COUNTY OF BALDWIN
The City Council of the City of Fairhope met in regular
session at the Adult and Tourist Recreation Building on Morphy
Avenue, Monday, November 8, 1971 at 7:30 P.M., with the follow
ing members present: Mayor R. C. Macon, Councilmen: James P. Nix,
John A. Robertson, Robert H. Cowen, H. G. Bishop and Sam E. Box.
Minutes of previous regular meeting were approved.
This being date and time set for public hearing on re-
zoning from R-2 to R-3, Lots 4 thr..nugh 10, and 12 through 23,
Gooden Subdivision, there being no protests Councilman Box moved
that the following Ordinance be introduced:

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIR -
HOPE, ALABAMA , that,
Section 13, District Boundaries, of Zoning Ordinance No.
295 be amended by rezoning the following described property from
R-2 to R-3 as recommended by the Planning and Zoning Commission.
Lots 41i,through 10 and 12 through 23,
Goodens Subdivision, located on North-
rup Street in the City Limits of Fair -
hope, Alabama.
This being date and time set for public hearing on re-
zoning Lots 7 & 8, Block 11, Magnolia Beach from R-2 to R-3,
there being approximately 30 residents of the area present with
Mr. Fred F. Smith, Jr., as spokesman, presented signed petition
protesting the rezining (Petition on file). Motion by Council-
man Nix seconded by Councilman Bishop that request for rezoning
be denied. Motion carried unanimously.
Mr. Alexander King, Land Developer, Builders Homes, Inc.,
requested information on the availability of City utilities for
fifty acre development on Greeno Roa d.
Motion by Councilman Bishop seconded by Councilman Box
that Ordinance No. 476, An Ordinance Amending Section 1-8 of
the "Code of Ordinances, City of Fairhope, Alabama", be finally
adopted as introduced at the regular meeting of October 26, 1971.
Motion carried unanimously.
Mr. Dyson reported to Council that he plans to retire on
January 1, 1972 but would be available to work on part time basis.
Motion by Councilman Bishop seconded by Councilman Nix
that request for addition on West side of Dixie Drive In be ap-
proved as presented. Motion carried.
Motion by Councilman Robertson seconded by Councilman
Cowen that E. J. Kirk and Ira Steele be authorized to attend
Arson School at the University of Alabama on November 15th
through November 19, 1971. Motion carried.
Motion by Councilman Robertson seconded by Councilman
Bishop that the following Resolution be adopted. Motion carried.

'WHEREAS, the Mayor and City Council of the City of Fairhope, Fairhope,
P',labama, met in joint session with the Council of the Fairhope Single Tax
Corporation at a meeting on the 2nd day of November, 1971, and
WHEREAS, it was the consensus of both parties that Fairhope Avenue from
Section Street to Greeno ^oad should be improved, and
WHEREAS, the Fairhone Single Tax Corporation did pass a Resolution
wherein it ;would, at it's own expense, four -lane Fairhope Avenue from section
Street to Bayou Charbon if the City of Fairhope would finish the paving from
Bayou Charbon to Greeno Road, and
WHEREAS, the Mayor and City Council of the City of Fairhope, Alabama is
desirous of improving the said Fairhope Avenue,
NOW, THEREFORE, BE IT RESnLVED, by the mayor and City Council of the
City of Fairhope that if the Fairhope Single Tax Corporation four -lanes Fair -
hone Avenue fror, Section Street to Bayou Charbon, that the City of Fairhope
would not charge back any assessment to Fairhone Single Tax Corporation if
Fairhope Single Tax paid for this improvement in full at it's own expense.
BE IT FURTHER RESOLVED that the City of Fairhope would continue the
improvements on Fairhone ^venue from Ravou Charbon to Greeno Road at it's own
expense and at no exnense to Fairhone Single Tax Corporation.
ADOPTED this the8th day of November, 1971.

Motion by Councilman Bishop seconded by Councilman Nix
that bills be approved for payment. Motion carried.
Minutes of spe cial meeting of November 3, 1971 were
approved.
Motion by Councilman Bix seconded by Councilman Nix
that Moore Engineering Company be authorized and directed to
advertise for bids on Project WPC-ALA.-204, bids to be opened
at the meeting of the City Council on January 10, 1972. Mo-
tion carried.
Motion by Councilman Robertson seconded by Councilman
Nix that Moore Engineering Company be authorized to negotiate
contract with M. C. Williams Contracting Co., for paving, curb
and gutter on Fairhope Avenue from Bayou Charbon to Greeno Road.
Motion carried.
Motion by Councilman Box seconded by Councilman Nix that
Mayor be authorized to sign Service Agreement between United
Gas Pipe Line Co., and the City of Fairhope. Motion carried.
It was duly moved and seconded that meeting adjourn.
