The City Council, City of Fairhope, met in regular session at
5:30 p.m. Fairhope, Municipal Complex, 161 North Section Street,
Fairhope, Alabama 36532 on Monday, 13 December 1982.
Present were Mayor James P. Nix; Councilmembers Sam E. Box,
David E. Bishop, Michael A. Ford, Trisha Nelson, and Roy C. White;
City Attorney James H. Reid and City Clerk Evelyn Phillips.
Mayor -Nix called the meeting to order and introduced the
Reverend Francis C. Wilson, of the Fairhope United Methodist
Church. Reverend Wilson gave the invocation.
Minutes of the 22 November 1982 regular session were duly
approved.
Councilman White moved for the final adoption of Ordinance
No. 708, an'.Ordinance which would allow the sale of fireworks
in the police jurisdiction. Seconded by Councilman Bishop, motion
carried by the following vote: AYE- White, Bishop, Ford, and Nix.
NAY - Nelson and Box.
Councilman Box moved for the final adoption of Ordinance No.
709, an Ordinance to establish new water rates for all City water
customers and adjust the Code of Ordinances. Seconded by Council-
man White, motion passed unanimously.
Councilwoman Nelson introduced, and moved for the adoption of
the following Resolution. Seconded by Councilman Ford, motion pass-
ed unanimously:
RESOLUTION NO. 65-82
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY.OF FAIRHOPE,
ALABAAMA, that the Mayor and City Clerk are hereby authorized
to contract with the Eastern Shore Chamber of Commerce for
the following services to be rendered by the said Chamber
in return for financial support in the amount of $100.00
per month, for the Fiscal Year 10/01/82 - 9/30/83.
1. Daily response to mail, personal and
telephone inquiries concerning the City
of Fairhope as a place to live.
2. Publication of Tourist Promotion Brochures
and Maps.
3. Sponsorship�of the Arts & Crafts Festival
4. Sponsorship of the Christmas Parade.
5. Encourage tourism and visitors.

Mayor Nix advised Council that, at the Organizational
Session of this Administration in October, 1980, the Mayor
Pro-Tempore duties had been assigned for the 4-year term on the
basis of 10 months each for Councilmembers Box, Bishop, and
McCawley, and 9 months each for Nelson and White. The death
of Councilman C.O. McCawley, early in November,of this year,
left this important duty unassigned until next April 1st.
After some discussion, Councilman Bishop moved to appoint Council-
woman Nelson as Mayor Pro Tempore for 11 months, 12/1/82 to
10/31/83, and Councilman White for 11 months, ll/l/83 to
9/30/84. Seconded by Councilman Box, motion passed unanimously.
A letter from the Fairhope Single Tax Corporation request-
ing the addition of another street in a new subdivision near
Fairland Avenue & Wisteria Street to the 1982 Public Improve-
ments Project was discussed. The Tax Colony is the only
property owner and they will pay the assessment in full,
not use the 10-year payment option. Councilman Bishop moved
to allow the addition to the Project and to authorize the
engineers to advertise for bids if City Attorney Reid can
not find a legal way to increase,.the-present project's con-
tract by the amount needed for this addition.. Seconded by
Councilman Box, motion passed unanimously.
Councilman Box moved to approve a one=time pay adjustment
of $50.00 each for all City employees in honor of the Season.
Seconded by Councilwoman Nelson, motion passed unanimously.
Under old business, Council'heard reports from the Bike
Trail Committee and the Auditorium Risers Committee:
Councilman White reported he, Supt. Rutherford, and
Building Official Lunsford had met with the Marriott Grand
Hotel representative Mr. Cunningham and Baldwin County Engineer
Mr. Nixon to discuss ways and means and costs to provide a
Bike Trail from the City south to the Grand Hotel. Councilman
White stated that the Committee had resolved (1) a route of
some 2583 if beginning 177 feet north of Pier Street -and running
along the west side of Mobile Avenue to the southern city limits,

(2) to use concrete 4 ft wide and average 6" thick, and
(3) that the materials costs would be approximately $8200
and the labor $16,000. Councilman White moved to go on record as
approving the bike trail with the City's participation to be
the labor on the trail as described from the north to the south
boundary, labor to be on a time -available basis, and provided
financing can be found for the necessary materials from a
source other than the City. Seconded by Councilman Box, motion
passed unanimously.
Councilwoman Nelson and Building Official Lunsford
reported that it would take some $77,000 to provide risers
for use in the Auditorium. Everyone seemed to agree this
was too expensive. Off -set rows of seating will be tried to
see if this will be of some help.
Mr. A.I. Bauman, Chairman of the Library Board, extended
an invitation to the Council and the public to come to the
new Library location at the west end of the Municipal Complex
next Saturday, December 18th and see the work they are doing
there.
Councilman Box moved to pay bills as presented. Seconded
by Councilman Bishop, motion passed unanimously.
