PRESENT WERE MAYOR JAMES P. Nix; COUNCILMEMBERS JOHN V. DUCK, MICHAEL A. FORD, DAVID E. BISHOP, JEANETTE PUCKETT, AND LAYTON OVERSTREET; CITY ATTORNEY MARION E. WYNNE AND CITY CLERK EVELYN P. PHILLIPS. NO ONE WAS ABSENT. THERE BEING A QUORUM PRESENT, MAYOR NIX CALLED THE MEETING TO ORDER. MINUTES OF THE 8 APRIL 1996 REGULAR SESSION WERE DULY APPROVED. COUNCILMAN DUCK INTRODUCED IN WRITING, AND MOVED FOR THE ADOPTION OF, THE FOLLOWING RESOLUTION. SECONDED BY COUNCILWOMAN PUCKETT, MOTION PASSED UNANIMOUSLY: RESOLUTION NO. 5 1 4-96 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, THAT MAYOR NAMES P. NIX IS HEREBY AUTHORIZED TO EXECUTE A CONTRACT BETWEEN THE CITY AND FAULKNER STATE COMMUNITY COLLEGE (FAULKNER STATE) ON THE SHARED USE OF THE COMINGS HALL GYM. TERM IS TO BE FOR FIVE (5) YEARS WITH ONE 5-YEAR RENEWAL OPTION. THE CITY'S USE OF THE GYM IS FOR THE BENEFIT OF THE FAIRHOPE SUMMER YOUTH PROGRAM AND FOR THE FAIRHOPE TEEN CENTER. SHARED USE SHALL BE AS SET FORTH IN THAT CERTAIN DOCUMENT ENTITLED "JOINT USE AGREEMENT", DATED 1 2 APRIL 1996. ADOPTED THIS 22ND DAY OF APRIL, 1 996. 2 2 APRIL 1996 1764 COUNCILMAN BISHOP INTRODUCED ORDINANCE No. 996 IN WRITING. THIS ORDINANCE IS TO ANNEX A I -ACRE LOT IN FAIRHOPE ACRES AS PER ANNEXATION PETITION PRESENTED BY PROPERTY OWNERS, TERRY W. AND THERESA M. DAVIS, SR. IN ORDER TO TAKE IMMEDIATE ACTION, COUNCILMAN DUCK MOVED TO SUSPEND THE RULES. SECONDED BY COUNCILMAN OVERSTREET, MOTION TO SUSPEND PASSED UNANIMOUSLY BY THE FOLLOWING VOTE: AYE -DUCK, FORD, BISHOP, NIX, PUCKETT, AND OVERSTREET. NAY -NONE. SECONDED BY COUNCILWOMAN PUCKETT, MOTION PASSED UNANIMOUSLY. MAYOR NIX REPORTED THE OVER- I 0-INCHES OF RAIN LAST WEEKEND DID NOT CAUSE ANY MAJOR PROBLEMS FOR OUR UTILITY SYSTEMS. SOME MINOR PROBLEMS WERE TAKEN CARE OF BY THE ELECTRICAL AND WATER&SEWER DEPARTMENTS. THERE WAS NO DAMAGE TO THE GAS SYSTEM. THE COUNCIL WISHED GAS SUPERINTENDENT STEVE SEAY GOOD LUCK UPON HEARING THE NEWS THAT A LOCAL NATIONAL GUARD UNIT HAS BEEN ACTIVATED AND WILL BE LEAVING FOR BOSNIA ON MAY I ST. THIS WILL AFFECT TWO OTHER EMPLOYEES BESIDES SEAY. 22 APRIL 1996 1769 MRS. CLAUDINE MCCLINTOC CAME BEFORE THE COUNCIL WITH SEVERAL ITEMS OF CONCERN THAT SHE WISHED TO BRING TO THEIR ATTENTION. SHE ASKED IF THERE WAS SOME WAY TO STOP A TRUCK FROM USING INGLESIDE AVENUE TO MAKE DELIVERIES TO THOMAS HOSPITAL. WHEN TOLD THE ORDINANCE AGAINST TRUCK TRAFFIC DID NOT INCLUDE INGLESIDE, SHE ASKED THAT THE ORDINANCE BE CHANGED. MAYOR NIX ASKED STREET COMMITTEE CHAIRMAN OVERSTREET IF HE, AND GENERAL SUPERINTENDENT f HIL RUTHERFORD, WOULD CHECK INTO THIS COMPLAINT AND MAKE A REPORT TO THE COUNCIL. MRS. MCCLINTOC WENT ON TO LIST OTHER ITEMS, SUCH AS "DO NOT HAVE A COUNCIL MEETING THE NIGHT BEFORE MARDI GRAS" , HAVE COUNCIL MEETING AGENDA PRINTED IN NEWSPAPERS, AND HAVE "CITY OF FAIRHOPE" ON ALL LEGAL ADS HAVING TO DO WITH OUR CITY. COUNCILMAN BISHOP ASKED TO BRING UP AN ITEM OF OLD BUSINESS. THE ALABAMA SPORTS FESTIVAL WOULD LIKE TO HOLD A SKATING RACE IN FAIRHOPE, INSTEAD OF THE BIKE RACE, ON SUNDAY, JUNE 30, AT THE MUNICIPAL PIER. COUNCILMAN BISHOP MOVED TO APPROVE THIS REQUEST. SECONDED BY COUNCILMAN DUCK, MOTION PASSED UNANIMOUSLY. THERE BEING NO FURTHER BUSINESS, MEETING WAS DULY ADJOURNED AT 6:06 PM.
