The City Council, City of Fairhope, met in regular session
at 5:30 pm; Fairhope Municipal Complex Council Chamber;
161 North Section Street; Fairhope, Alabama 36532; on
Monday. 23 July 1990.
Present were Councilmembers Roy C. White, Jeanette Puckett,
David E. Bishop, and Michael A. Ford; City Attorney Marion E.
Wynne and City Clerk Evelyn Phillips. Mayor James P. Nix was absent.
*Councilman John V. Duck was also present.
Mayor Pro Temp Michael A. Ford presided in the absence of
Mayor Nix.
There being a quorum present, Mayor Pro Temp Ford called
the meeting to order. Minutes of the 9 July 1990 regular session
were approved on motion of Councilman Duck, seconded by Council-
man Bishop, with a unanimous vote.
Council decided to delay an appointment to the Recreation
Board to fill Mr. Barney Shull's unexpired term to March, 1992,
until the next regular session.
Councilman Duck introduced, and moved for the adoption of,
the following resolution. Seconded by Councilman Bishop,
motion passed unanimously:
RESOLUTION NO. 314-90
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE,
ALABAMA, That the City of Fairhope elects to come under the
provisions of ACT NO. 90-522 of the Regular Session of the
State of Alabama 1990 Legislature;
BE IT FURTHER RESOLVED That the City of Fairhope agrees to
provide all funds necessary to the Employees' Retirement
System to cover the cost of the increase as provided by said
ACT for those employees retired from the City of Fairhope
with the aforementioned increase to be effective with the
OCTOBER 1990 benefit payments.

RESOLUTION NO. 315 - 90
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE
THAT the Mayor is hereby authorized to purchase approximately
One acre of land from Mason McGowin for use as a well site
on County Road 32, subject to Engineer's certification that
site is acceptable for well water.
ADOPTED THIS 23RD DAY OF JULY, 1990.

Councilman Bishop introduced, and moved for the adoption of,
the above resolution (#315-90). Seconded by Councilwoman Puckett,
motion passed unanimously.
Mr. Ack Moore and Mr. Thad Ingram of Harmon, Moore Engineering
Associates, gave reports on the following projects:
SEWER SMOKE TESTS: Mr. Moore reported that 165,000 lineal feet
of sewer lines had been tested and 167 leaks had been dis-
covered. The majority of the leaks, 121, are on service lines.
These leaks have to be repaired by property owners and a notice
to that affect is being prepared for them. The leaks on the
collector lines and around manholes are estimated repairable
at $17,500. These repairs should effectively stop the water
infiltration problems.
WATER TANK AND WATER WELL CONSTRUCTION: Mr. Ingram reported
that both projects are well ahead of schedule and should be com-
plete before Thanksgiving, provided no problem arises when well
water tests are complete.
Councilwoman Puckett moved to approve payment of all June
Bills. Seconded by Councilman White, motion passed unanimously.
Meeting was duly adjourned at 5:43 pm.
