALLED THE
MEETING TO ORDER. MINUTES OF THE 1 3 MAY 1996 REGULAR SESSION
WERE DULY APPROVED.
THE BALDWIN COUNTY TRAIL BLAZERS, A NONPROFIT GROUP OF
OUTDOOR ENTHUSIASTS, ARE TRYING TO ESTABLISH A COUNTYWIDE NETWORK
OF TRAILS FOR CITIZENS OF ALL AGES. MS. LEANN PIERSON, SERVING AS
MC, PRESENTED A SHORT SKIT ILLUSTRATING WHAT THE TRAILS WILL BE FOR
AND WHAT KINDS OF PEOPLE WILL USE THEM. A `WALKING FOOL" (CYNTHIA
MOSTELLAR) EXPLAINED WHY SHE WANTED MORE WALKING AREA AND WHAT
BENEFITS SHE RECEIVES BY WALKING; A "MOTHER, PULLING A RED WAGON
WITH TWO SMALL CHILDREN IN IT," (CARLA WILSON)STATED SHE AND HER
FRIENDS NEED TO HAVE A SAFE PLACE TO STROLL AND ENJOY NATURE WITH
THEIR YOUNG CHILDREN; A "BIKER" ROM BURTON) SAID HE WOULD MUCH
RATHER LEAVE HIS CAR AT HOME AND RIDE HIS BIKE TO WORK AND OTHER
PLACES; AND A "HANDICAPPED PERSON" (EARL MONROE) EXPLAINED THE
BENEFITS HE RECEIVES BY BEING ABLE TO GET OUTSIDE IN HIS WHEELCHAIR
WITHOUT ANOTHER PERSON'S HELP. AFTER THIS PRESENTATION,
TRAILBLAZERS PRESIDENT Jim GAMBILL ADDRESSED THE COUNCIL AND
STATED THE GROUP'S GOAL IS FOR SOME 26 MILES OF TRAIL ALL OVER
BALDWIN COUNTY. THE TRAIL WILL START IN DAPHNE AND WILL FIRST
TRAVEL SOUTH ALONG THE EASTERN SHORE. MR. GAMBILL STATED
CONGRESSMAN SONNY CALLAHAN IS VERY ENTHUSIASTIC ABOUT THE
PROJECT. THE GROUP REQUESTS THE COUNCIL TO ( I ) GIVE THEM ANY
FEEDBACK ABOUT THE PROJECT; (2) WRITE CALLAHAN ABOUT THE PROJECT
AND GIVE IT A BOOST; AND (3) WRITE RON POIROUX, ALABAMA DEPARTMENT
OF TRANSPORTATION, REQUESTING THAT THE 6-FOOT RUMBLE STRIP SOUTH
OF THE FAIRHOPE HIGH SCHOOL BE RESTRICTED TO I -FOOT, ALLOWING
THE 5-FEET LEFT TO BE USED AS PART OF THE TRAIL (US 98). AFTER
SOME DISCUSSION, COUNCILMAN BISHOP MOVED THAT THE LETTERS BE

