THERE BEING A QUORUM PRESENT, MAYOR NIX CALLED THE
MEETING TO ORDER. MINUTES OF THE 8 JANUARY 1 996 REGULAR
SESSION WERE DULY APPROVED.
MS. PEGGY VANOVER OF BALDWIN COUNTY ELECTRIC
MEMBERSHIP CORPORATION PRESENTED THEIR BUSINESS LICENSE
CHECK. THE CHECK, FOR $7,743.39, REPRESENTS A PERCENTAGE
OF BCEMC's BUSINESS REVENUES IN THE POLICE JURISDICTION.
A PUBLIC HEARING WAS HELD AS ADVERTISED ON AN
ORDINANCE TO ANNEX AND ZONE PROPERTY OWNED BY MRS. OLYMPIA C.
RYAS, LOCATED IMMEDIATELY ADJACENT TO THE SOUTH OF MONTROSE
WOODS DRIVE AND EAST OF US HIGHWAY 98. PARCEL CONTAINS SOME
4.5 ACRES, MORE OR LESS, AND IS ANNEXED AS R3 PGH,
PATIO/GARDEN HOMES. THE PLANNING & ZONING COMMISSION
APPROVED THE ZONING. PROOF OF PUBLICATION WAS PRESENTED.
COUNCILMAN BISHOP INTRODUCED ORDINANCE No. 990 IN WRITING. IN
ORDER TO TAKE IMMEDIATE ACTION, COUNCILWOMAN PUCKETT MOVED TO
SUSPEND THE RULES. SECONDED BY COUNCILMAN OVERSTREET, MOTION
TO SUSPEND PASSED UNANIMOUSLY BY THE FOLLOWING VOTE: AYE -
DUCK, FORD, BISHOP, NIX, PUCKETT, AND OVERSTREET. NAY -NONE.
COUNCILMAN BISHOP THEN MOVED FOR FINAL ADOPTION OF ORDINANCE
NO. 990. SECONDED BY COUNCILWOMAN PUCKETT, MOTION TO FINAL
ADOPT PASSED UNANIMOUSLY BY THE FOLLOWING VOTE: AYE -DUCK,
FORD, BISHOP, NIX, PUCKETT, AND OVERSTREET. NAY -NONE.
COUNCILMAN DUCK INTRODUCED IN WRITING, AND MOVED FOR
THE ADOPTION OF, THE FOLLOWING RESOLUTION, AUTHORIZING A
CONTRACT WITH FRAZER-LANIER, INVESTMENT BANKERS, TO ACT AS THE
CITY'S FISCAL AGENT FOR THE BOND ISSUE TO FUND THE 1995-96

LOWEST BIDDER OF EIGHT FINANCIAL INSTITUTIONS INVITED TO BID.

BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY
OF FAIR HOPE, ALABAMA, that Mayor James P. Nix is here-
by authorized to execute a contract between the CITY and
FRAZER-LANIER, INC., of Montgomery, for Frazer-Lanier's
services as Fiscal Agent for the 1996 Bond Issue to finance
the 1995-96 Public Improvements Assessment Project.

COUNCIL CONSIDERED THE FOLLOWING REQUESTS FROM MS.
VIVIAN SISCO, REPRESENTING THE FAIRHOPE YACHT CLUB:
I . PERMISSION TO USE PARKING LOT AT VOLANTA BALLPARK FOR
PARTICIPANTS AND VISITORS FOR THE 1 996 DAUPHIN ISLAND REGATTA
ON APRIL 26, 27, AND 26, 1 996.
COUNCILMAN OVERSTREET MOVED TO ALLOW THIS REQUEST SUBJECT TO
APPROVAL BY THE RECREATION BOARD. SECONDED BY COUNCILMAN
BISHOP, MOTION PASSED UNANIMOUSLY.
2. BARRICADE VOLANTA AVENUE AT SECTION STREET, EXCEPT FOR
LOCAL RESIDENTS. FYC VOLUNTEERS WILL DIRECT TRAFFIC BUT
REQUEST POLICE PERSONNEL TO HELP WITH THIS.
MS. SISCO WAS TOLD THIS REQUEST WILL HAVE TO BE WORKED OUT WITH
THE POLICE DEPARTMENT.
3. REQUEST POLICE SECURITY DURING THE NIGHTS OF THE REGATTA.
MS. SISCO WAS ADVISED THE POLICE WILL MAKE ORDINARY PATROLS

