NOTICE AND CALL OF SPECIAL MEETING
Notice is hereby given of a special meeting of the
City Council of the City of Fairhope, Alabama, to
be held at the Fairhope Municipal Complex Council
Chamber, on Tuesday, November 18, 1986, at 5:00,pm,
for the purpose of adoption of two ordinances, two
resolutions, and the acceptance of bids on Golf
Course project and to use Recreation Improvement Funds
on Golf Course.
CONSENT TO HOLDING OF MEETING
The undersigned members of the City Council of the
City of Fairhope, Alabama, do hereby acknowledge
service of the Notice and Call of Special Meeting
hereinabove set forth and do hereby consent to the
holding of such meeting at such time and in such
place and for the purposes set forth therein.

The City Council, City of Fairhope, met in special
session at 5:00, p.m.; Fairhope Municipal Complex Council
Chamber, 161 North Section Street, Fairhope, Alabama 36532,
on Tuesday, 18 Noyombor'1986.
Present were Mayor James P. Nix; Councilmembers Roy C.
White, Jeanette Puckett, David E. Bishop, Michael A. Ford,
and Barney L. Shull; City Attorney James Reid and City
Clerk Evelyn Phillips. No one was absent.
The purpose of this meeting was to review and adopt two
ordinances, two resolutions, accept bids on work on the
Golf Course project, and to authorize the use.of the Recrea-
tion Improvement Fund on the Golf Course project.
There being a quorum present, Mayor Nix opened the
meeting.
Councilman White introduced Ordinance No. 779, an
ordinance designating the Intoxilyzer 5000 as the test to
be administered by the police to determine alcoholic blood
content. It was moved by Councilman Shull that all rules
and regulations which, unless suspended, would prevent the
immediate consideration and adoption of said ordinance be
suspended, and that unanimous consent to the immediate
consideration of said ordinance be given. Motion was
seconded by Councilman White and passed unanimously by the
following vote: AYE - White, Puckett, Nix, Bishop, Ford,
and Shull. NAY - none. The Mayor declared the motion
carried. After said ordinance had been discussed and con-
sidered in full by the Council, it was moved by Councilman
Bishop that said ordinance be now placed upon its final
passage and adopted. The motion was seconded by Councilman
Ford and passed unanimously by the following vote: AYE -
White, Puckett, Nix, Bishop, Ford, and Shull. NAY - none.
The Mayor thereupon declared said motion carried and
Ordinance No. 779 passed and adopted as introduced.
Councilman Bishop introduced Ordinance No. 780, an
ordinance declaring certain leasehold interest and improve-
ments (purchased from Organic School, Inc.) available for
lease by the City to the State of Alabama Board of Education.
It was moved by Councilman White that all rules and regu-
lations which, unless suspended, would prevent the immediate
consideration and adoption of said ordinance be suspended,
and that unanimous consent to the immediate consideration
of said ordinance be given. Motion was seconded by Council-
man Ford and passed unanimously by the following vote: AYE -
White, Puckette, Nix, Bishop, Ford, and Shull. NAY - none.

The Mayor declared the motion carried. After said ordinance
had been discussed and considered.in full by the Council,
it was moved by Councilman Bishop that said ordinance be
now placed upon its final passage and adopted. The motion
was seconded by Councilwoman Puckett and passed unanimously
by the following vote: AYE - White, Puckett, Nix, Bishop,
Ford, and Shull. NAY - none. The Mayor declared said
motion carried and Ordinance No. 780 passed and adopted as
introduced.
Councilman Bishop introduced, and moved for the adoption
of, the following Resolution. Seconded by Councilman Shull,
motion passed unanimously:
RESOLUTION NO. 205-86
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF
FAIRHOPE, ALABAMA, That Resolution No. 200-86, autho-
rizing a loan of $334,000 Dollars from CENTRAL BANK
OF THE SOUTH to the City of Fairhope, duly adopted
by this Body in regular session on 10 November 1986,
is hereby rescinded in its entirety.
ADOPTED THIS 18th DAY OF NOVEMBER, 1986.
Councilman White introduced, and moved for the adoption
of, the following Resolution. Seconded by Councilman Shull,
motion passed unanimously:

RESOLUTION NO. 206-86
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF
FAIRHOPE, ALABAMA, as follows:
1. That Mayor James P. Nix is hereby authorized to
finalize a loan agreement between the CITY OF FAIRHOPE
and AMSOUTH BANK, N.A.;
2. That the principal amount of said loan is THREE
HUNDRED, THIRTY-FOUR THOUSAND DOLLARS ($334,000.00);
3. That loan is payable in 120 monthly payments;
4. That interest rate will be AMSOUTH PRIME MINUS
THREE -EIGHTHS PERCENT (AmSouth Prime-3/8%), to float;
S. That loan will be a General Obligation against the
good faith and credit of the City of Fairhope;
6. And that the purpose of this loan is the acquisition
of leasehold interest and improvements on some Ten (10)
acres of land owned by the MARIETTA JOHNSON SCHOOL OF
ORGANIC EDUCATION, INC., situated on real property owned
by the Fairhope Single Tax Corporation and described as
follows, to -wit:
Blocks 9, 10, and 11, Division 4, of land of the
Fairhope Single Tax Corporation of Fairhope,
Baldwin County, Alabama, and located within the
corporate limits of the City of Fairhope, Baldwin
County, Alabama.; as per the FSTC plat thereof filed
for record September 13, 1911, in the Office of the
Probate Judge of Baldwin County, Alabama, located
in Section 17, T6S, R2E.
DULY PASSED AND ADOPTED THIS 18th DAY OF NOVEMBER, 1986.

Councilman Shull moved to accept the Dixie Dozer bid of
$8,250 per month as recommended by Gen. Supt. Rutherford.
Seconded by Councilwoman Puckett, motion passed unanimously.

Course project. Seconded by Councilman Ford, motion
passed unanimously.
Meeting was duly adjourned.
