PRESENT WERE MAYOR JAMES P. Nix; COUNCILMEMBERS JOHN V. DUCK, MICHAEL A. FORD, DAVID E. BISHOP, JEANETTE PUCKETT, AND LAYTON OVERSTREET; CITY ATTORNEY MARION E. WYNNE AND CITY CLERK EVELYN P. PHILLIPS. NO ONE WAS ABSENT. THERE BEING A QUORUM PRESENT, MAYOR NIX CALLED THE MEETING TO ORDER. MINUTES OF THE 19 FEBRUARY 1996 REGULAR SESSION WERE DULY APPROVED. AN ORDINANCE AMENDING THE ZONING ORDINANCE WAS INTRODUCED AT 19 FEBRUARY REGULAR MEETING AND HELD OVER FOR FINAL CONSIDERATION AT THIS MEETING. COUNCILMAN BISHOP MOVED FOR FINAL ADOPTION OF ORDINANCE NO. 995. SECONDED BY COUNCILMAN DUCK, MOTION PASSED UNANIMOUSLY BY THE FOLLOWING VOTE: AYE -DUCK, FORD, BISHOP, NIX, PUCKETT, AND OVERSTREET. NAY -NONE. COUNCILMAN DUCK INTRODUCED IN WRITING, AND MOVED FOR THE ADOPTION OF, THE FOLLOWING RESOLUTION. SECONDED BY COUNCILMAN OVERSTREET, MOTION CARRIED BY THE FOLLOWING VOTE: AYE -DUCK, BISHOP, NIX, PUCKETT, AND OVERSTREET. NAY - NONE. ABSTAIN -FORD. (RES. No. 5 1 0-96 ON FOLLOWING PAGE...) 1 4 MARCH 1996 RESOLUTION NO. 5 10-96 WHEREAS, THE BUILDING OFFICIAL OF THE CITY OF FAIRHOPE, ALABAMA, PURSUANT TO PROVISIONS OF ARTICLE V, CHAPTER 7 OF THE FAIRHOPE CODE OF ORDINANCES, HAS INVESTIGATED A BUILDING WHICH EXISTED ON LOT 9, BLOCK 1 4, VOLANTA (MISC BOOK I , P. 34 1 , BALDWIN COUNTY, ALABAMA, PROBATE RECORDS) AT 5 19 GRAND AVENUE AND HAS FOUND THE SAME TO BE A DAN- GEROUS BUILDING WITHIN THE MEANING OF SECTION 7-86 OF SAID CODE AND A PUBLIC NUISANCE; AND WHEREAS, THE SAID BUILDING OFFICIAL HAS POSTED NOTICE OF THE DANGEROUS BUILDING AND PROVIDED A COPY OF SUCH NOTICE TO THE OWNER THEREOF AND HAS COORDINATED WITH THE CITY ATTORNEY THE PROPER DETERMINATION OF AND NOTICE TO PARTIES AT INTEREST; AND WHEREAS, THE CITY ATTORNEY HAS CAUSED PROPER NOTICE TO BE GIVEN TO PARTIES AT INTEREST; AND WHEREAS, THE CITY COUNCIL ON 26 AUGUST 1995, CONDUCTED A PUBLIC HEARING AS PROVIDED IN SECTION 7-90 OF SAID CODE, GRANTED A STAY OF SIXTY DAYS FOR OWNER TO REPAIR OR DESTROY THE BUILDING, AND FURTHER PROVIDED THAT UPON OWNERS FAILURE TO ACT WITHIN SIXTY DAYS, THE CITY WILL CAUSE THE BUILDING TO BE DEMOLISHED; AND WHEREAS, THE CITY DID, ON 26 FEBRUARY 1996, CAUSE ITS CONTRACTOR TO DEMOLISH THE BUILDING AT A COST OF $4,000.00, AND THAT THE CITY DID INCUR FURTHER ADMINISTRATIVE COSTS OF $500.00 IN CONNECTION WITH THE PUBLIC NUISANCE; NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA, THAT THE CITY ATTORNEY BE, AND HEREBY IS, INSTRUCTED TO PROCEED UNDER PROVISIONS OF SECTION 7-92 OF SAID CODE TO INSTITUTE ANY AND ALL LEGAL PROCEEDINGS NECESSARY TO SECURE THE CITY'S RECOVERY OF COSTS INCURRED IN CONNECTION WITH THE PUBLIC NUISANCE ELIMINATED. ADOPTED THIS 14TH DAY OF MARCH, 1 996. J MES P. Nix, MAYOR ATTEST EVEL+PHILL19PSCITY CLERK 1748 14 MARCH 1996 1749 COUNCIL CONSIDERED AN APPLICATION FOR A RESTAURANT LIQUOR LICENSE BY JEAN PIERRE SEMAY, DBA "JEAN PIERRE" , LEON DE LYON, INC., 302 DELAMARE AVENUE. THERE WAS POLICE APPROVAL OF THE APPLICANT. COUNCILMAN DUCK MOVED TO APPROVE THE ISSUANCE OF THE LICENSE. SECONDED BY COUNCILWOMAN PUCKETT, MOTION PASSED UNANIMOUSLY. COUNCILMAN FORD MOVED TO AUTHORIZE MAYOR NIX TO NEGOTIATE WITH FAULKNER COMMUNITY COLLEGE ON USING COMMINGS HALL FOR A TEEN CENTER, AND ON PROVIDING CLASS ROOMS FOR DAY