HomeMy WebLinkAbout03-09-1981 Regular Meeting261 STATE OF ALABAMA COUNTY OF BALDWIN The City Council, City of Fairhope, met in regular session at 7:00 p.m., City Administration Building, 387 Fairhope Avenue, Fairhope, Alabama 36532, on Monday, 9 March 1981. Present were Councilmembers Sam E. Box, David Ed Bishop, C.O. McCawley, Trisha Nelson, and Roy C. White; City Clerk Evelyn Phillips Mayor James P. Nix and City Attorney John Duck were out of town. Chairman Pro Tempore Sam E. Box presided in the absence of the Mayor. The minutes of the 23 February 1981 regular session and the 5 March 1981 special session were duly approved. Councilman Bishop moved for Final Adoption of Ordinance No. 668, an Ordinance to be known as the Flood Plains Ordinance. Seconded by Councilman White, motion passed unanimously. Mr. Ack Moore, Moore Engineering Company, made the following report and recommendations relative to the bid opening on the Waterline Extension(FHA) Project held at 10:00A.M., 9 March 1981: " I have examined the bids submitted.... checked for compliance with bid specifications and/or errors in unit price exten- sions. I have evaluated and compared the various bids received and find them reasonable and representative of the type work involved. I, therefore, recommend the tentative acceptance of the following bids. DIVISION I.- WELLS: I recommend accepting the bid of LAYNE-CENTRAL COMPANY,....., Pensacola, Florida,..... Phase A & Alternates 1, 2, 3: .$486,492.00 I also recommend acceptance of Alternate No. 4 of Layne - Central in the amount of $29,940.00, DEDUCT from well bids in case wells are located on sites with tanks. DIVISION II. - TANKS: I recommend the acceptance of BROWN STEEL CONTRACTORS, INC., Newnan, Georgia, ... Item 1: $451,290.00 DIVISION III. - DISTRIBUTION SYSTEMS: I recommend acceptance of OVERSTREET CONTRACTING COMPANY, INC., Satsuma, Alabama,... Items 1 through 20 $433,894.95 and Alternate No. 1, Item 21 in the amount of $22,550.00 in the event that this item is required..... 3/9/81 262 DIVISION IV. - DISTRIBUTION SYSTEM: I recommend the acceptance of TUCKER BROTHERS CONTRACTING COMPANY, Pell City, Alabama...... Items 1 through 22: $400,824.50 and Alternate No. 1, Item 23 in the amount of 24,900.00 in the event that this Item is required...." (Letter from A. Moore to City Council dated March 9th, 1981.) Councilman McCawley moved for tentative acceptance of the bids as outlined by Mr. Moore's letter of 9 March 1981; acceptance contingent upon Farmers Home Administration approval. Seconded by Councilwoman Nelson, motion passed by the following vote: AYE -Mr -Cawley, Nelson, White, Bishop, and Box. NAY -none. Chairman Box opened the following bids on utility poles: American Creosote Hatfield & Co. 8 65' 412.70 415.75 ea. 20 40' 101.78 106.50 ea. 20 30' 53.95 60.85 ea. Councilman Bishop moved to accept the low bid, provided all specifications are met. Seconded by Councilwoman Nelson, motion passed unanimously. Chairman Box opened the following bids on lights for the Girls Softball Field: 30 lights, 1500 W Hatfield & Co. $205.00 each Mack Electric Co. 192.00 if Stuart Irby Co. 189.43 if Councilman Bishop moved to accept the low bid, provided all specifications are met; and the cost to be charged to the Recreation Dept. Seconded by Councilwoman Nelson, motion passed unanimously. Councilman White moved to accept a Performance Bond from Eastern Shore Builders, Inc. in the amount of $25,604.00 on Meadowbrook S/D Unit II. Seconded by Councilwoman Nelson, motion passed unanimously. Councilman Bishop moved we purchase 9 electric customers from Baldwin County EMC at the usual rate of 4 times the gross receipts. Seconded by Councilwoman Nelson, motion passed unanimously. Councilman McCawley reported on his and Councilman Box's trip to Montgomery to appear before the House Ways and Means Bill. Council- man McCawley said our opposition, based on revenue loss in the PJ and loss of taxation power, was unsuccessful at this point; however other actions are still available before the bill becomes law. Councilman McCawley introduced, and moved for the adoption of the following resolution to be sent to our representatives and other key members of the State legislature. Seconded by Councilman Bishop, motion passed unanimously: RESOLUTION NO.3-81 BE IT RESOLVED BY THE MAYOR AND COUNCIL of the City of Fairhope that our State Representatives and Senators be strongly uR,GC c) 3/9/81 263 and petitioned to amend .the Uniform Beer Tax Bill(H380, Rep. G. Clark) to allow Municipalities to continue to collect taxes on Beer sales in their respective Police Juris- dictions. BE IT FURTHER RESOLVED that this Resolution be expressly directed toward the representatives of Baldwin County. ADOPTED THIS 9th DAY OF MARCH, 1981. O City C erk Councilman White led a discussion on public improvements. Consensus was to hold a public hearing first on a paving assessments project; later on curb & gutter, repaving, and sewer; and -hold up on drainage until discussions can be held with the Baldwin County Commissioners on coordination of drainage projects. Council- man White moved to advertise a public hearing for all those property owners now living or owning property on unpaved streets who are interested in a paving assessments project. Meeting to be held April 6, 1981, at 7:00 p.m. at the City Hall. Seconded by Council- man McCawley, motion passed unanimously. Councilwoman Nelson moved to hear the following business not on the Agenda. Seconded by Councilman White, motion passed unan- imously. A letter was read from the Saratoga Trunk requesting a special permit to sell alcoholic beverages on Sunday, March 22nd, during Arts & Crafts Festival. After some discussion, Councilman McCawley moved to deny the request. Seconded by Councilman Bishop, motion carried by the following vote: AYE-McCawley, Bishop, White, and Box. NAY -Nelson. Councilman McCawley moved to pay bills as presented. Second- ed by Councilwoman Nelson, motion passed unanimously. Councilman White moved to hear the following business not on the Agenda. Seconded by Councilman McCawley, motion passed unanimously. ` Councilwoman Nelson moved to request bids on playground equip- ment to be used at the beach area, payment to be made out of the Beach Fund. Seconded by Councilman White, motion passed unanimously. (3/9/81) 204 Councilwoman Nelson moved to hear the following business not on the Agenda. Seconded by Councilman Bishop, motion passed unanimously. A discussion was held on the deadline for the special $50.00 tapping fee on the waterline (FHA) extension. No action was taken.
