COUNTY OF BALDWIN
The City Council of the City Of Fairhope met in regular
session at the Adult and Tourist Recreation Building on Tuesday,
August 25, 1971 at 7:30 P.M., with the following members present:
Mayor R. C. Macon, Councilmen: James P. Nix, John A. Robertson,
H. G. Bishop and Sam E. Box. Councilman Robert H. Cowen absent.
Minutes of previous regular meeting were approved.
This being date set for opening bids on Trac ur with
Backhoe, the following bids were received

Motion by Councilman Robertson seconded by Councilman
Box that low bid be accepted subject to bid meeting specifica-
tions as determined by Purchasing Agent and General Superintendent.
Motion carried.
Motion by Councilman Bishop that the following Ordinance
be introduced:
ORDINANCE NO. 470
AN ORDINANCE AMENDING SECTION 9-1 OF THE FIRE PREVENTION
CODE TO INCORPORATE AND ADOPT THE 1970 EDITION OF THE=FIRE PREVEN-
TION CODE AS RECOMMENDED BY THE AMERICAN INSURANCE ASSOCIATION.
✓BE IT ORDAINED by the City of Fairhope, Fairhope, Alabama
to amend Section 9-1 of the City Code of Ordinances entitled""Fire
Prevention Code Adopted" to read as follows:
There is hereby adopted,for the purpose of prescribing
regulations governing conditions hazardous to life and, property from
fire or explosion, that certain code known as the Fire Prevention Code
1970 Edition, recommended by the American Insurance Association, and
the whole of the said Edition thereof, save and except such portions
as may be hereinafter deleted, modified or amended,of which Code
not less than three (3) copies have been and now are filed in the
Office of the City Clerk, and,the same are hereby adopted and in-
corporated as fully as if set out at length herein.
ADOPTED this the day of , 1971
This being date set for public hearing on rezoning from
R-2 to B-1 property of J. Dudley Wade, there being no protests,
the following Ordinance was introduced by Councilman Box.
ORDINANCE NO. 471
AN ORDINANCE AMENDING SECTION 13, DISTRICT BOUNDARIES OF
ZONING ORDINANCE NO. 295.
BE IT ORDAINED by the City Council of the City of Fair -
hope, Alabama that Section 13, District Boundaries of Zoning
Ordinance 295 be amended by rezoning the following described pro-
perty from R-2 to B-1, as recommended by the Planning and Zoning
Commission.
Councilman Nix moved that all rules governing the Council
which might, unless suspended, preventuthe passage and adoption of
this Ordinance at the meeting, be and,the same are hereby suspended
for the purpose of permitting the said Ordinance -to be finally pas-
sed and adopted at this meeting. Councilman Box seconded the motion.
The question was put before the Council and on roll call the vote
was as follows: Yee: Mayor Macon, Councilmen: Nix, Robertson, Box
and Bishop. Nay.: None. Councilman Cowen being absent. Motion
adopted by unanimous vote of members present. Councilman Bishop
moved that said Ordinance No. 471 be finally passed and adopted
as introduced. Councilman Box seconded the motion. The question
of final passage and adoption of said Ordinance was put to vote of
Council and.;on roll call the results were as follows: Yea: Mayor
Macon, Councilman: Nix, Robertson, Bishop and Box..Ney: None.
Councilman Cowen being absent. Ordinance finally passed and adop-
ted.
This being date set for public hearingoon rezoning from
R11 to R-3, property of Chas. S. Davison located on East Morphy
Avenue, there being no protests the following Ordinance was intro-
duced by Councilman Robertson:
ORDINANCE NO. 472
AN ORDINANCE AMENDING SECTION 13, DISTRICT BOUNDARIES OF
ZONING ORDINANCE NO. 295.
BE IT ORDAINED by the City Council of the City of Fair -
hope, Alabama that the following described property be rezoned
from R-1 to R-3 as recommended by the Planning and Zoning Com-
mission:
The East h of NWY4 of Sec. 15, TS 6 S,
Range 2 East, less 10 feet on West and
30 feet -on North for road. Contains 4.6 A.
Councilman Nix moved that all rules governing the Council
which might, unless suspended, preventthe passage and adoption of
the Ordinance at this meeting, be and the same are hereby suspended
for the purpose of permitting the said Ordinance to be finally pas-
sed and adopted at this meeting. Councilman Box seconded the mo-
tion. The question was put before the Council and on roll call the
vote was as follows: Yea: Mayor Macon, Councilmen: Nix, Robertson,
Box and Bishop. Nay: None. Councilman Cowen being absent. Motion
adopted by unanimous vote of members present. Councilman Nix moved
that said Ordinance No 472 be finally passed and adopted as intro-
duced. Councilman Box seconded the motion. The question of final
passage and adoption of said Ordinance was put to vote of Council
and on roll call the results were as follows: Yea: Mayor Macon,
Councilmen: Nix, Robertson, Bishop and Box. Nay: None. Council-
man Cowen being absent. Ordinance finally passed and adopted.
This being date set for public hearing on rezoning pro-
perty of M. P. Dial, Jr.,in Worcester Subdivision, there being no
protests Councilman Box introduced the following Ordinance.
ORDINANCE NO. 473
AN ORDINANCE AMENDING SECTION 13, DISTRICT BOUNDARIES OF
ZONING ORDINANCE NO. 295.
BE IT ORDAINED by the City Council of the City of Fair -
hope, Alabama that section 13, District Boundaries, of Zoning Or-
dinance No. 295 be amended by rezoning the following described
property from R-2 to M-1 as recommended by the Planning and Zoning
Commission.
Lots 1,2,3,4,9,10,11 & 12, Block 4
and Lots 1,2,3,4,9,10,11 & 12, Block
5 Worcester Subdivision between Nichols
and Harlem Lane.
Councilman Robertson moved that all rules govering the
Council which might, unless suspended,prevent'the passage and
adoption of the Ordinance at this meeting, be and the same are
hereby suspended for the purpose of permitting the said Ordinance
to be finally passed and adopted at this meeting. Motion seconded
by Councilman Nix. The question was put before the Council and on
roll call the vote was as follows: Yea: Mayor Macon, Councilmen,
Nix, Robertson, Bishop and Box. Councilman Cowen being absent.
Motion adopted by unanimous vote of the members present. Coun-
cilman Robertson moved that said Ordinance No. 473 be finally pas-
sed and adopted as introduced. Councilman Nix seconded the motion.

The question of final passage and adoption of said Ordinance was
put to vote of the Council and on roll call the results were as
follows: Yea: Mayor Macon, Councilmen Nix, Robertson, Bishop and
Box. Nay: None, Councilman Cowen being absent. Ordinance No.
473 finally passed and adopted as introduced.
Motion by Councilman Robertson seconded by Councilman
Bishop that City accept proposal of Blue Cross -Blue Shield for
Major Medical subject to waiver of time limit on any pre-existing
condition. Motion carried.
Motion by Councilman Bishop seconded by Councilman Robert-
son that Ira Steele be employed as Fire Inspector at a salary.,of
as•o"
$250.00 per month,effective August 28, 1971. Motion carried.
Motion by Councilman Box seconded by Councilman Bishop tha
the Mayor and City Clerk be authorized to sign Certificate of Assur-
ance under Uniform Relocation Assistance and Real Property Acquisi-
tion Policies Act of 1970. Motion carried.
Motion by Councilman Nix seconded by Councilman Box that
bill of Ponder Co., be approved for paymeht from Airport Funds.
Motion carried.
Motion by Councilman Robertson seconded by Councilman Nix
that the meeting adjourn. Motion carried.
