The City Council of the City of Fairhope met in regular
session at the Adult Tourist Recreation Center on Morphy Ave.,
Monday, September 13, 1971 at 7:30 P.M., with the following
members present: Mayor R. C. Macon, Councilmen: James P. Nix,
John A. Robertson, Robert H. Cowen and Henry G. Bishop. Council-
man Sam E. Box being absent.
Minutes of the previous regular meeting were approved.
This being the date set for public hearing on rezoning
from R-1 to B-1 Lot 12, Block 3, Oswalt Subdivision the follow-
ing residents were present in favor of rezoning: Mrs. H. West,
Mrs. A. Wahl, Mrs. J. F. Loftin and Mr. Edgar Sullivan. There
being no protests the following Ordinance was introduced by
Councilman Bishop:
ORDINANCE NO. 474
AN ORDINANCE AMENDING ORDINANCE 295, SECTION 13, DIS-
TRICT BOUNDARIES.
BE IT ORDAINED by the City Council of the City of Fair -
hope, Alabama that the following described property be re-
zoned from R-1 to B-1 as recommended by the Plannind and Zoning
Commission:
Lot 12, Block 3, Oswalt Subdivision,
siad lot being immediately South of
and adjoining the South Central Tele-
phone Building on South Section St.
This being date set for opening bids on gas and water
pipe the following bids were received:

Motion by Councilman Bishop seconded by Councilman Nix
that Purchasing Agent and General Superintendent analyze and
accept best bid for City. Motion carried.
Motion by Councilmal Bishop seconded by Councilman Nix
that the City Attorney be authorized to proceed with collec-
tion of account of Bay Hill Subdivision. motion carried.
Motion by Councilman Bishop seconded by Councilman Bishop
seconded by Councilman Nix that bills be approved for payment.
Motion carried.
Motion by Councilman Bishop seconded by Councilman Robert-
son that Clerk close out Beach and Pier Account in First Nat'l
Bank and balance of $21,057.09 be transferred to General Fund.
Motion carried.
Motion by Councilman Bishop seconded by Councilman Cowen
that $20,000.00 be transferred from Electric Fund to General
Fund. motion carried.
,P motion by Councilman Bishop seconded by Councilman Nix
yq��e that City pay $10,000.00 plus $900.00 Interest on note and
/ that the mayor be authorized to negotiate for 90 days extension
on balance of $50,000.00. motion carried.
Motion by Councilman Cowen seconded by Councilman Nix
that City crews be instructed to revamp parking lot at Stimpson
Field and construct new driveway to exit on Young Street. motion
carried.
Water for Experimental Station and gas needs for coming
year were discussed.
It was duly moved and seconded that the meeting adjourn,
motion carried.

Dear Mayor Macon:
Your letter of July 12 requesting the cooperation of our cor-
poration in sharing the cost of the recently completed street im-
provements on Oak Ave. and Church St. did not reach us in time for
attention at our last council meeting in July. Mr. Arnold was out
of state for a vacation trip until the middle of August so was de-
layed in his check on the extent and expense of the work with Mr.
Yohn, as you suggested.
He did have a report ready for our council at its first reg-
ular meeting this month, September 2 and the council authorized an
appropriation $2,500.00 and our check for that amount is herewith
enclosed.
Considering that the Colony had previously initiated and paid
for much of the construction on Church St. north of Magnolia Ave.
to Oak Ave. that benefitted Colory_land and that a large part of
the present expense there was for additional improvements of major
benefit to non participating private land owners, the councillo
:ain consideration was the additional improvements on Church St.
South of Magnolia Ave. and on Oak Ave.
It its discussion of your request that the Colony share the
cost of this improvement, the council expressed a desire to have
advance notice of like projects in the future and an opportunity
to review the p3Ans before the start of construction.
