HomeMy WebLinkAbout10-26-1971 Regular MeetingSTATE OF ALABAMA COUNTY OF BA LDWI N The City Council of the City of Fairhope met in regular session at the Adult and Tourist Recreation Building on Morphy Avenue, Tuesday, October 26, 1971 at 7:30 P.M., with the fol- lowing members present: Mayor Macon, Councilmen: James P. Nix, Robert H. Cowen, H. G. Bishop, and Sam Box. Councilman John Robertson being absent. Minutes of previous regular meeting were approved. Dr. Goldsmith and Mr. Zehner of the Baldwin County Health Department met with Council requesting increase in monthly al- lotment to Health Department. Motion by Councilman Cowen se- conded by Councilman Box that City increase allotment from $70.00 to $150.00 per month to the Baldwin County Health Department. Motion carried. Motion by Councilman Nix seconded by Councilman Cowen that Ordinance No. 475, An 0 alinance Adopting the State of Alabama Highway Department Standards for Accommodating Utilities on Highway Rights of Way as Standards for use by the City for Ac- commodating Utilities on Roads and Streets under the Jurisdic- tion of the City on those Raods and Streets which have or will involve the Expenditure of State or Federal Highway Funds, be adopted as introduced at the regular meeting of October 11, 1971. Motion carried. Councilman Bishop introduced the following Ordinance: ORDINANCE NO. 476 AN ORDINANCE TO AMEND SECTION 1-8 OF THE "CODE OF ORDINANCES, CITY OF FAIRHOPE, ALABAMA". BE IT ORDAINED BY THE CITY COUNCIL of the City of Fairhope, Alabama to amend Section 1-8 of the "Code of Ordinances, City of Fairhope, Alabama" to read as follows: Whenever irthis Code or in any Ordinance of th4City an act is prohibited or is made or declared to be unlawful or an offense or a misdemeanor, or wherever in such Code or Ordinance the doing of an act is required or the failure to do any act is declared to be unlawful, and where there is a specific penalty provided there- for, the violation of any such provision of this Code or any such Ordinance shall be punishable byAt*m fine or not more than TWO HUNDRED ($200.00) DOLLARS or by imprisonment or hard labor for not more than SIX (6 MONTHS, or by both such fine and imprisonment, at the discretion of the Court. Each day that any violation of this Code or of any Ordinance of the City shall continue, shall constitute separate offense. Whenever in this Code!�or in any Ordinance of the City an act is prohibited or is made or declared to be unlawful or an of- fense or a misdemenanor, or wherever in such Oode or Ordinance the doing of an act is requited, or the failure to do any act is declared to be unlawful, where no specific penalty is provided therefor, the violation of any such provision of this Code or, any such Ordinance shall be punishable by a fine of not more than 4TWO HUNDRED ($200.00) DOLLARS or by imprisonment or hard labor for not more than SIX (6) MONTHS, or by both such fine and imprisonment, at the discretion of the Court. CITY OF FAIRHOPE As its Mayor ATTEST Ctiy Superintendent Jack Kirk reported that there will be a Waste Water Treatment School held in Fairhope from No- vember 1st:throdgh-�November S, 1971. Councilman Box was unanimously appointed to meet with Boy Scounts as representative from the City to help with their various programs. Motion by Councilman Bishop seconded by Councilman Nix that Councilman Box be appointed,Mayor Pro-tem for one year ending October, 1972. motion carried. Motion by Councilman Cowen seconded by Councilman Box that meeting dates of City Council,;meeting be changed to ori- ginal dates of the second and fourth Monday of each month. Motion carried. Motion by Councilman Bishop seconded by Councilman Box that Mayor Macon be authorized to pay interest on Water and Sewer Improvement Loan and renew note for 90 days. Motion carried.
