HomeMy WebLinkAbout11-22-1971 Regular MeetingSTATE OF ALABAMA COUNTY OF BALDWIN The City Council of the City of Fairhope met in regular session at the Adult and Tourist Recreation Buil- ding on Morphy Avenue, Monday, Novembe r22, 1971 at 7:30 P.M., with the following members present: Mayor R. C. Macon, Councilmen: James P. Nix, John A. Robertson, Robert H. Cowen, Henry G. Bishop and Sam E. Box. Minutes of previous meeting were approved. Library Board met with Council requesting additio- nal funds of $11,606 per year for operating expenses. Mrs. R. Carr, Librarian, outlined the various activities at the Library and necessary equipment,.- needed. No action taken by the Council at this time, Councilman Bishop assuring the Board that the City would not let the Library close for lack of support. Mr. Ira Steele, Fire Chief, presented request for City to run 6" and 8" water mains to new buildings being built by Emperor Clock Co., in.order to install sprinkler systems in these buildings. Motion by Councilman Box secon- ded by Councilman Bishop that City install necessary lines provided Emperor Clock Company pays for materials. Motion carried. Municipal Airport Board presented their proposed project of extending runway;�to 5,,200 feet, which is minimun for (,all jet operations. Total cost of project to be' $124,250.00 from Federal and State grants, $24,2.50.00 from in- dividuals and Airport funds, leaving a- balance of $40,000.00 to be financed. Motion by Councilman Cowen seconded by Councilman Nix that the Airport Board be authorized to fund their part of Airport project by loan of $40,000.00 to be repaid from revenue derived from negotiated lease with Alabama Aircraft. Motion car- ried. Motion by Councilman Box seconded by Councilman Nix that City furnish water to Gulf Coast Experimental Station through 8" line after line has been constructed by the Experimental Station at no cost to the City, the 8" line to become property of City. Motion carried. Motion by Councilman Bishop, seconded by Councilman Box that Mr. Harmon Stearns be employed as Building Inspector for the City. Motion carried. Councilman Bishop introduced the following Ordinance: ORDINANCE NO. `f % AN ORDINANCE TO REPEAL SECTION 10-4, 10-5 AND 10-9 OF THE "CODE OF ORDINANCES", CITY OF FAIRHOPE, ALABAMA, AND TO AMEND AND ADD THERETO AND IN ITS PLACE AND STEAD, AN ORDINANCE FIXING FEES FOR COLLECTION OF GARBAGE OF RESIDENCES - FEES FOR COMMERCIAL ESTABLISHMENTS, HOTELS AND MOTELS - INDUSTRIES, AND FIX FEES FOR THE USE OF THE CITY DUMP BY PRIVATE INDIVIDUALS. BE IT ORDAINED by the City Council of the City of Fairhope, Alabama: Section 1 - That Section 10-4, Section 10-5 and Section 10-9 of the (Code of Ordinances, City of Fairhope, be, and the same are hereby repealed. Section 2 - To amend Section 10-4 of the Code of Ordinances of the City of Fairhope to read as follows: A. That in the exercise of the Police power of the City of Fairhope, Alabama, and for the purpose of enabling the City of Fairhope to perform a governmental function, there is hereby fixed the following fees for the collection, hauling, disposing of garbage and trash for residental establish- ments within the City of Fairhope, Alabama, to -wit: (1) For single-family dwellings or apartment units within the City of Fairhope, Alabama - $2.00 per month. Section 3 - Section 10-5 of the Code of Ordinances of the City of Fairhope, Alabama is hereby amended to read as follows: A. There is hereby fixed the following fees for collection, hauling and disposing of garbage and trash for commercial establishments, hotels and motels, -apartment houses, house trailers within the City of Fairhope, Alabama, as follows: (1) Apartment houses with more than one living unit - $1.00 per month per unit. (2) House trailers - $2.00 per month per trailer. (3) Offices - $2.00 per month each. (4) Businesses: (a) Two pickups per week - $5.00 per month (b) Three pickups per week - $8.00 per month (c) One pickup per day - $20.00 per month (d) Two or more pickups per day - $35.00 per month. q (5) Industries: (a) Two pickups per week - $5.00 per month (b) Three pickups per week - $8.00 per month (c) One pickup per day - $20.00 per month (d) Two or more pickups per day - $35.00 per month. Section 4 - It shall be unlawful to place in any garbage or rubbish container any acids or other dangerous liquids or substances which could cause injury to employees of the Sanitation Department engaged in removing refuse. Leaking and defective garbage cans with sharp or ragged edges likely to injure employees of the Sanitation