HomeMy WebLinkAbout01-10-1994 Regular Meeting1523 STATE OF ALABAMA 0 COUNTY OF BALDWIN 0 The City Council, City of Fairhope, met in regular session at 5:30 pm; Fairhope Municipal Complex Council Chamber; 161 North Section Street; Fairhope, Alabama 36532; on Monday, 10 January 1994. Present were Mayor James P. Nix; Councilmembers John V. Duck, Michael A. Ford, David E. Bishop, Jeanette Puckett, and Layton Overstreet; City Attorney Marion E. Wynne and City Clerk Evelyn Phillips. No one was absent. There being a quorum present, Mayor Nix called the meeting to order. Minutes of the 27 December 1993 regular session were duly approved. Ms. Peggy Vanover, Baldwin County Electric Membership Cor- portation Board of Directors, presented a check for $6,701.46 in payment of their 1994 business license. Council reviewed an application for a Restaurant Liquor License by Martha W. A1sup , dba RUPERT'S, at #9 Church Street. No one present was opposed to the license. There was police approval of the applicant. Councilman Overstreet moved torapprove the license. Seconded by Councilwoman Puckett, motion passed unanimously. Engineering consultant Ack Moore explained Change Order No. 4, Brunson -Nichols contract on Division "C", 193-'94 Public Improvements Assessments Project, for a net increase of $6,691.35. Councilman Bishop moved to approve the Change Order. Seconded by Councilman Ford, motion passed unanimously. Councilman Duck introduced in writing Ordinance No. 953, an ordinance to increase water & sewer tap fees, effective 17 January 1994, and water & sewer rates, effective in two phases (first February 1994 billing cycle and first November 1994 billing cycle). In order to take immediate action, Council- woman Puckett moved to suspend the rules. Seconded by Councilman Overstreet, motion to suspend the rules passed unanimously by the following vote: AYE -Duck, Bishop, Ford, Nix, Puckett, and Overstreet. NAY- none. Councilman Duck then moved for final adoption of Ordinance No. 953. Seconded by Councilwoman Puckett, motion to final adopt passed unanimously by the following vote: AYE -Duck, Ford, Bishop, Nix, Puckett, and Overstreet. NAY -none. Mayor Nix announced an opening on the Library Board for a 5-year term. Councilman Bishop moved to reappoint Mary Miley by acclamation. Seconded by Councilman Duck, motion passed unanimously. 10 January 1994 1524 The floor was opened for nominations for a 3-year term on the Board of Adjustments & Appeals. Former member Jim Merrihew is moving out of town and can no longer serve. Councilman Overstreet nominated Jim McClure. There being no other nominations, Councilman Duck moved to close the nominations and appoint Mr. McClure by acclamation. Seconded by Councilman Overstreet, motion passed unanimously. Councilwoman Puckett moved to pay bills as presented. Seconded by Councilman Overstreet, motion passed unanimously.
