The City Council, City of Fairhope, met in regular session
at 5:30 pm; Fairhope Municipal Complex Council Chamber;
161 North Section Street; Fairhope, Alabama 36532; on
Monday, 25 January 1993.
Present were Mayor James P. Nix; Councilmembers John V. Duck,
Michael A. Ford, David E. Bishop, Jeanette Puckett, and Layton
Overstreet; City Clerk Evelyn P. Phillips. City Attorney
Marion E. Wynne was absent.
There being a quorum present, Mayor Nix called the meeting
to order. Minutes of the 11 January 1993 regular session,
including the recessed portions on 13 January, 18 January,
and 20 January, were duly approved.
The floor was opened to discuss the response received
by the City Clerk to the authorized 30-day advertisement
for city property owners to notify her as to whether they
were interested in having their property improved by way
of an Assessments Project. Mrs. Phillips reported that
letters had come in requesting some or all utilities (gas,
water, sewer, electricity) and paving of streets from the
following areas: Richmond Square, Edwards Avenue, the
proposed Rock Creek, Angelo A. Corte, Greenbrier, Cambridge
Court, and Glen Hardy Farms developments, and Colonial Acres
sub -division. This information will be turned over to a
consulting engineer who will put the project together as
more than sufficient interest exists to justify an assess-
ment project. The engineer will advise when he has the
project mapped out and cost estimates ready. A public hearing
will then be held to discuss these estimates with all affected
property owners and the project will then be launched.
Councilman Overstreet moved for final adoption of
Ordinance No. 915, an ordinance to rezone the Pierce Frederick
property on Foster Avenue from R2 Medium Density Single
Family Residential to RSTH High Density Multi -Family Residential,
introduced at the last regular session. Seconded by Councilman
Duck, motion to final adopt carried by the following vote:
AYE -Duck, Ford, Nix, Puckett, and Overstreet. NAY -Bishop.

Councilman Duck then moved for final adoption of Ordinance
No. 916. Seconded by Councilman Bishop, motion to final
adopt passed unanimously by the following vote: AYE -Duck,
Ford, Bishop, Nix, Puckett, and Overstreet. NAY -none.
A petition for annexation by Charles D. Carter on his
property located west of Greeno Road across from the Eastern
Shore Mobile Home Park was reviewed. After discussion, Council-
man Bishop introduced Ordinance No. 917,/lgnwrRiffinance annexing
Mr. Carter's property. In order to take immediate action,
Councilman Overstreet moved to suspend the rules. Seconded
by Councilwoman Puckett, motion to suspend passed unanimously
by the following vote: AYE -Duck, Ford, Bishop, Nix, Puckett,
and Overstreet. NAY -none. Councilwoman Puckett then moved
for final adoption of Ordinance No. 917. Seconded by Councilman
Duck, motion to final adopt passed unanimously by the following
vote: AYE -Duck, Ford, Bishop, Nix, Puckett, and Overstreet.
NAY -none.
A petition for annexation by Annie B. Hall on her property
located west of Greeno Road across from the Eastern Shore
Mobile Home Park was reviewed. After discussion, Councilman
Duck introduced Ordinance No. 918, in writing, an ordinance
annexing Ms. Hall's property. In order to take immediate
action, Councilwoman Puckett moved to suspend the rules.
Seconded by Councilman Overstreet, motion to suspend passed
unanimously by the following vote: AYE -Duck, Ford, Bishop,
Nix, Puckett, and Overstreet. NAY -none. Councilman Duck
then moved for final adoption of Ordinance No. 918. Seconded
by Councilman Bishop, motion to final adopt passed unanimously
by the following vote: AYE -Duck, Ford, Bishop, Nix, Puckett,
and Overstreet. NAY -none.

Councilman Duck introduced an ordinance/to amend Chapter 5
(Animal Control) of the Fairhope Code of Ordinances. The
ordinance will establish first, second, and third offense
fees instead of'one flat rate to redeem impounded animals.
This ordinance will receive final consideration at the next
regular session.

Councilwoman Puckett introduced an ordinance/to add two
members to the Harbor Board, to the Library Board, to the
Recreation Board, and to the Airport Board. This ordinance
will receive final consideration at the next regular session.

by Councilman Ford, motion passed unanimously.

Councilman Ford moved to authorize the Police Depart-
ment to offer for sale by sealed bids the 1986 Nissan Pick
Up truck the Department obtained over two years ago as part
of a drug raid. Seconded by Councilman Bishop, motion
passed unanimously.
Council discussed a letter from Scott E. Carrier,
106 Pecan Avenue, requesting a four-way stop sign at the
intersection of Pecan Street and Satsuma Avenue. Mayor
Nix reported that Building Official Bob Lunsford said this
intersection does not meet the established criteria for
a four-way stop. After some discussion, Mayor Nix appointed
a committee to research the matter, (Overstreet, Chair,
with Ford & Lunsford) and make a recommendation to the Council
at the next regular session.
Under Old Business, Electric Department Superintendent
Aaron Norris reported he had investigated the request from
Theatre 98 to hang banners from the Christmas Decoration
utility pole hangers whenever they are having a production
and the hangers are not being used. Norris recommended
approval of the request. So moved by Councilman Overstreet.
Seconded by Councilwoman Puckett, motion passed unanimously.
Supt. Norris also suggested that all over -the -street
banners be phased out in favor of using the vertical -banner
method as soon as a policy could be written up and phased
into operation.
There being no further business, meeting was duly
adjourned at 6:02 p.m.
