STATE OF ALABAMA
COUNTY OF BALDWIN
The City Council, City of Fairhope, met in regular session
at 5:30 o'clock, PM, Fairhope Municipal Complex Council Chamber,
161 North Section Street, Fairhope, Alabama 36532, on
Monday, 13 May 1985.
Present were Mayor James P. Nix; Councilmembers Roy C.
White, David E. Bishop, Michael A. Ford, and Barney L. Shull;
City Attorney James Reid and City Clerk Evelyn Phillips.
Councilwoman Trisha Nelson was absent.
There being a quorum present, Mayor Nix called the meeting
to order. Minutes of the April 22nd regular session and the
April 29th special session were duly approved.
Mr. John Parker, representing Baldwin County United,
invited the Mayor and Council to a June 19th breakfast meeting
at the Gift Horse Restaurant in Foley at 7:00 o'clock, AM, at
which time the pros and cons of zoning outside municipal limits
will be discussed.
Mr. Bobby Green represented his mother, Mrs. Lillian Green,
Green's Nursery on Greeno Road, by requesting of the Council an
exemption from the monthly $6.00 garbage fee assessed against
all businesses located within the city. Mr. Green said they
hauled their own garbage to the city dump and would like to know
why they must be required to pay this fee. It was explained
that the garbage fee does not cover the pick-up of garbage only,
it also helpsdefray the costs of having a dump. It was also
pointed out that giving an option on garbage service would most
likely result in a very unclean city, and unsanitary dump.
Mr. Green agreed.
A public hearing was held on Mr. Matt Dial's request to
vacate some right of ways in the Commercial Park Drive area as
advertised. Mr. and Mrs. Dial, and their attorney, Mr. Ernest
Bailey,were present. No one present was opposed to the request;
however, City Attorney Reid felt the resolution of vacation
was not correct and would have to be reworked. The hearing was