CAMP THIS SUMMER. SECONDED BY COUNCILMAN BISHOP, MOTION PASSED UNANIMOUSLY. WHEN COUNCIL MOVED TO ACCEPT THE BALDWIN COUNTY COMMISSIONS PROPOSAL AS PRESENTED ON 12 FEBRUARY 1996, THEY WERE SURPRISED TO LEARN THAT THE COUNTY AGREED TO DO THE WORK OF RESURFACING AND WIDENING FAIRHOPE AVENUE FROM GREENO ROAD EAST TO COUNTY ROAD 27 AND SPLIT THE COST WITH THE CITY, PROVIDED THE CITY WILL ACCEPT THE MAINTENANCE OF THE ROAD AFTER JOB IS COMPLETE. COUNCILWOMAN PUCKETT MOVED TO ACCEPT THE MAINTENANCE PROVIDED AN AGREEMENT IS SIGNED BY THE COUNTY COMMISSION STATING ( I ) ROAD WILL BE RESURFACED AND WIDENED ACCORDING TO CITY SPECIFICATIONS, (2) COUNTY WILL HELP THE CITY SHOULD ANY MAJOR MAINTENANCE WORK COME UP, AND (3) A TURN LANE IS PROVIDED AT THE SCHOOL. SECONDED BY COUNCILMAN OVERSTREET, MOTION PASSED UNANIMOUSLY. COUNCILMAN FORD MOVED TO APPROVE AN APPROPRIATION OF $3,000.00 TO THE VOLUNTEER FIRE DEPARTMENT TO SEND FIREMEN TO THE FIRE COLLEGE THIS YEAR. SECONDED BY COUNCILMAN DUCK, MOTION PASSED UNANIMOUSLY. A LETTER WAS READ FROM MR. RAYMOND ZICARELLI, 103 LAUREL AVENUE, REQUESTING A 3-WAY STOP SIGN BE PLACED AT SATSUMA AND LAUREL. MAYOR NIX APPOINTED COUNCILMEN OVERSTREET (CHAIR) AND BISHOP, WITH GENERAL SUPT. PHIL RUTHERFORD, AS A COMMITTEE TO LOOK INTO THE SITUATION AND REPORT TO THE COUNCIL AS SOON AS POSSIBLE. 14 MARCH 1996 1750 A LETTER WAS READ FROM MRS. MICHELLE JANASEK, 103 PECAN AVENUE, ALSO REQUESTING A STOP SIGN. THIS MATTER WAS ALSO TURNED OVER TO THE ABOVE COMMITTEE FOR INVESTIGATION, AND A REPORT TO THE COUNCIL AS SOON AS POSSIBLE. MR. JOHN ROGERS, 306 NORTH SUMMIT, CAME BEFORE COUNCIL REQUESTING PERMISSION TO BUILD A FENCE ONTO CITY PROPERTY ADJACENT TO THE WASTEWATER TREATMENT PLANT. THE FENCE WOULD EXTEND ABOUT 20 FEET ONTO THE CITY PROPERTY. MR. ROGERS WAS TOLD HIS REQUEST WILL HAVE TO BE RESEARCHED BY THE CITY ATTORNEY BEFORE AN ANSWER CAN BE GIVEN. THIS WILL BE DONE AS SOON AS POSSIBLE. COUNCILMAN FORD, REPRESENTING THE FAIRHOPE RECREATION BOARD, REQUESTED $ 1 5,000.00 OUT OF THE RECREATION IMPROVEMENT FUND FOR REPAIRS TO THE SWIMMING POOL. COUNCILMAN FORD THEN MADE THIS REQUEST HIS MOTION TO APPROVE. SECONDED BY COUNCILMAN DUCK, MOTION PASSED UNANIMOUSLY. A REPORT FROM GENERAL SUPERINTENDENT PHIL RUTHERFORD WAS READ: SEALED BIDS ON REPAIR WORK TO RESTORE MUNICIPAL PIER TO ITS CONDITION PRIOR TO HURRICANE OPAL WERE OPENED ON 29 FEBRUARY 1996 AS ADVERTISED. COUNCILMAN BISHOP MOVED TO ACCEPT THE LOW BID BY MORGAN DREDGING & PILEDRIVING, INC., PROVIDED ALL SPECIFICATIONS ARE MET, BY INTRODUCING THE FOLLOWING RESOLUTION IN WRITING. SECONDED BY COUNCILMAN DUCK, MOTION PASSED UNANIMOUSLY: 14 MARCH 1 996 RESOLUTION NO. 5 1 1 -96 BE IT RESOLVED BY THE CITY COUNCIL OF THE CRY OF FAIRHOPE, ALABAMA, THAT MAYOR NAMES P. NIX IS HEREBY AUTHORIZED TO EXECUTE A CONTRACT BETWEEN THE CITY AND MORGAN DREDGING AND PILEDRIVING, INC., SPANISH FORT, AL, IN THE AMOUNT OF $ 1 6.928.00, FOR REPAIR WORK TO RESTORE FAIRHOPE MUNICIPAL PIER TO ITS CONDITION PRIOR To HURRICANE OPAL, UNDER THE SUPERVISION OF GENERAL SUPT. MR. SHEP SHEPHERD ADDRESSED THE COUNCIL ABOUT RESERVED PARKING SPACES FOR VISITORS TO THE CITY MUSEUM. THIS MATTER WAS ALSO TURNED OVER TO MR. OVERSTREET'S COMMITTEE FOR A REPORT AS SOON AS POSSIBLE.
