COUNTY OF BALDWIN
We, the undersigned members of the Fairhope City Council, do
hereby waive notice of a special called meeting to be held 20 April 1981
at 5:30 pm; City Administration Building ,387 Fairhope Avenue, Fairhope,
Alabama, for the purpose of discussing public interest in a Public
Improvements Assessments Project.

The City Council, City of Fairhope, met in special session
at 5:30 p.m. City Administration Building, 387 Fairhope Avenue
Fairhope, Alabama, on Monday, 20 April 1981.
The purpose of this meeting was to hold a public hearing
on the public's interest in a Sewer and Curb & Gutter Assessments
program.
Present were Mayor James P. Nix; Councilmembers Sam E. Box,
Roy C. White, C.O. McCawley, and David E. Bishop; and City Clerk
Evelyn Phillips. (Councilwoman Nelson arrived late, as indicated
in the minutes.)
Mayor Nix called the meeting to order and welcomed the
audience of some 65-75 persons.
The Colonial Acres area was first discussed. Engineering
Consultant Ack Moore advised the sewer improvements would cost approx-
imately $1,660 per lot. Of those present or represented by letter
13 were opposed and 3 were in favor. Curb & gutter was estimated
at $5.75 per front foot. Of those present or represented by
letter, 16 were opposed and none were in favor.
Councilman Bishop moved to drop Colonial Acres from consider-
ation. Seconded by Councilman McCawley, motion passed unanimously.
The next area to be discussed was some 82 acres consisting of
some undeveloped land, Forster Avenue, and Volanta View Subdivision.
This was for sewer improvements only:

Councilman Bishop moved to withdraw the Troup property, the Frederick
property, and the Forster Avenue area from consideration; and to have
Engineer Moore contact Mr. A. Corte, Mr. F. Corte, Mr. Arens, and
Mr. Rockett for written confirmation of their wishes before preceding
further. Seconded by Councilman Box, motion passed unanimously.

A lady asked Mr. Moore about how much her paving estimate on
Lincoln Street would be increased for sewer also. Mr. Moore
estimated an increase of about $7-8 per front foot.
Discussion on the Curb & Gutter improvements was taken street
by street: (Price estimated to bye $5.75 pff except where another
price is noted.)

759' were opposed. 436' were in favor. Mayor Nix
was asked how the City would vote its front footage on this
street. The Mayor said this would require a Council vote.
When pressed, Mayor Nix said the City would probably vote
with the majority of the property owners but that decision
would be taken by Council vote.

Councilman White moved to drop consideration of the Curb
& Gutter Improvements on all these streets,(School, Ettle, all
sections of Nichols, Gaston, White, Pier, Pecan, Volanta, Orange
Fig, Church, Pomelo, Freedom, Bay View, George, Equity, Liberty,
Summit, Section, and Middle) due to the inadequate public response.
Seconded by Councilman Box, motion carried over one NAY vote by
Councilwoman Nelson.