Department engaged in removing refuse will not be serviced and the Sanitation Department shall cause to be placed on such cans a tag marked "Condemned". Section 5 - "Garbage Container" shall be taken to mean a watertight receptacle or can having a capacity of mot more than thirty (30) gallons, of sut stantial construction is approved by the Sanitation Department and applicable Codes, with a tight fitting lid or cover, and two handles on the sides of the receptacle or can. Section 6 - Section 10-9 of the Code of Ordinances of the City of Fairhope is hereby repealed, and in its place and stead as follows: Section 10-9 - PERMIT TO USE CITY DUMP. (a) Any person desiring to use the City Garbage Dump for the purpose of dumping or disposing of refuse shall first make application for a permit to do so, when application shall be prepared by the Superintendent of the Sanitary Department of the City, or his designated agent, and such application shall re- quire information regarding the nature and quantity of the refuse. Upon receipt of such application, if the said Superintendent of the Sanitary Department, or his designated agent, determines that such refuse may be dumped without detri- ment to the garbage dump of the City, the following charges will be paid there- for: (1) Amount carried by hand or automobile - $1.00 per load (2) Amount carried by vehicle with capacity above automobile, to and including a half -ton pickup truck - $2.50 per load (3) Amount carried by vehicle with capacity above half -ton pickup truck, to and including one ton trucks - $4.00 per load (4) Amount carried by vehicle with capacity in excess of one ton truck, to and including two ton trucks - $6.50 per load -2- 1 3 (5) Amount carried by vehicle with capacity in excess of two ton truck or packer truck - $13.50 per load Section 7 - All bills for services rendered hereunder shall be due and payable monthly and fees charged hereunder shall be sent out on the utility bill for power, water and gas, or one of them mailed out by the Utilities Department of the City of Fairhope, Alabama, and such fee shall be paid when the said bill is paid, and the said Utilities Department shall not accept payment of any utility bill unless the fee for garbage and trash service hereunder is also paid All fees collected hereunder shall be net, and all accounts shall be considered delinquent if not paid within the time limit specified in the bill so rendered by the Utilities Department of the City of Fairhope, Alabama. All delinquent accounts are subject to the same penalties as are now in effect by the Utilities Department of the City of Fairhope in connection with delinquent accounts for utility service rendered by said City. Fees for use at the site of the garbage dump shall be paid to the attend- ent on the site. Section 8 - Any person, firm, association or corporation violating any provision of these sections and this Ordinance shall be guilty of a misdemeanor and, on conviction shall be fined not less than $1.00 nor more than $200.00 at the discretion of the City Recorder hearing the case. Section 9 - If any clause, sentence, section or provision of this Ordinance is held invalid or inoperative, the remainder of the Ordinance shall not be affected thereby. Section 10 - All Ordinances or parts of Ordinances in conflict with the provisions of this Ordinance are hereby repealed. ( Section 11 - This Ordinance shall become effective on the i ,a day of \ ? 197.L after due advertisement in legal form. JADOPTED this a ] day of 1971. Councilman Nix introduced the following Ordinance: ORDINANCE NO.J7L AN ORDINANCE TO AMEND SECTION 13-7 OF THE CODE OF OR DI NA LACES OF THE CITY OF FAIRHOPE, ALABAMA BY ADDING THERETO A FINE OF TWO ($2.00) DOLLARS FOR OVERTIME PARKING. BE IT ORDAINED by the City Council of the City of Fair - hope, Alabama to amend Section 13-7 of the Code of Ordinances of the City of Fairhope, Alabama to read as follows: SECTION 13-7- PARKING - GENERALLY: It shall be unlawful for any person to park any vehicle on the streets or Avenues, public ways and public places, and seg- ments and parts thereof, of theCity during the hours, for a longer length of time, or in a manner other than permitted and indicated by the posted markings or during the hours, for a length of time, or in a manner prohibited as indicated on such markings. Any person violatin the provisions of this Section shall be fined not more than TWO ?$2.00) DOLLARS by the City Recorder of the City of Fairhope, Alabama ATTEST: ADOPTED this the day of CITY CLERK CITY OF FAIRHOPE By MAYOR 1971.
