HomeMy WebLinkAbout05-12-1975 Regular MeetingSTATE OF ALABAMA CO JNTY OF BALDWIN The City Council of the City of Fairhope met in regular session at the City Administration Building, 387 Fairhope Avenue, on Monday, May 12, 1975 at 7:00 P.M. with the following members present: Mayor James P. Nix, Councilmen: H. G. Bishop, David E. Bishop, Sam E. Box, 011ie E. Deese and Barney L. Shull. Minutes of the previous regular meeting were approved. This being date set for public hearing on rezoning Lots 11 & 129 Block 6, Magnolia Beach Addition, from-R-2 to R-39 the following protests were heard: Mr. Gene Pirtle and Dr. and Mrs. Abrahamer. Mr. R. G. Rosenquist, owner of the property, stated that the reason for rezoning was to build a Duplex facing Fig Street, front set back from property line would be 35 ft with side set back 30 ft. and off street parking provided. The City's Planning Consultant recommended to the Planning Commission that the request be granted, the Planning Commission recommended to the Council that the request be denied. After general discussion, Councilman Barney Shull moved that the following Ordinance be introduced based on the recommendation of the Planning Consultant: ORDINANCE NO..5-51 AN ORDINANCE AMENDING ZONING O�ANCE NO. 295 Section 13, DISTRICT BOUNDARIES. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, Alabama that the following described property be rezoned from R-2 to R-3 as recommended by the Planning Consultant; Lots 11 and 12, Block 6, Magnolia Beach Addition to the City of Fairhope, Alabama. ADOPTED THIS THE,�DAY OF _, 1975• Approved Attest: ty Clerk Motion by Councilman David E. Bishop seconded by Councilman Sam Box that permission be granted to hold Art Show in Knoll Park in September. Motion carried. Motion by Councilman David E. Bishop seconded by Councilman Barney Shull that the City offer for sale on bid basis, four window air conditioner Units. Motion carried. Motion by Councilman David E. Bishop seconded by Councilman 011ie E. Deese that the City ask for bids on utility poles. Motion carried. Motion by Councilman David E. Bishop that the following Ord- inance be introduced: ORDINANCE NO. S S ,, AN ORDINANCE TO ADOPT THE NATIONAL ELECTRIC CODE, 1975 REVISION AND REQUIREMENTS OVER AND ABOVE THE NATIONAL CODE DUE TO CONDITIONS NATIVE TO THIS AREA. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA that all electrical work and all materials and appliances used in connection therwith installed within the City are con- formed to the rules, regulations and requirements of the 1975 National Electric Code and said rules are hereby adopted by reference as fully as if set out at length therein. BE IT FURTHER ORDAINED that the following requirements over and above the National Electric Code are required due to conditions native to this area: 1. A minimum of 100 AMP meter and breaker installation shall be required for all trailers. 2. Any new home or upgraded service shall have a minimum entrance of 100 AMP with 12 branch circuits. Any new home with electric heat shall have a minimum of 200 AMP capacity with at least 24 branch circuits. All panels, except power panels and those used in con- junction with a power panel, must have a main disconnect. 3. For permanent residences, nonmetalic sheathed cable No 12 AWG Copper or larger is required. Switch legs controlling only one or two ceiling fixtures may be No. 14 AWG Copper. Aluminum or copper clad aluminum smaller than No. 6 will not be approved. This Ordinance shall become law upon its due adoption and pub- lication as required by law. Bishop that all rules governing the Council which might, unless suspended, prevent the passage and adoption of this Ordinance at this meeting, be and the same are hereby suspended for the purpose of permitting the said Ordinance to be finally passed and adopted at this meeting. Councilman 011ie Deese seconded the motion and on roll call the vote was as follows: Voting for: Councilmen: David E Bishop, H. G. Bishop, Sam E. Box, 011ie & Deese and Barney L. Shull. Voting against: None. Motion carried unanimously. Councilman David E. Bishop moved for final adoption of said Ordinance which motion was seconded by Councilman Barney Shull and upon being put to vote the following vote was recorded: Voting For: Councilmen: David E. Bishop, H. G. Bishop, Sam E. Box, 011ie E. Deese and Barney Shull. Voting Against: None. Ordinance finally passed and adopted as introduced. Motion by Councilman Sam Box seconded by Councilman 011ie Deese that the Revenue Sharing Use Form be approved as submitted. Motion carried. Motion by Councilman Barney Shull seconded by Councilman Sam Box that Mr. Harford Field be reappointed to the Planning and Zoning Commission for a six (6) year term ending May 259 1981. Motion carried. Motion by Councilman Barney Shull seconded by Councilman David Bishop that City apply for 90% grant from State for updating signal lights in the City. Motion carried. This being date set for opening bids on mower, the following bids were received: TIECO CO. 72" Kut Quick 24 HP $4,980.00 72" Howard 25 HP 49050.00 72" Heckendorn 16 HP 39150.00 Casey Enterprises, Inc. 72" Hustler 20 HP 59295.00 Motion by Councilman Shull seconded by Councilman Sam Box that the City acknowledge bids, position of bidders and evaluate bids as received for matching specifications. Decision to be made on Saturday, May 179 1975 at 10:00 A.M. Motion carried. This being date set for opening bids on condensing unit for City Hall, the following bids were received: Ruffles Co. $19535.00 Dowsey Co. 19125.00 Motion by Councilman Sam Box seconded by Councilman 011ie Deese that City accept low bid of Dowsey Co. provided bid meets specifications. Motion carried. Motion by Councilman H. G. Bishop seconded by Councilman Sam Box that the bills be approved for payment as presented with the exception of Workmens Comp. bill which is being held for comparison. Motion carried.
