PRESENT WERE MAYOR JAMES P. Nix; COUNCILMEMBERS
MICHAEL A. FORD, DAVID E. BISHOP, JEANETTE PUCKETT, AND LAYTON
OVERSTREET; CITY ATTORNEY MARION E. WYNNE AND CITY CLERK EVELYN
P. PHILLIPS. COUNCILMAN JOHN V. DUCK WAS ABSENT.
THERE BEING A QUORUM PRESENT, MAYOR NIX CALLED THE
MEETING TO ORDER. MINUTES OF THE 22 APRIL 1996 REGULAR SESSION
WERE DULY APPROVED.
MS. CHRISTY MICELI CAME BEFORE THE COUNCIL TO REQUEST
PERMISSION TO DELIVER AND PICK UP JET SKIS AT THE MUNICIPAL PIER.
SHE HAD FIRST REQUESTED PERMISSION TO SET UP HER RENTAL BUSINESS
ON THE PIER, BUT WITHDREW THIS REQUEST WHEN TOLD THE COUNCIL DOES
NOT ALLOW ANY PRIVATE BUSINESS TO LOCATE AT THE PUBLIC PIER. MS.
MICELI HAS PURCHASED A BUSINESS LICENSE, HOWEVER IT RESTRICTS HER
FROM DELIVERIES TO THE BEACH WITHOUT COUNCIL APPROVAL. AFTER
SOME DISCUSSION, COUNCIL DID NOT MOVE TO APPROVE THE REQUEST.
COUNCIL REVIEWED AN APPLICATION FOR A RESTAURANT LIQUOR
LICENSE BY SANDRA D. IVEY, DBA IVEY'S FINE DINING OF FAIRHOPE,
LOCATED AT THE HOMESTEAD VILLAGE, 920 PLANTATION BOULEVARD.
APPLICANT WAS APPROVED BY THE POLICE DEPARTMENT. NO ONE PRESENT
WAS OPPOSED TO THE LICENSE. COUNCILMAN FORD MOVED TO APPROVE
THE ISSUANCE OF THE LICENSE. SECONDED BY COUNCILWOMAN PUCKETT,
MOTION PASSED UNANIMOUSLY.
COUNCILMAN BISHOP INTRODUCED IN WRITING ORDINANCE NO.
997, AN ORDINANCE TO AMEND CITY CODE SECTION 20- 1 BY STATING
PENALTY IN THE SAME SECTION. IN ORDER TO TAKE IMMEDIATE ACTION,
COUNCILMAN FORD MOVED TO SUSPEND THE RULES. SECONDED BY
COUNCILMAN BISHOP, MOTION TO SUSPEND THE RULES PASSED
UNANIMOUSLY BY THE FOLLOWING VOTE: AYE -FORD, BISHOP, NIX,
PUCKETT, AND OVERSTREET. NAY -NONE. COUNCILMAN OVERSTREET THEN'
MOVED FOR FINAL ADOPTION OF ORDINANCE NO. 997. SECONDED BY
COUNCILMAN BISHOP, MOTION TO FINAL ADOPT PASSED UNANI - USLY BY
THE FOLLOWING VOTE: AYE -FORD, BISHOP, NIX, PUCK AND
OVERSTREET. NAY -NONE

COUNCILWOMAN PUCKETT INTRODUCED IN WRITING, AND MOVED
FOR THE ADOPTION OF, THE FOLLOWING RESOLUTION. SECONDED BY
COUNCILMAN OVERSTREET, MOTION PASSED UNANIMOUSLY:
RESOLUTION NO.
WHEREAS, the Owners of Calloway Place Subdivision
are desirous of having the street and the utilities
therein accepted for maintenance by the City Council in
order that building permits may lawfully issue, and;
WHEREAS, the General Superintendent of the City represents
that the physical improvements in the nature of streets,
drainage and utilities have been installed in substantial
conformity with City requirements, and;
WHEREAS, City has received Engineer's Certified As -
built Plans, test reports and lateral locations
substantially as required by Chapter 19 of the Code of
Ordinances, and;
WHEREAS, the owners have provided to the City Clerk a
bond for maintenance of the improvements as required by
the City's codes and regulations, and;
WHEREAS, the Plat of said Calloway Place having been
recorded in the Probate Records of Baldwin County, Alabama
at Slide No. 1648-A, delineates thereon the subject
streets therein as public ways;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF FAIRHOPE, ALABAMA that the said street and the
utilities within said Calloway Place be and the same
hereby are accepted for public maintenance subject to the
bond posted. This resolution of acceptance shall not
obligate the City of Fairhope to maintain any utility or
drainage facilities outside the limits of the right-of-way
of the public street, whether or not such may be located
within dedicated easements. Further, the adoption of this
resolution by the Council creates no obligation of the
City with respect to maintenance of Thompson -Hall Road.

BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY
OF FAIRHOPE, ALABAMA, THAT MAYOR JAMES P. Nix Is
HEREBY AUTHORIZED TO EXECUTE A RENTAL AGREEMENT BETWEEN
THE CITY AND JOHN W. BEBOUT, INC., REPRESENTING
PCS PRIMECO, A WIRELESS MOBILE TELEPHONE COMPANY;
PRIMECO WILL INSTALL NINE (9) PANEL ANTENNAS ON THE
FAIRHOPE AVENUE WATER TANK, WITH THREE OR FOUR
20' X 20' EQUIPMENT CABINETS. AGREEMENT IS FOR FIVE
YEARS WITH FOUR 5-YEAR RENEWAL OPTIONS, AT AN ORIGINAL
ANNUAL RENT OF $9,000.00, PAYABLE IN ADVANCE, AND
WITH A 20% INCREASE AT EACH RENEWAL.
