PRESENT WERE MAYOR JAMES P. Nix; COUNCILMEMBERS MICHAEL A. FORD, DAVID E. BISHOP, JEANETTE PUCKETT, AND LAYTON OVERSTREET; AND CITY CLERK EVELYN P. PHILLIPS. CITY ATTORNEY MARION E. WYNNE AND COUNCILMAN JOHN V. DUCK WERE ABSENT. THERE BEING A QUORUM PRESENT, MAYOR NIX CALLED THE MEETING TO ORDER. MINUTES OF THE 26 DECEMBER 1995 REGULAR SESSION WERE DULY APPROVED. COUNCILWOMAN PUCKETT INTRODUCED ORDINANCE No. 989, IN WRITING AND AS ADVERTISED, AN ORDINANCE TO REZONE BESTOR WARD PROPERTY, LOCATED BETWEEN SPRING RUN DRIVE AND NICHOLS STREET OFF GREENo ROAD, FROM B2 GENERAL BUSINESS TO R3PGH HIGH DENSITY PATIO/GARDEN HOMES. NO ONE PRESENT OPPOSED THE REZONING, THERE WAS PLANNING & ZONING APPROVAL. IN ORDER TO TAKE IMMEDIATE ACTION, COUNCILMAN OVERSTREET MOVED TO SUSPEND THE RULES. SECONDED BY COUNCILWOMAN PUCKETT, MOTION TO SUSPEND PASSED UNANIMOUSLY BY THE FOLLOWING VOTE: AYE -FORD, BISHOP, NIX, PUCKETT, AND OVERSTREET. NAY -NONE. COUNCILMAN OVERSTREET THEN MOVED FOR FINAL ADOPTION OF ORDINANCE NO. 989. SECONDED BY COUNCILWOMAN PUCKETT, MOTION TO FINAL ADOPT PASSED UNANIMOUSLY BY THE FOLLOWING VOTE: AYE -FORD, BISHOP, NIX, PUCKETT, AND OVERSTREET. NAY -NONE. COUNCIL REVIEWED A BEER OFF -PREMISES LICENSE AND A WINE OFF -PREMISES LICENSE APPLICATION BY ED NELSON, DBA JUBILEE MART, 82 1 SO. MOBILE AVENUE, FORMERLY CALLED THE E-Z Pic. No ONE PRESENT WAS OPPOSED TO THE LICENSES. THERE WAS POLICE APPROVAL OF THE APPLICANT. COUNCILMAN FORD MOVED TO APPROVE THE ISSUANCE OF THE LICENSES. SECONDED BY COUNCILWOMAN PUCKETT, MOTION PASSED UNANIMOUSLY. COUNCILMAN FORD ADVISED COUNCIL THAT THE TRUCK BEING USED BY THE RECREATION DEPARTMENT HAD FINALLY QUIT AND HAD TO BE REPLACED. COUNCILMAN FORD MOVED TO APPROVE A TRANSFER OF 1731 08 January 1996 $3500.00 FROM THE RECREATION IMPROVEMENT FUND TO THE RECREATION OPERATING FUND TO PURCHASE A REPLACEMENT TRUCK. SECONDED BY COUNCILMAN OVERSTREET, MOTION PASSED UNANIMOUSLY. MAYOR NIX ANNOUNCED THAT THE NORTH TEAM FOR THIS YEAR'S SENIOR BOWL CLASSIC WILL BE PRACTICING AT THE FAIRHOPE FOOTBALL STADIUM ON JANUARY 1 5, 1 6, 1 7, AND 1 9. THE SOUTH TEAM WILL BE PRACTICING IN FAIRHOPE ON JANUARY 18. EVERYONE IS INVITED TO WATCH PRACTICE WITHOUT CHARGE. PUBLIC WORKS SUPERINTENDENT Tim KANT ANNOUNCED A POSSIBLE MAY COMPLETION DATE ON THE SANITATION TRANSFER STATION, AND A LANDSCAPE PLAN FOR THE NEW PART OF GREENO ROAD (US 98) SHOULD BE READY FOR APPROVAL BY THE END OF THE WEEK. COUNCILMAN OVERSTREET ASKED SUPT. KANT TO CHECK INTO THE POSSIBILITY OF HAVING A "DIP" IN THE NEW HIGHWAY, AT THE INTERSECTION OF GREENO ROAD AND FAIRHOPE AVENUE, CORRECTED BEFORE THE STATE DEPARTMENT OF TRANSPORTATION ACCEPTS THE HIGHWAY. COUNCILWOMAN PUCKETT MOVED TO PAY BILLS AS PRESENTED. SECONDED BY COUNCILMAN FORD, MOTION PASSED UNANIMOUSLY. THERE BEING NO FURTHER BUSINESS, MEETING WAS DULY ADJOURNED AT 6:00 PM. JA ES P.
