HomeMy WebLinkAbout12-11-1978 Regular Meeting16 STATE OF ALABAMA X COUNTY OF BALD IN X The City Council, City of Fairhope, met in regular session at 7:00 P.M., City Administration Building, 387 Fairhope Avenue, Fairhope, Alabama 36532, on Monday, 11 December 1978. Present were Mayor James P. Nix; Councilmen Jack A. Stipes, Billy Don Wiggins, Henry G. Bishop, Sam E. Box, Sr,. and David Ed Bishop; City Attorney John Duck; and Acting City Clerk Evelyn P. Phillips. Mayor Nix introduced Ms. Carol Williams of Scott Paper Company's Publicity Department who was making a few photographs to be published in "Scott World" as part of an article featuring Councilman David Ed Bishop. Minutes of 27 November 1978 regular session and 28 November 1978 special session were duly approved. Mayor Nix awarded three special Certificate of Appreciation documents to three gentlemen of Fairhope who spearheaded the Ambulance Service Con- tract drive. Mr. Paul McGrath, Mr. Paul Ring, and Mr. Franklin Buchanan were awarded these Certificates for their outstanding efforts in obtaining over 1,000 Ambulance Service Contracts. This successful drive will enable Fairhope Ambulance Service Owner Gary Sandell to remain in operation with- out.City financial assistance this year. Councilman Stipes introduced an ORDINANCE to establish procedure for all applications to the City Council of the City of Fairhope for approval of the issuance of Beer or Liquor Licenses that are located within the City Limits of the City of Fairhope, or its'Police Jurisdiction. Councilman Stipes moved that Mr. Harmon Stearns be removed from the position of City Building Inspector, that Mr. Jack Kirk be appointed City Building & License Inspector and Personnel Officer with Mr. Stearns as his assistant. Motion died due to lack of a Second. Councilman Stipes moved the City obtain bids on a hopper for the Garbage Transfer Trailer. Seconded by Councilman Ed Bishop, motion passed unanimously. Electrical Superintendent Aaron Norris' written report on the bid opening last Monday for an Oil Circuit Breaker was reviewed by Council. Upon Mr. Norris' and City Engineering Consultant H.S. St. John's recommendation, Councilman Ed Bishop moved the low bid of $25,151.00 entered by Mack Electric Company of Dothan, Alabama, be accepted. Seconded by Councilman Wiggins, motion passed unanimously. Councilman Box moved for the rejection of all bids received at last regular Council meeting on a pick-up truck for the Water & Sewer Depart- ment. Seconded by Councilman Wiggins, motion passed unanimously. (11 December 1978) 17 Councilman Box moved the City obtain bids on a pick-up truck for the Water & Sewer Department. Seconded by Councilman Henry Bishop, motion passed unanimously. Councilman Wiggins and City Superintendent Phil Rutherford were asked to assess the feasibility and cost of reworking curbs at downtown intersections to make the streets safer for and accessible to Handicapped Persons. They will report their findings to Council at a later date. Councilman Ed Bishop moved final payment of retainage due to Delta Plumbing Company on the 16" Sewer Outfall work, Flood Damage Project, be paid. Seconded by Councilman Stipes, motion passed unanimously. Councilman Henry Bishop moved that Mrs. Evelyn P. Phillips be ap- pointed to the permanent position of City Clerk -Treasurer at a salary of $1,000 per month. Seconded by Councilman Box, motion passed unanimously. Councilman Ed Bishop moved for the adoption of the following Resolution. Seconded by Councilman. Box, motion passed unanimously: RESOLUTION WHEREAS, all Anti -Recession Funds received by the City of Fairhope have been and are obligated for the use of the Fairhope Public Library, and WHEREAS, this has been standard practice since said funds were first received, and, WHEREAS, this will continue to be standard parctice should additional funds be received, and WHEREAS, the Council Minutes do not reflect the adoption of this standard obligation by motion or resolution THEN, TIlEREFORE, IT IS RESOLVED that the practice of obligating all Anti -Recession Funds to the Fairhope Public Library is and has been a standard practice. Adopted this llth day of December 1978. 