The City Council, City of Fairhope, met in regular
session at 5:30 p.m. City Administration Building, 387
Fairhope Avenue, Fairhope, Alabama 36532 on Monday, 11 May 1981.
Present were Mayor James P. Nix; Councilmembers C.O. McCawley
Sam E. Box, Trisha Nelson, Roy C. White, and David Ed Bishop;
City Attorney John Duck and City Clerk -Treasurer Evelyn Phillips.
All members being present, with no members absent, Mayor
Nix called the meeting to order. Minutes of the 27 April 1981
regular session were duly approved.
Mayor Nix explained that several changes had to be made
in Ordinance No. 670 adopted at the April 27th meeting, re-
lating to the temporary financing for the new Waterline Ext-
ension(FmHA) Project. It is now necessary to rescind Ordin-
ance No. 670 and adopt a new Ordinance.
Councilman Box introduced Ordinance No. 671, an Ordinance
to rescind Ordinance No. 670. In order to give immediate
consideration of and take action on this Ordinance, Council-
man McCawley moved to suspend the rules. Seconded by Council-
man White, motion passed unanimously by the following vote:
AYE: -Nix, Box, White, McCawley, Nelson, and Bishop. NAY: -
none. Councilman Box then moved for final adoption of Ordin-
ance No. 671. Seconded by Councilman McCawley, motion passed
unanimously by the following vote: AYE -Nix, Box, White,
McCawley, Nelson, and Bishop. NAY -none.
Councilman Box introduced Ordinance No. 672, an Ordinance
to authorize a Water Revenue Bond Anticipation Note in the
principal amount of $2,192,000. In order to give immediate
consideration of and take action on this Ordinance, Council-
man White moved to suspend the rules. Seconded by Councilman
Bishop, motion passed unanimously by the following vote:
AYE -Nix, Box, White, McCawley, Nelson, and Bishop. NAY -none.
Councilman Box then moved for final adoption of Ordinance
No. 672. Seconded by Councilwoman Nelson, motion passed
unanimously by the following vote: AYE -Nix, Box, White,
McCawley, Nelson, and Bishop. NAY -none.
City Attorney John Duck requested a change be made in
his legal services contract on the Waterline Extension(FmHA)
Project. The following Resolution was introduced by Council-
man Box:
RESOLUTION NO. 8-81
BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF FAIR -
HOPE, ALABAMA, that

A. That certain Legal Service Contract between the
City of Fairhope, Owner, and John V. Duck, Attorney,
dated 10/1/79, relative to the Waterline Extension
(FmHA) Project be and the same hereby is amended as
follows:
"SECTION B-COMPENSATION
1. Owner will -pay to the Attorney for professional
services rendered in accordance herewith, -fees as
follows:
The sum of TWENTY-FIVE THOUSAND($25,000.00)
DOLLARS, which shall include all bond counsel
fees.
Said fees to be payable in the following manner
at the following times:
a. 70% or SEVENTEEN,THOUSAND, FIVE HUNDRED
($17,500.00) DOLLARS at closing of Temporary
Financing Arrangements.
b. 30% or SEVEN THOUSAND, FIVE HUNDRED($7,500.00)
DOLLARS when final financing shall be closed."

In order to give immediate consideration of and take action
on this Resolution, Councilman McCawley moved to suspend
the rules. Seconded by Councilwoman Nelson, motion passed
unanimously by the following vote: AYE -Nix, Box, White,
McCawley, Nelson, and Bishop. NAY -none. Councilman Box
then moved for final adoption of Resolution No. 8-81.
Seconded by Councilman Bishop, motion passed unanimously
by the following vote: AYE -Nix, Box, White, McCawley,
Nelson, and Bishop. NAY -none.
All ordinances and resolutions were introduced in writing.
Councilman Box moved to authorize bid requests on pipe
for the Gas. Dept. Seconded by Councilman McCawley, motion
passed unanimously.
Mrs. Mona Cain requested that No Parking Signs be placed
in front of her home at 252 Mershon Street. Councilman White
reported he had contacted Mrs. Cain, had inspected her area,
and would recommend the No Parking Signs be placed at least

one car -length on each side of her drive. Councilman White
so moved, seconded by Councilman Box. Motion passed unani-
mously.
Councilman Box moved to approve a request by the American
Red Cross for free access to the boat launch ramp for their
Regatta Day on May 23, 1981, only. Seconded by Councilman
Bishop, motion passed unanimously.
Mr. Don Dabney, Prindle Fleet #31 Sail Club from Mobile,
requested free access for the 20-30 member Club for the
summer. Consensus was that congestion is already a problem and
if one Sail Club is allowed free, others will also request the
same privilege. Councilwoman Nelson moved to deny the request.
Seconded by Councilman White, motion passed unanimously.
Mayor Nix appointed a committee of Councilmembers Box,
White, and Bishop to meet with Mr. Mike Ponder, Mr. Carlton
Niemeyer, and Mr. Lloyd Taylor to discuss the moratorium on
sewer connections outside the City Limits. The committee
is to make a recommendation to the Council at the next regu-
lar session as to what action should be taken, if any.
Mayor Nix appointed a Civic Center Architect Committee
to consist of all five Councilmembers and Building Official
Bob Lunsford. This Committee is to select an Architect and
recommend him or her to the remodling of Del -Fair Shopping
Center into a Civic Center Municipal Complex. Mayor Nix asked
Councilman White to serve as Chairman of this Committee and
to report back to Council at the next regular session or the
first regular session in June.
Councilman McCawley moved to authorize bid requests on a
Trash Collection Service. General Supt. Rutherford and Street
Supt. Mason are to draw up the specifications. Seconded by
Councilman Bishop, motion passed unanimously.
Councilman White introduced an.,Ordinance to re-establish
the boundaries of Fire District 1.
Councilman Bishop introduced an Ordinance to revise Permit
Fees.
Councilman Box introduced an Ordinance to revise tapping
fees to connect onto City Utility mains.
Mayor Nix proclaimed Friday, May 15th, Fairhope High
School Baseball Team Day.
Councilman Box reminded Mr. Moore and Mr. Metcalf that
written replies from property owners are required before any
go-ahead can be given on the sewer improvement assessment
project.

Councilman McCawley moved to pay bills as presented.
Seconded by Councilman Bishop, motion passed unanimously.
