HomeMy WebLinkAbout02-25-1985 Regular Meeting641 STATE OF ALABAMA COUNTY OF BALDWIN The City Council, City of Fairhope, met in regular session at 5:30 o'clock, PM, Fairhope Municipal Complex Council Chamber, 161 North Section Street, Fairhope, Alabama 36532, on Monday, 25 February 1985. Present were Mayor James P. Nix; Councilmembers Roy C. White, Trisha Nelson, David E. Bishop, Michael A. Ford, and Barney L. Shull; City Attorney James Reid and City Clerk Evelyn Phillips. No one was absent. There being a quorum present, Mayor Nix called the meeting to order. Minutes of the 11 February 1985 regular session were duly approved. Councilman Bishop introduced, and moved for the adoption of, the following Resolution. Seconded by Councilman Shull, motion passed unanimously: RESOLUTION NO. 151-85 BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF FAIRHOPE, BALDWIN COUNTY, AIABAMA, in regular session this 25th day of February, 1985, having considered and found acceptable a contract designated as Contract No. 89-00-1501-738 with SOUTHEASTERN POWER ADMINISTRATION for the purchase of power, here- by authorizes and directs Mayor James P. Nix to ex- ecute said contract with the Southeastern Power Administration an behalf of the City of Fairhope. ADOPTED THIS 25th DAY OF FEBRUARY, 1985. s P. Nix, Mayor City er Council reviewed a Lounge Liquor License application by David C. Stapleton, dba E-Z PIC, INC., on Fairhope Avenue. Mr. Stapleton plans to open a Package Store, not a Lounge, however the City ABC ordinance does not provide for a Store. After some discussion, Councilman Shull moved to table the application until an amending ordinance can be passed to add a Package Store License. Seconded by Councilman Bishop, motion passed unanimously. 25 February 1985 642 Mrs. Joan Hoffman, representing the Baldwin County League of Women Voters, addressed the Council on the subject of the recent, and first, Mardi Gras Parade held in Fairhope on the 9th of February. Mrs. Hoffman said there was concern about why the parade was permitted, whether this was the beginning of a tradition, and if so, do we have to allow this. It was explained by Attorney Reid that people have a legal right to free assembly and a parade permit cannot be denied unless there is a real threat to public safety. Mrs. Hoffman asked if there was extra City expense because of the Parade. The answer was yes, for extra police and clean-up time; but no more than any other activity such as the Christmas Parade, the Fourth of July and Arts & Crafts festivities. Councilman Ford reported to Council on the subject of the YMCA organization trying to locate a site on which to construct a Family Recreation Facility here in Fairhope. The City Recrea- tion Board has a proposal which Mr. Ford offered in the form of the following motion: "The Recreation Board recommends that, if another parcel can't be located by the YMCA, the City lease a parcel of land containing approximately 40,000 square feet, or .92 acre, located on Greeno Road in the extreme south- east corner of our 60-acre Municipal Park to the YMCA for use as a family YMCA recreational building. This is between the tennis courts and the highway. The Lease would (a)*contain a reversion clause stating that if the site and any building were not used as a YMCA family recreational center, the property and building would revert to the City of Fairhope and lease be canceled." (Mr. Ford later corrected this point by saying...'not a reversion clause but a clause to say the YMCA could not sub -lease or the site�"used for some other purpose') "(b) the architectural design of any building, signs, etc., be approved by the Recreation Board to insure conformity to our existing facilities and future facil- ities of the City of Fairhope which are or may be planned at our park. (c)that a member of the Fairhope City Council be a member of the YMCA Board if we lease the property of the City. (d)that it be understood that all other land, parking facilities and recreation facilities are and will be kept under the ownership of the City of Fairhope and the control of the Recreation Board, and (e)that any legal papers and/or agreements be given to the Recreation Board, before agreed to or executed by the City, for their perusal, comments, and recommendations." *(alphbetical divisions added by Clerk for clarity ... ep) 25 February 1985 643 This motion seconded by Councilwoman Nelson, motion passed by unanimous vote. Mayor Nix announced that the City had been designated a TREE CITY, USA by the National Arbor Day Foundation and the Alabama Forestry Commission. Early today, during the ARBOR DAY program, a TREE CITY flag had been raised at the Complex and other commemorative material is being forwarded. During ARBOR DAY some 5,000 free tree seedlings were given out to citizens, and the Fairhope Garden Club donated two Bradford Pear trees which were planted at the Complex Fountain. Councilwoman Nelson moved to hear the following business not on the Agenda. Seconded by Councilman Shull, motion passed unanimously: Councilwoman Nelson moved to change the second meeting in March from Monday, March 25th, to Wednesday, March 27th, at the usual time and place. This change is due to the planned attendance by some of the Council to the National League of Cities conference in Washington, D.C., on March 23rd-26th. Seconded by Councilman Shull, motion passed unanimously. Meeting was duly adjourned.