WRITTEN TO SHOW OUR SUPPORT OF THE EASTERN SHORE TRAIL PROJECT.
SECONDED BY COUNCILMAN OVERSTREET, MOTION PASSED UNANIMOUSLY.
COUNCILMAN BISHOP INTRODUCED IN WRITING ORDINANCE NO.
998, AN ORDINANCE AMENDING ORD. NO. 747 TO PROTECT CERTAIN
TREES ON OTHER THAN SINGLE FAMILY RESIDENTIAL PROPERTY FROM LOSS
BY REQUIRING THE TREE COMMITTEE TO MAKE A RECOMMENDATION TO THE
CITY COUNCIL AS TO THE REMOVAL OF SUCH CERTAIN TREES. IN ORDER TO
TAKE IMMEDIATE ACTION, COUNCILMAN FORD MOVED TO SUSPEND THE
RULES. SECONDED BY COUNCILMAN OVERSTREET, MOTION TO SUSPEND
THE RULES PASSED UNANIMOUSLY BY THE FOLLOWING VOTE: AYE -FORD,
BISHOP, NIX, PUCKETT, AND OVERSTREET. NAY -NONE. DURING
DISCUSSION, MS. MARSHA GILHART AND MR. JOHN COMPTON, AND THE
GROUPS THEY REPRESENTED, HIGHLY ENDORSED THE ADOPTION OF THE
ORDINANCE. MR. VINCE VALENTIM SPOKE IN OPPOSITION, SAYING THERE
ARE TOO MANY ORDINANCES ON THE BOOKS ALREADY, AND THAT HE COULD
NOT SEE HOW THE CITY CAN KEEP A PERSON FROM CUTTING DOWN A TREE
IN HIS/HER OWN YARD, BUT WITHDREW HIS COMMENTS WHEN IT WAS POINTED
OUT THAT THE ORDINANCE WILL EXEMPT ALL SINGLE FAMILY RESIDENTIAL
PROPERTY.
COUNCILWOMAN PUCKETT THEN MOVED FOR FINAL ADOPTION OF ORDINANCE
NO. 998. SECONDED BY COUNCILMAN OVERSTREET, MOTION TO FINAL
ADOPT PASSED UNANIMOUSLY BY THE FOLLOWING VOTE: AYE -FORD,
BISHOP, NIX, PUCKETT, AND OVERSTREET. NAY -NONE.

IT IS THE RECOMMENDATION FROM THE GOLF COURSE THAT THE LOW BID BE
ACCEPTED. COUNCILMAN FORD MOVED TO ACCEPT THE $ 1 2,370.03 LOW
BID BY ALMS PUMP SERVICE, INC., PROVIDED ALL SPECIFICATIONS ARE MET.
SECONDED BY COUNCILMAN BISHOP, MOTION PASSED UNANIMOUSLY
COUNCILMAN BISHOP, CHAIRMAN, REPORTED HIS COMMITTEE HAD
MET AND DISCUSSED THE PARKING PROBLEM AT PIER STREET BOAT RAMP. IT
IS THEIR RECOMMENDATION THAT A SIGN BE PLACED AT THE RAMP AND IN THE

PARKING AREA SAYING THAT ANY VEHICLE PARKED OR USING THE BOAT RAMP
MUST HAVE A CURRENT BEACH DECAL. IF USER DOES NOT HAVE OR WANT A
DECAL, THEY MUST BUY A TICKET AT THE NORTH BEACH ENTRANCE BOOTH.
COUNCILMAN BISHOP ALSO MENTIONED SOME REPAIR WORK IS NEEDED ON THE
RAMP. COUNCILMAN BISHOP MOVED TO HAVE THE SIGNS INSTALLED.
SECONDED BY COUNCILWOMAN PUCKETT, MOTION PASSED UNANIMOUSLY.
PUBLIC WORKS SUPERINTENDENT Tim KANT ADVISED COUNCIL THAT
ADEM WAS GIVING HIS PEOPLE AT THE LANDFILL A HARD TIME BECAUSE OF
SOME MATERIALS BEING PLACED IN THE LANDFILL. TIM ASKED THAT ALL
CITIZENS TAKE CARE NOT TO PUT SUCH THINGS AS KITCHEN -GENERATED
GARBAGE, OIL -BASED PAINT, CAR & LAWNMOWER OIL, AND BATTERIES IN THE
LANDFILL.
MR. VINCE VALENTIM ADVISED COUNCIL TO CHECK OUT RISK FACTOR
BEFORE AGREEING TO DO ANYTHING FOR THE TRAIL BLAZERS PROJECT.
THERE BEING NO FURTHER BUSINESS, MEETING WAS DULY
ADJOURNED AT 6: 1 5 PM.
JAMES P. Nix, MAYOR
