COUNTY OF BALDWIN
The City Council of the City of Fairhope met in regular
session at the City Administration Building, 387 Fairhope
Avenue, Monday, November 24, 1975 at 7:00 P.M. with the follow-
ing members present: Mayor James P, Nix, Councilmen: David E.
Bishop, H, G. Bishop, Sam E. Box and Barney L. Shull, Council-
man 011ie E. Deese being absent.
Minutes of the previous regular meeting were approved.
Mr, Phillip Stenzel met with the Council protesting the
paving assessment on his property. The City Attorney read the
law that the City has to follow when property owners are involved
in a paving venture which includes a protest hearing before the
paving is started and another when the assessment roll is completed.
This being date set for public hearing on rezoning Kilgore
property at the Northwest corner of Pecan and Section Street from
R-2 to R-4 in order to build Townhouse type apartments-, a group
of residents in the area were present to protest the rezoning.
A petition was presented which was signed by 66 residents in the
area. After a general discussion Councilman Box moved, seconded
by Councilman David Bishop that the request for rezoning be denied
as recommended by the Fairhope Planning and Zoning Commission.
Motion carried unanimously,
Motion by Councilman Sam Box seconded by Councilman David
Bishop that the Mayor be authorized to sign agreement with the
State for a Traffic and Safety survey at no cost to the City.

Motion by Councilman H. G. Bishop seconded by Councilman
Barney Shull that Ordinance No.563, AN ORDINANCE TO PROVIDE FOR A
CENSUS TO BE TAKEN OF THE INHABITANTS RESIDING WITHIN THE CORPORATE
LIMITS OF THE CITY OF FAIRHOPE, ALABAMA, APOINTING ENUMERATORS
THEREFOR AND CERTIFYING THE RESULTS OF THE CENSUS TO THE SECRETARY
OF STATE, introducd at the regular meeting of November 10, 1975
be adopted as introduced. Motion carried.
This being date set for opening bids on poles the following

Motion by Councilman David Bishop seconded by Councilman Barney
Shull that City accept low bid of Huxford Pole & Timber Co., Inc.
if bid meets specifications. Motion carried.
Motion by Councilman Sam Box seconded by Councilman Barney
Shull that the City reject bid of Shell Oil Company for gasoline,
submitted at the November 10 meeting. Motion carried.
Motion by Councilman Sam Box seconded by Councilman Barney
Shull that City negotiate for lower bid on gasoline for City
vehicles. Motion carried.
Motion by Councilman H. s. Bishop seconded by Councilman Sam
Box that City refund Volunteer Fire Department $675.32 for
insurance. Motion carried.
Motion by Councilman Barney Shull seconded by Councilman
Sam Box that the application for beer permit at Bama-Bino's
Pizza Den be approved. Motion carried.
Motion by Councilman Barney Shull seconded by Councilman Sam Box
that the application of Edgar Sullivan for Beer Permit at Busy
Bee Garage be approved. Motion carried.
Motion by Councilman Sam Box seconded by Councilman H. G.
Bishop that the City accept low bid of W. R. Mitchell, Contractor,
submitted at the October 27th meeting, in the amount of $1,371.70
for 16" X 12" Tapping Sleeve and Valve. Motion carried.
Action on pipe was held for next meeting of the Council.
It was duly moved, seconded and carried that the meeting adjourn.

RESOLUTION
WHEREAS, the City Council of the City of Fairhope is desirous
of having a study conducted of the traffic control devices within
the corporate limits of the municipality in accordance with Stand-
ard 613 of the Highway Safety Act 1966, amended 1970.
WHEREAS,the State of Alabama Highway Department is desirous
of having all traffic control devices within the State meet the
standards of the Alabama Manual on Uniform Traffic Control
Devices 1972 and National Manual on Uniform Traffic Control
Devices 1971, and has received a grant, Numbered 613-76-001-001
for such studies to be conducted.
WHEREAS, the State of Alabama Highway Department and the
Office of Highway and Traffic Safety will not participate in the
said project until and unless the City of Fairhope will agree to
accept the standards for the placement and design of any and
all traffic control devices as stated in Title 36, Code of
Alabama 1940, as amended and the Alabama Manual on Uniform
Traffic Control Devices 1972, and until and unless the City of
Fairhope agrees to refrain from placing or permitting the place-
ment of any traffic control device that does not meet the above
standards at any and all locations within the study area and
until and unless the City of Fairhope'agrees to implement the
recommendations of the studies within their budgetary limitations
but with a defined program for upgrading and standardizing traffic
control devices and until and unless the City of Fairhope
agrees to enforce those traffic control devices requiring such
under the provisions of Section 58(36) and Section 51, Code of
Alabama 1940, as amended by Act No. 517, General Acts of Alabama
1949.
NOW, THEREFORE, be it resolved by the City Council of the
City of Fairhope that in consideration of the State Highway
Department and/or its selected consultant study, it hereby agrees
to accept the standard of the Alabama Manual on Uniform Traffic
Control Devices 1972; and install the traffic control devices
recommended in this project as indicated on the final copies of
the report in accordance with the Alabama Manual on Uniform
Traffic Control Devices and there will be provision by the City
to program for the systematic upgrading and standardization of
the traffic control devices on those roadways on which it has
authority. The City further agrees that it will enforce those
necessary devices under the provisions of Title 36, Section 58(36)
and 51 Code of Alabama 1940, as amended by Act No. 517, General
Acts of Alabama 1949. The City further agrees to the scope of
tbthe project as shown on the attached project description and
budget itemization entitled, Form HS-1.
It is understood and agreed that the State of Alabama Highway
Department has the right and responsibility to choose a consul-
tant if it is determined that the scope of work is greater than
can be accomplished by State Forces.
The City Council further agrees for and on behalf of the City
of Fairhope to idemnify the State of Alabama, the State High-
way Director, the State Highway Department, its agents, servants
and employees from and against all manner of suits, claims,
actions and/or causes in equity whatsoever that may arise or are
alleged to have arisen as a result of the preliminary or actual
study.
