COUNTY OF BALDWIN
The City Council of the City of Fairhope, Alabama met in special
session at tha City Administration Building, 387 Fairhope Avenue
on Saturday, February 2, 1974 at 9:00 A.M. with the following
members present: Mayor James P. Nix, Councilmen: H. G. Bishop,
David (Ed) Bishop, Sam-E. Box, 011ie E. Deese and Barney L. Shull.
Each member signed waive ofinotice of the calling and holding of
said meeting for the purpose, of discussing and taking necessary
action on West Baldwin Water; rates, Bulldozer for Land Fill,
Decorative roof for old City Hall Building, 40 acre triarigle(Dyas
property) and any other business that might come befo:L%e the Council.
Motion by Councilman Shull seconded by Councilman Ed 3lshop that
Mayor Nix be authori,,cd to secure bids on Decor -Wall for old City
Hall building. Motion evtrried.-
Motion by Councilman H. G. Bishop seconded by Councilman Ed Bishop
that Mayor Nip and Councilman Barney Shull be authorized to proceed
with obtainin3 additional land for future land fill. Motion carried.
Motion by Councilman Sam Box seconded by Councilman 011ie Deese
that City ask for bids on bulldozer for land fill with priority .
consideration given on earliest delivery date. Motion carried.
Motion by Councilman Barney Shull seconded by Councilman 011ie'
Deese that Major Nix be authorized to meet with West Baldwin
Water Authority to inform them of rate increase of 40;$ due to
City's increase of 52%, increase in service charge per customer to
One Dollar (31.00) and charge for meter connection the same as for
residents of the City at $125,00 or cost, if more than 3125«00.
These rates to be effective on March 1, 1974. Motion carried.
In an effort to increase Fairhope's allowable "tax effort" under
the revenue sharing law, contents of a letter addressed to Mayor
Nix from Congressman Jack Edwards, revealed�ithat both Treasury and
Census stated that it would be permissable to reduce utility rates
and add a tax to the rate. This would in effect increase the
amount of funds due the City from Revenue Sharing with no additional
cost to utilV:y consumers. Motion was made by Councilman H. G.
Bishop seconded by Councilman Barney Shull that the Mayor secure a
ruling in writing from the Office of Revenue Sharing stating that
the proceeds From the new tax will qualify as tax effort. Motion
carried.
Triangle known as Dyas property was discussed but no action taken.
It was duly moved, seconded and carried that the meeting adjourn.

The City of Fairhope will agree to incorporate your development
area into the City Limits upon completion of annexation procedures
and accept your streets, drainage, and utilities for maintenance, pro-
vided that you meet all Subdivision Regulations and.Munlolpal Spec-
ifications. You will also be required to take all available City owned
utilities.
The responsibility for installation shall be as follows:
Streets: including necessary drainage within the development
shall be constructed at the developers expense and
In compliance with the City Subdivision Regulations
and Municipal Specifications.
Sewers: and appurtenances including lift station and force
main shall be oonstruoted at the expense of the
developer to the point of discharge at the existing
City manhole at Nichols Avenue and Greeno Road.
Water Mains:. and appurtenances shall be installed at the developers
expense from the point of distribution at the existing
City main at Greeno Road,
Natural Gas
Mains: shall be installed by the City.

Distribution: lines shall be installed by the City. (If underground
lines are desired, the developer will be required to
assume the total cost of same.)

All Annexation fees shall be borne by the developer and service
connection fees shall be in a000rdanoe with City Regulations in effect
at the time such oonneotions are made.
