HomeMy WebLinkAbout06-16-1977 Special Meetingi e + s* t ' " , STATE OF ALABAMA _ COUNTY OF BALDWIN The City Council of the City -of Fairhope, Alabama met in special called session on Thursday, June 16th, 1977, at 7:00 P.M. at the City Administration Building, 387 Fairhope Avenue, Fairhope Alabama for the purpose of reviewing and revising the City of Fairhope's Personnel Rules and Regulations. The following members were present: Mayor James P. Nix; Council- men: David E. Bishop, Henry G. Bishop, Sam E. Box, Jack A. Stipes and Billy Don Wiggins. The Mayor and Council decided to strike out the word Mayor under Section IV Duties of the Personnel Officer as set out in the Ordinance introduced at the June 13th, 1977 meeting of the Council establishing a Personnel system. Under Section IV: (d) advise the municipal governing body regarding the most effective manpower resources: (e) make an annual report to the municipal Governing Body regardi the status of the personnel administration program. The Mayor and Council went through the Personnel Rules and Regula- tions one page at a time and the following changes were made: 1. Page No. 9- Section V. Leaves of Absence Section 2. Holidays The following and such other days as the Governing Body proclaims are holidays for all employees except emergency employees: New Years Day-- January 1 Independence Day-- July 4 Labor Day-- First Monday in September Veteran's Day- November 11 Thanksgiving Day- Fourth Thursday in November Christmas- one-half day December 24th, and all day December 25th. Mardi Gras Day Upon being put to vote for having the fourth Thursday and Friday in November as Thanksgiving Holidays the following vote was recorded: AYES: David E. Bishop, Billy Don Wiggins, Mayor Nix. NAYES: Henry G. Bishop, Sam E. Box Jack A. Stipes. Upon being put to vote for' having December 24th and 25th for the Christmas holidays the following vote was recorded: AYES: David E. Bishop, Mayor Nix NAYES: Jack A. Stipes, Henry G. Bishop and Sam E. Box. It was agreed that. the,fourth Friday in November for Thanksgiving Holidays would be omitted and that the 24th of December would be changed from all day to a half a day. Section 2. Holidays i (a) Permanent Employees x For permanents employees on a work week other than Monda through Friday;­the- bepartment Head shall designate the work day that shall,begobserved is a holiday. (b) Holidays on.Scheduled work days Employees who'areirequired to,work on the observed holiday shall be granted a work day of leave, or overtime at the discretion of the department head. Page -No. 12 Section 5 Military Leave (d) Any employee who is a member of the National Guard of Alabama or reserve officer or enlisted man in the Army or Navy or Marine Corps, or Air Force Reserve shall be granted leav of absence with pay being the difference between normal and military pay, if any, for the purpose of attending an encampment of such organization for training when so ordered by military authority. The maximum military leave shall not exceed twenty- one (21).days in any calander year. ( refer to: Title 35, Section 185 (130 (a). Code of Alabama 1958, recompiled as amended.) Page No. 14 Section 11 Civil Leave An employee called for service on a jury may be grante leave with the City paying the difference between normal pay and jury pay, for the duration of the period for which called, unles released earlier, without charge against annual leave. Section 14 Place of Residence All permanent employees shall live within the Corporat Limits of ,the,.,City of Fairhope., This section shall not be retoractiv&, and no other action shall be taken concerning those employed and living 'out 'of -the City at the time of the adoption of this section. However, those living outside of the Corporate Limits shalltbe considered last.for promotions. Page No. 15 VI. Employees Benefits Section 4. Retirement Details of the City o"^Fairhope's Retirement Program are under a seperate contract. Policemen will be eligible for retirement at age fifty-five (55) pro- viding mandatory contributions shall be a condition of their employment. Page No. 17 VIII Retirement Section 1. Normal Retirement Age The normal retirement age for employees is 65 and 55 for Police Personnel. Extension of employment beyond the normal retirement age must be approved by the Appointing Authority upon the recommendation of the department head. Page No. 18 SECTION 3. GRIEVANCE POLICY (b) An employee must submit his grievance to his immediate supervisor for initial settlement. It may be either written or oral. If within five (5) working days a satisfactory solution has not been obtained, the employee may file a written appeal with his department head. The department head must provide a a written statement of his findings and action taken within five (5) working days after notification of the appeal. If satisfac- tion is not obtained within five (5) working days following the date of appeal to the department head, the employee may appeal to the municipal personnel board for a hearing before a grievance committee. Within five (5) working days after receipt by the municipal personnel board of the employee's request for a grievance committee hearing, the municipal personnel board shall cause to be formed a grievance committee of three (3) persons to hear the employees grievance and to make a determina- tion thereon. One member of the grievance committee shall be appointed by the councilman committee chairman in charge of that department. One member of the grievance committee shall be appointed by the aggrieved party from among the other employees of the municipality. The two members so appointed shall select the third member of the grievance committee, who shall serve as Chairman. Page No. 18 SECTION 3 GRIEVANCE POLICY (continued ) Once formed the Grievance Committee must meet and hear the employee's grievance and issue a written opinion on such grievance to the,employee and municipal personnel board. The hearing by the grievance committee shall be open to the public at the discretion of the municipal personnel board. It shall be conducted in an informal manner and the Chairman shall make every effort to avoid the appearance of conducting a trial in a court of law. The appelant shall have the right to appear and be heard in person or by counsel. Appelants failure to attend,or notify the chairman of the grievance committee of his ina5i-lity to attend 'will constitute just cause for dismissal of`theappeal. Within -ten (10) calendar days of the receipt_.of the recommendations of the grievance committee, the municipal personnel board°shall make the final determinatioi in the case; The decision�of'the municipal personnel board shall be final. If the municipal personnel board fails to take action on the report of the grievance committee within the pre- scribed time, • the recommendations.of the grievance committee shall be final. Page No. 21- Section 2 Discipline Policy (14) Introduction, possession, or use on government property or in government equipment of intoxicating liquors, illegal drugs, or proceeding to or from work under the influence of liquor or illegal drugs. Page No. 24- Section 4 Duties The Board shall elect its own Chairman and establish its own rules of procedure which shall include a minimum of one meeting per month, if necessary, at a time and place set by the Board. The Chairman shall convene the Board at anytime upon receipt of a written request signed by two (2) members of the Board or signed by the Appointing Authority within a period not exceeding two (2) hours. The Board shall upon the request of the local Governing Body or upon its own initiative, inquire into the administra- tion of the personnel system and, on the basis of the inquiry make written recommendations regarding the system 'to the Governing Body. The Board as a whole, shall have acess to any records necessary for its inquiry. The Mayor and Council agreed to have the above revisions put into the final draft of the Personnel Rules and Regulations. There being no further business, the meeting adjourned at 9:00 P.M. ,.