THROUGH THE AREA BUT CANNOT GUARANTEE 24-HOUR SECURITY, THE
YACHT CLUB WILL HAVE TO MAKE PRIVATE ARRANGEMENTS FOR ALL-NIGHT
SECURITY.
4. REQUEST AN EXTENSION OF THE CITY'S SOUND ORDINANCE, FROM
1 0:00 PM TO I 1 :00 PM, DURING THE SKIPPERS PARTY ON THE
2 6TH .
COUNCILMAN OVERSTREET MOVED TO ALLOW THE EXTENSION, BUT ONLY
IF NO COMPLAINTS COME IN. SECONDED BY COUNCILWOMAN PUCKETT,
MOTION PASSED UNANIMOUSLY.
A PUBLIC HEARING WAS HELD AS ADVERTISED ON AN
APPLICATION FOR A CLUB LIQUOR LICENSE BY TAMARA WINTZELL, DBA
JUBILEE LOUNGE, AT 902 MORPHY AVENUE. NO ONE PRESENT WAS
OPPOSED TO THE LICENSE. THERE WAS POLICE APPROVAL OF THE
APPLICANT. (BUSINESS PREVIOUSLY OPERATED HERE, HAD A CLUB
LICENSE.) COUNCILMAN FORD MOVED TO APPROVE THE ISSUANCE OF THE
LICENSE. SECONDED BY COUNCILMAN DUCK, MOTION PASSED
UNANIMOUSLY.
COUNCIL CONSIDERED AN APPLICATION FOR A BEER OFF -
PREMISES LICENSE AND A WINE OFF -PREMISES LICENSE BY DONALD W.
CARTER, DBA MONEY BACK FOOD STORE, 404 NORTH SECTION
STREET. THERE WAS POLICE APPROVAL OF THE APPLICANT.
COUNCILMAN DUCK MOVED TO APPROVE THE ISSUANCE OF THE
LICENSES. SECONDED BY COUNCILMAN BISHOP, MOTION PASSED
UNANIMOUSLY.
COUNCIL CONSIDERED AN APPLICATION FOR A BEER ON/OFF
PREMISES LICENSE BY EMILY WILSON SMITH, DBA THE KOZY KORNER,
1 6755 TWIN BEACH ROAD. THERE WAS POLICE APPROVAL OF THE
APPLICANT. COUNCILMAN FORD MOVED TO APPROVE THE ISSUANCE OF
THE LICENSE. SECONDED BY COUNCILMAN DUCK, MOTION PASSED
UNANIMOUSLY.
COUNCILMAN FORD OUTLINED SEVERAL SAFETY FEATURES AT
VOLANTA PARK THAT NEED UPGRADING: SOME FENCING, CONCRETE FOR
TWO NEW BATTING CAGES, ETC. THE RECREATION BOARD REQUESTS THE
USE OF $3,500.00 OF THE RECREATION IMPROVEMENTS FUND.
COUNCILMAN OVERSTREET MOVED TO APPROVE THE REQUEST.
SECONDED BY COUNCILMAN DUCK, MOTION PASSED UNANIMOUSLY.

COUNCILMAN BISHOP MOVED TO AUTHORIZE NEWSPAPER ADS
INVITING INTERESTED PERSONS TO OFFER PROPOSALS FOR LEASING THE
FOOD AND BEVERAGE CONCESSION AT QUAIL CREEK GOLF COURSE.
SECONDED BY COUNCILMAN DUCK, MOTION PASSED UNANIMOUSLY.
MAYOR NIX APPOINTED THE FOLLOWING COMMITTEE TO MEET
WITH COUNTY COMMISSIONER WENDY ALLEN TO DISCUSS THE
COMMISSIONS PROPOSAL TO SHARE THE COST OF WIDENING AND
RESURFACING COUNTY ROAD 48 (FAIRHOPE AVENUE EXTENSION) FOR
ABOUT TWO MILES FROM US 98 (GREENO ROAD) EAST TO COUNTY ROAD
27: OVERSTREET (CHAIR), FORD, BISHOP, Tim KANT, AND PHIL
RUTHERFORD. THE COMMITTEE WILL REPORT THEIR RECOMMENDATIONS
TO THE COUNCIL AS SOON AS POSSIBLE.
