The City Council, City of Fairhope, met in regular session
at 5:30 pm; Fairhope Municipal Complex Council Chamber;
161 North Section Street; Fairhope, Alabama 36532; on
Monday, 23 October 1989.
Present were Mayor James P. Nix; Councilmembers Roy C.
White, Jeanette Puckett, David E. Bishop, Michael A. Ford,
and Barney L. Shull; City Attorney Marion Wynne and Acting
City Clerk Betty Rivenbark(Mrs. Phillips was on vacation)
There being a quorum present, Mayor Nix called the meeting
to order. Minutes of the 9 October 1989 regular session were
duly approved.
Mayor Nix asked for authorization to go out on bids for
a 2,000,000 gallon water tank and a 750gpm water well. The
tank to be located out by the Middle School and the well to be
located on the NE corner of the airport property. The tank
location would have to be approved by the airport board and
FAA, but we don't see it as a problem. Councilman Shull moved
that the Mayor be authorized to solicit bids according to plans
and specifications and subject to approval necessary. -
Councilman Bishop seconded motion and it passed unanimously.
At this time Thad Ingram reported that he had talked with
ADEM and that they said they could not review plans until
the 24th of November, but he had also talked with Elton Jay
of the FAA, and that he said he did not see any problems but
until he got into it deeper he could not say anything definite.
Two terms had run out on the Board of Adjustments & Appeals
and Councilman Bishop moved to re -appoint Claude Puckett and
Cliff Goodletson to a three year term on this Board. Council-
man Ford seconded the motion. Councilman Shull moved that
nominations be closed and that Mr. Puckett and Mr. Goodletson
be appointed by acclamation. Councilman White seconded the
motion and it carried unanimously.
Mayor Nix reported that he had been asked September 18
to send a letter to the Corps of Engineers regarding proposed
extension of jetties at -the entrance of Fly Creek. He had
done so and has received a letter back basically saying that
they do not recommend doing what is proposed. Further discussion
led to Councilman Shull authorizing the Mayor to obtain prices
to fix the existing bulkhead with rip -rap where needed. Council-
woman Puckett seconded the motion and it carried unanimously.
At this time Tom Hutchings spoke to the Council saying he had
talked to ADEM and that their two major concerns in this project
were 1) the "litoral drift" and 2)the water quality in the creek.
That historically the South side of the creek has always stayed
open and that he disagrees with the information set out in
the letter from the Corps. Gary Moore asked if what the Council
is proposing is a somewhat different design or take care of

what already exists. Councilman Shull said motion was to
take care immediate need now. Councilman White asked
about the White Avenue problem, are we prepared to get profess-
ional advice on that also. Mayor Nix reported that we had
already gotten a letter from the Corps on that, and that we
are re -working where the water goes to the bay now. Council-
man Bishop asked if we could get a price on bulkheads for
that area. Further discussion led to Council directing
Supt. Rutherford to get prices on bulkheads for proper
intervals in White Avenue area.
Mayor Nix reported that he signed a proclamation
proclaiming October 22-29th as National Drug Free America
week in Fairhope and wished the Council to go on record
supporting this important issue and proclamation. Council-
woman Puckett moved to give Council support, Councilman
White seconded and motion carried unanimously.
Councilman Bishop moved to hear the following business not
on the Agenda. Seconded by Councilman Shull, motion passed
unanimously:
Mayor Nix reported that we needed to replace Truck #6
in the Gas Department and we had sought bids on a 11 ton
truck/chassis and the bids were:

Councilman Shull moved to accept the recommendation
of the purchasing agent, to accept low bid meeting specifica-
tions. Councilman White seconded and motion carried
unanimously.
At this time a lady, Tina Echler, with Loma Alta Towers
spoke to the Council reporting new ownership and that she
is seeking help in trying to sell the units that they are
not going to be listed with realtors but they are going
to try and sell them themselves, and they have a year to do
it in; which will put a burden on them. She thanked the
Council for the opportunity to speak. Mayor Nix remarked
he knew they were nice, but he couldn't recommend Fairhope
citizens moving there.

A Mr. Seckinger spoke on behalf of a letter that was
sent to the Mayor and Council requesting that the Daphne
Middle School Band be allowed to use the auditorium in
December for the in -town rate of $125 rather than the $350
out-of-town rate they would be required to pay. Councilman
White said he had been approached about this and that he
had researched it but he did not feel that we could allow
them to have it at the $125 charge. Mayor Nix remarked that
he knew it was for a good cause, but we are besieged with
requests all the time, all good causes, and we have to draw
the line somewhere on the charges, that everybody has a
good valid reason, but since there was no motion forthcoming
to allow the reduced rate, the request is denied.
