HomeMy WebLinkAbout04-12-1993 Regular Meeting1425 STATE OF ALABAMA X COUNTY OF BALDWIN X The City Council, City of Fairhope, met in regular session at 5:30 pm; Fairhope Municipal Complex Council Chamber; 161 North Section Street; Fairhope, Alabama 36532, on Mondav, 12 April 1993. Present were Mayor James P. Nix; Councilmembers John V. Duck, Michael A. Ford, David E. Bishop, Jeanette Puckett, and Layton Overstreet; and City Clerk Evelyn Phillips. City Attorney Marion E. Wynne was absent. There being a quorum present, Mayor Nix called the meeting to order. Minutes of the 22 March 1993 regular session and the 29 March 1993 special session were duly approved. Mrs. Rae Jackson, representing the Recreation Board, addressed the Council, requesting permission to again hold their "May Day" festival on Saturday, 1 May 1993, on the northernmost section of the Municipal Beach. After discussion, Councilman Ford moved to approve the request. Seconded by Councilman Duck, motion passed unanimously. A public hearing was held as advertised on an ordinance amending the Zoning Ordinance by establishing Arbor Gables as a Planned Unit Development. No one present was opposed. The Planning & Zoning Board recommends approval. Councilman Duck introduced Ordinance No. 931, in writing, establishing this development as a PUD. In order to take immediate action, Councilman Duck moved to suspend the rules. Seconded by Councilman Overstreet, motion to suspend passed unanimously by the following vote: AYE -Duck, Ford, Bishop, Nix, Puckett, and Overstreet. NAY -none. Councilman Duck then moved for final adoption of Ordinance No. 931. Seconded by Councilman Overstreet, motion to final adopt passed unanimously by the following vote: AYE -Duck, Ford, Bishop, Nix, Puckett, and Overstreet. NAY -none. The Planning & Zoning Board recommends approval. Councilman Bishop introduced Ordinance No. 932, in writing, establishing this development as a PUD. Councilwoman Puckett then moved for final adoption of Ordinance No. 932. Seconded by Councilman Overstreet, motion to final adopt passed unanimously by the following vote: AYE -Duck, Ford, Bishop, Nix, Puckett, and Overstreet. NAY -none. 12 April 1993 1426 2 Councilman Ford introduced in writing, and moved for the adoption of (provided required As -Built Plans are presented immediately and are in order), the following resolution. Seconded by Councilwoman Puckett, motion passed unanimously: RESOLUTION NO, O.S- 93 WHEREAS, the Owners of Hawthorne Glen S/D Unit One are desirous of having streets and utilities therein accepted for maintenance by the City Council in order that building permits may lawfully issue, and; WHEREAS, the General Superintendent of the City represents that the physical improvements in the nature of streets, drainage and utilities have been installed in substantial conformity with City requirements, and; WHEREAS, the Building/Zoning Officer of the City represents that he has received Engineer's Certified As - built Plans, test reports and lateral locations substantially as required by Chapter 19 of the Code of Ordinances, and; WHEREAS, the owners have provided to the City Clerk a bond for maintenance of the streets within Hawthorne Glen as required by the City's codes and regulations, and; WHEREAS, the Plat of Hawthorne Glen S/D Unit One having been recorded in the Probate Records of Baldwin County, Alabama at Slide No. 3 /- , delineates thereon the streets therein as public ways; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA that the streets and utilizes within said Hawthorne Glen be and the same hereby are accepted for public maintenance subject to the bond posted. th ADOPTED this the �.2 day of 1993. Seconded by Council- man Ford, motion passed unanimously: RESOLUTION Z/_j 7- 93 WHEREAS, FAIRHOPE SINGLE TAX CORPORATION, granted to WEST BALDWIN WATER AND FIRE PROTECTION AUTHORITY, an easement across certain lands owned by Fairhope Single Tax Corporation in accordance with the minutes of a regular meeting of Fairhope Single Tax Corporation on May 5, 1966; and WHEREAS, the City of Fairhope assumed the easement granted West Baldwin Water and Fire Protection Authority; and WHEREAS, the said easement is no longer needed by the City of Fairhope and the City no longer maintains or uses said easement; NOW, THEREFORE, BE IT RESOLVED, that the City of Fairhope does herby release, relinquish and abandon any and all rights it has on an easement to place a water line over and across properties owned by the Fairhope Single Tax Corporation described as follows: Begin 1337.5 feet South 89 degrees East of Southwest Section Corner, then North 1 degrees West 1314.1 feet, South 89 