00, ,v az' G'9J_L_ '__� Act' g City Clerk Councilman Box moved Employee's Christmas Holidays be scheduled to commence at 12:00 noon, Friday, December 22nd, and conclude at the end of Christmas Day, December 25th, due to the fact that Christmas Eve falls on a Sunday this year. Seconded by Councilman Stipes, motion passed unan- imously. (December 11, 1978) 18 Councilman Henry Bishop moved that giving of Christmas Turkeys and Christmas Bonuses be done this year as it was last year, with finds pro- vided by the Electric Fund. Seconded by Councilman Box, motion passed unanimously. Councilman Stipes moved that a portion of the retainage due con- tractors for work under the 1977 Street Improvement Project be paid as recommended by City Engineers with the exception of Valta Construction Company. Seconded by Councilman Wiggins, motion passed unanimously. Councilman Ed Bishop moved to authorize City Attorney John Duck to contact Earle Construction Company regarding repair work to be done on Ronforth & Kurlane Streets. Seconded by Councilman Stipes, motion passed unanimously. Mrs. Sally Maloney of 565 North Mobile Street came before Council with a complaint against the VFW Club located on North Mobile Street. Mrs. Maloney presented a petition, signed by some 24 people who live near the Club, re- questing Council take action against the Club because of noise. The petition sites Fairhope Ordinance Code Section 14-14 and Ordinance No. 554 and states the Club is in violation of these anti -noise Ordinances, and that calls to the Police are not solving the problem. Mrs. Maloney also presented a motel bill and requested payment for the time she and her daughter spent away from home due to the noise problem. Councilman Box moved the request for payment of motel bill be denied. Seconded by Councilman Wiggins, motion passed unanimously. Councilman Wiggins moved to have Mayor Nix contact the Commander of the VFW Club by letter, stating the complaint entered by Mrs. Maloney and petitioners, and requesting the Commander to appear before Council at next regular session. Seconded by Councilman Ed Bishop, motion passed unanimously. Mayor Nix announced the finalization of the purchase of West Baldwin Water Authority is planned for December 15th. It will be necessary to pay off their outstanding Loans of approximately $97,000 - $98,000 after receipt of their monies. Mayor Nix also announced a special session of the Council to be held Monday, December 18th, for the purpose of holding a public hearing of proposed City Budget for Fiscal Year 1978-1979. Meeting will be at 7:00 p.m., City Administration Building, 387 Fairhope Avenue, Fairhope, Alabama., and the news media were asked to publicize this meeting. A letter from the Executive Council of the Fairhope Single Tax Corp- oration stated they could not approve the proposed use of Knoll Park by the Eastern Shore Art Association for Arts & Crafts week -end as such use would be in conflict with the Park Deed. Councilman Ed Bishop moved the Mayor contact the Art Association and offer them the use of a closed street, Oak Street from Section to Church, as an alternative. Seconded by Council- man Box, motion passed unanimously. M (December 11, 1978) 19 Councilman Stipes moved all old unpaid utility bills over $25.00 with correct addresses, be tinned over to Small Claims Court for collec- tion. Seconded by Councilman Wiggins, motion passed unanimously. Co mcilman. Wiggins moved the Baldwin County Re -Appraisal Invoices be struck from the list of Bills Payable until such time as the City can be advised just how much more is due. Seconded by Councilman Stipes, motion passed unanimously. Councilman Henry Bi,-f�op moved all other bills be paid as presented. Seconded by Councilman. Stipes, motion passed unanimously. Councilman Stipes moved to authorize City Attorney John Duck to take action on the collection of $1,165.34 due from Major Homes, Inc., for engineering services and laboratory work done on correcting street prob- lems in Paddock Estates. Seconded by Councilman Box, motion passed unan- imously. Meeting was duly adjourned.
