The City Council of the City of Fairhope met in regular session at
5:30 p.m., City Administration Building, 387 Fairhope Avenue, Fairhope,
Alabama 36532 on Monday, 9 November 1981
Present were Mayor James P. Nix; Councilmembers David Ed Bishop,
Roy C. White, Trisha Nelson, Sam E. Box, and C.O. McCawley; City
Attorney Jim Reid, and City Clerk Evelyn Phillips.
Minutes of 26 October regular session and 30 October special session
were duly approved.
Mike Arnold, President of the Jubilee Optimist Club, and several
Club members were present to hear what decision had been reached as to
whether or not they could again coordinate and direct the Fourth of
July festivities. After some discussion, Councilman Box moved to leave
Council's earlier decision.... to coordinate the Fourth by a Committee
to be chaired by Councilman McCawley with open participation by every
club interested.... as is. Seconded by Councilman White, motion carried
by the following vote: AYE - Box, White, and McCawley. NAY - Bishop
and Nelson.
Only one bid was received on the computer. IBM bid $39,041 and
offered to finance at 12% for 60 months. Councilman Bishop moved to
accept this bid. Seconded by Councilman McCawley, motion passed unanimously.
Councilman White withdrew the Zoning Ordinance discussion from the
Agenda at this time.
Mayor Nix advised Council of concern over safety of persons involved
in soliciting donations by staging road blocks on city streets. The
Mayor said this was a discussion item at a recent Alabama League seminar
and legal advice was that such solicitations required a police authorization
which would still leave liability for accidents on the City. Many cities
and towns had decided to pass an ordinance prohibiting road blocks.
Mayor Nix and the Council requested the news media to publicize their
need for citizen input on this question before taking action or not at
the next meeting.
Mayor Nix advised that the lease agreement on the vehicle gas
conversion equipment had been received and passed on to City Attorney
Reid for review. Attorney Reid stated the forms were in order except
for one stipulation stating the City would bear the cost of delivery.
The bid request asked for bids FOB Fairhope Councilman Box moved to
authorize the Mayor to sign the agreement after this cost -of -delivery
point was corrected to comply with the bid as requested and accepted.
Seconded by Councilman Bishop, motion passed unanimously.
Councilwoman Nelson moved to hear the following business not on
the Agenda.. Seconded by Councilman Box, motion passed unanimously:

Mayor Nix asked Council to declare an emergency on getting the City
Bulldozier repaired due to the County Health Department's warning that
the dump was below m;nin n standards and must be upgraded immediately.
Councilman Box moved to so declare an emergency and to authorize the Mayor
to purchase needed parts totaling some $6,245 from Industrial Tractor
Company. Seconded by Councilman McCawley, motion passed unanimously.
Councilwoman Nelson said she wished to bring up some old business.
Councilwoman Nelson said she had met with State Highway Department
Official Bobby Kemp while in Montgomery last week and he was willing
to attend a special meeting at night to discuss the Scenic 98 matter
with Council and other interested citizens.
Councilwoman Nelson moved to hear the following business not on
the Agenda. Seconded by Councilman White, motion passed unanimously:
Councilman Bishop reported a number of instances lately when burglar
alarms had gone off in residential areas and no one was at home to turn
them off. A general discussion ensued concerning this and other complaints
from citizens and from the police about burglar alarms. Mayor Nix asked
Councilmen Bishop and White to work with Attorney Reid on an ordinance
or some regulations to correct this potentially dangerous problem.
Councilman McCawley moved to pay bills as presented. Seconded by
Councilman Box, motion passed unanimously.