degrees East 15 feet, South 1 degrees West 1314.1 feet and North 89 degrees West 15 feet to beginning, of Southeast Quarter of Southwest Quarter, Section 16, Township 6, Range 2. BE IT RESOLVED, that the Fairhope Single Tax Corporation, its lessees, tenants and assigns, may remove any pipe that may be located on said easement and shall not be liable to the City of Fairhope for damages done to the pipe or for the disposition of the pipe. Seconded by Council- woman Puckett, motion passed unanimously: RESOLUTION NO. 408-93 TEMPORARY EASEMENT AGREEMENT Whereas, Fairhope Single Tax Corporation and Morphy Group Limited, an Alabama limited Partnership, are desirous of granting unto the City of Fairhope a temporary right-of-way over and across leasehold property owned by Morphy Group Limited under certain terms and conditions; and Whereas, the City of Fairhope is desirous of seeing to the orderly use of and development of Hawthorne Glen SubDivision; Now, Therefore, the parties hereto do agree as follows: 1. That the City of Fairhope shall have a temporary right-of-way over and across Lot 1, Phase One, Hawthorne Glen SubDivision for the purpose of maintaining a paved street entrance from Morphy Avenue into Phase One, Hawthorne Glen SubDivision. 2. This right-of-way is for the sole purpose of entering onto the property of Phase One, Hawthorne Glen, until such time as Phase Two has been completed. 3. That said right-of-way granted herein is for the sole purpose of a road and does not include the placement or maintenance of utilities. 4. It is understood that Morphy Group Limited may maintain and decorate the remainder of Lot 1, Phase One, up to the curb of the paved right- of-way. 5. That the City of Fairhope agrees to release, relinquish and turn over to Morphy Group Limited the right-of-way granted herein at such time Morphy Group Limited completes Phase Two of the proposed Hawthorne Glen SubDivision. Seconded by Councilman Ford, motion passed unanimously: RESOLUTION NO. 409-93 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, that Mayor James P. Nix is hereby authorized to execute Contract No. 40300, between the City and UNITED GAS PIPE LINE COMPANY, for the pur- chasing of Natural Gas for distribution and resale through the City's Gas System serving the community of Fairhope, Baldwin County, Alabama, and its adjoining environs. Nix, Mayor 12 April 1993 1430 Council reviewed a request from Sunset Cruises, Inc.'s President, Robert Van Iderstine, for a letter of approval for the State ABC Board to issue a Common Carrier Liquor License to their 45-ft mini -cruise ship, the FISHBUSTERS. The ship will operate from the docks at Fly Creek into Mobile Bay. All food and beverages will be purchased at retail. Councilman Duck moved for approval of issuing such a letter to the ABC Board, provided Mr. Van Iderstine has operating approval from the Fairhope Harbor Board. Seconded by Council- man Ford, motion passed unanimously. (Harbor Board approved.) Councilman Overstreet moved to approve expenses to send five firemen to Fire College. Seconded by Councilman Bishop, motion passed unanimously. In order to take immediate action, Councilman Ford moved to suspend the rules. Seconded by Councilman Overstreet, motion to suspend passed unanimously by the following vote: AYE - Duck, Ford, Bishop, Nix, Puckett, and Overstreet. NAY -none. Councilman Ford then moved for final adoption of Ordinance No. 933. Seconded by Councilman Duck, motion passed unanimously by the following vote: AYE -Duck, Ford, Bishop, Nix, Puckett, and Overstreet. NAY -none. Councilman Ford then asked Council to consider approving the use of the Recreation Improvement Fund monies to repair the swimming pool. He explained the Recreation Board had taken bids on the job and had accepted a bid of approximately $9,000.00; however, the Board's operating fund is a little low due to decreased cigarette and beer sales (the tax on same is used to fund recreation activities) and increased demand for services. After some discussion, Councilman Overstreet moved to table the request. Seconded by Councilman Bishop, motion carried by the following vote: AYE -Duck, Bishop, Puckett, and Overstreet. NAY -Ford. Councilwoman Puckett moved to pay bills as presented. Seconded by Councilman Overstreet, motion passed unanimously. Mayor Nix announced he had received a request from the Downtown Merchants Association that a "No Left Turn" sign be established for east -bound traffic on Fairhope Avenue at the intersection with Section Street. He asked that the Council be ready to discuss this request at the next regular session. Meeting was duly adjourned at 6:10 pm. mes Nix, Mayor
