HomeMy WebLinkAbout10-24-1988 Regular Meeting973 STATE OF ALABAMA X COUNTY OF BALDWIN The City Council, City of Fairhope, met in regular session at 5:30 pm; Fairhope Municipal Complex Council Chamber; 161 North Section Street; Fairhope, Alabama 36532; on Monday. 24 October 1988. Present were Mayor James P. Nix; Councilmembers Roy C. White, David E. Bishop, Michael A. Ford, and Barney L. Shull; City Attorney James H. Reid and City Clerk Evelyn Phillips. Councilwoman Jeanette Puckett was absent. There being a quorum present, Mayor Nix called the meeting to order. Minutes of the 3 October 1988 regular session were duly approved. City Attorney, and Notary Public, James Reid administered the Oath of Office to Councilman David E. Bishop who was not present at the October 3rd session. A Certificate of Appreciation was presented to Joseph Smazik who is retiring from the Police Department and the Volunteer Fire Department. Councilman Shull moved for final adoption of Ordinance No. 813, an ordinance establishing the time, place, and rules of pro- cedure for Council Meetings, which had been introduced at the last regular session. Seconded by Councilman Ford, motion passed unanimously. Council reviewed a petition for the vacation of a unnamed public right-of-way located between Fairhope Avenue and Edwards Avenue east of Greeno Road by Julio Corte, Jr., and Atilio Corte, Jr. A public hearing on this request was duly advertised in the EASTERN SHORE COURIER on October Sth, 12th, and 19th. No one present was opposed to the vacation. Councilman White introduced an ordinance assenting to the vacation. In order to take immediate action on this ordinance, Councilman Shull moved to suspend the rules. Seconded by Councilman White, motion to suspend was unanimously passed by the following vote: AYE -Nix, White, Ford, Bishop, and Shull. NAY -none. Councilman White then moved for final adoption of the ordinance, No. 814. Seconded by Councilman Ford, motion to final adopt passed unanimously by the following vote: AYE -Nix, White, Ford, Bishop, and Shull. NAY -none. A public hearing was held as advertised on public interest in a public improvements assessments program. Responses received were: paving & sewer requested by Quail Creek Joint Venture in a new subdivision by the Golf Course; paving the eastern portion of Nichols Avenue by the VFW Post; paving the 400 block of North Mobile Street by William Troup and Jesse Davis; and paving Weston Lane east of Paddock Estates by Robert King. Weston Lane 24 October 1988 974 is not located in the corporate limits and is only 30-feet wide and therefore cannot be included in the project. There is some question about the width of North Mobile Street. Councilman Ford moved to turn the Quail Creek Joint Venture* request, the VFW request, and the North Mobile Street request over to the engineers for consideration as a possible project. Upon the engineers report as to what improvements can be made, and where, a public hearing will be held --after newspaper publications and notices by mail have been sent to all affected property owners --to finally determine the scope of the project. Councilman Shull seconded Ford's motion which passed unanimously. *subject to their being annexed into the city; annexation procedure now in progress. Mayor Nix announced that he would like to fill the council position on the Planning $ Zoning Commission by appointing each Councilmember to a term concurrent with their Mayor Pro Tempore term: 10/1/88 - 7/31/89 Bishop 8/l/89 - 5/31/90 White 6/l/90 - 3/31/91 Ford 4/1/91 - 12/31/91 Shull 1/1/92 - 9/30/92 Puckett Councilman Bishop moved to approve the appointments. Seconded by Councilman Shull, motion passed unanimously. Councilman Bishop moved to approve the Mayor's appointment of Councilman Roy White to the Architectural Review Committee for the Fairhope Industrial Park. Seconded by Councilman Ford, motion passed unanimously. Councilman Shull moved to approve the designation of the week of October 23rd to 30th as.Red Ribbon Week in the City of Fairhope. This week is to focus on a drug -free America. Seconded by Councilman Ford, motion passed unanimously. Councilman White moved to hear the following business not on the Agenda. Seconded by Councilman Shull, motion passed unanimously: Bids were opened on twelve 25KVA Electric Transformers: Hatfield & Co Mobile it alt Stuart Irby Co P'cola, F1 Brassfield Sales Birmingham TOTAL'COST EVALUATED COST DELIVERY $5,280.00 $20,356.80 2 weeks 519520.00 18,566.40 2 weeks $7,380.00 $14,983.20 14 weeks $7.9380.00 $19,672.87 12-14 weeks Councilman Bishop moved to accept lowest evaluated bid by Stuart Irby Company provided all specifications are met. Seconded by Councilman Shull, motion passed unanimously. 24 October 1988 975 Mayor Nix appointed Councilmembers White, Shull, and Ford to work with Street Supt. Tim Kant on the formulation of a "trash policy" for the city. They will bring recommendations for a new ordinance back for council consideration as soon as possible.
