HomeMy WebLinkAbout04-12-1971 Regular MeetingSTATE OF ALABAMA BALDWIN COUNTY The City Council of the City of Fairhope met in regular session at the Adult and Tourist Recreation Building on Morphy Avenue, Monday, April 12, 1971 at 7:30 P.M. with the following members present: Mauor R. C. Macon, Councilmen: James P. Nix, John A. Robertson, Robert H. Cowen, Henry G. Bishop and Sam E. Box. Minutes of the previous meeting were approved. Motion by Councilman Box seconded by Councilman Nix, that City accept agreement with Robert Berglin on sanitary sewer on Evergreen Street from Nor th Ingleside Avenue to the end of Ever- green Street. Motion carried. This being date set for public hearing on rezoning from R-1 to R-3, property of Mary Bolden off Young Street as recom- mended by the Planning and Zoning Commission, Councilman Nix moved that the following Ordinance be introduced: ORDINANCE NO. 462 AN ORDINANCE AMENDING SECTION 13, DISTRICT BOUNDARIES OF ZONING ORDINANCE NO. 29f. BE IT ORDAINED by the City Council of the City of Fairhope that Section 13, District Boundaries Zoning Ordinance No. 295.be amended by rezoning from R-1 to R-3 the following described pro- perty as recommended by the Planning and Zoning Commission: Commence at the Northeast Corner of the Southeast Quarter of the Northwest Quarter of Section 20, Township 6 South; Range 2 East, run S 00 deg. 02' E, Along N-S half section line 1023.6 feet to a point in line with the Nor th fence of Mitchell Crue property; thence run N 89 deg. 56'W, 118.4 feet to a point in Crue's north fence line; thence run N 00 deg. 45' W, 115 feet to the Northwest corner of Eugene Bosby's lot; thence run N 74 deg. 27' W, 71.9 feet to the point of beginning; thence run N 63 deg. 39' W, 153.7 feet; thence run S 25 deg. 33' W, 73 feet, to the Northwest Corner of W. W. Thompson's lot; thence run S 60 deg. 50' E, 161.7 feet, to said Thompson's northeast corner; thence run N 20 deg. E, 80.6 feet to the point of beginning; containing 0.278 acres, bounded on the North by a 12 foot lane, on the West by a 20 foot lane, on the South by lands of W. W. Thompson, on the East by lands of Louise Wilson and Eugene Bosby, in Section 20, Township 6 South, Range 2 East. Motion by Councilman Bishop seconded by Councilman Cowen that Mrs. Moore, City Clerk, be authorized to pay land rent due Fairhope Single Tax Corporation and Library and Stimpson Field leasehold, and that Mayor Macon be authorized to negotiate a new lease on the Library property for one year. Upon being put to vote the following vote was recorded: For: Councimen: Bishop, Box, Nix and Cowen. Against: Councilman Robertson. Motion carried. The following bids were received on two loads of 6" Cast Iron Pipe: Davis meter Supply Co. Thomasville, Ga. $2.09 per Ft. United States Pipe & Foundry Co. Birmingham, Alabama $2.18 per Ft. Moore -Handley, Inc. $2.09 per Ft. Mobile, Alabama American Cast Iron Pipe Co. Birmingham, Alabama $2.05 per Ft. McWane Cast Iron Pipe Co. $2.16 per Ft. Birmingham, Alabama Motion by Councilman Box seconded by Councilman Nix that City accept low bid of American Cast Iron Pipe Co., for a 12 month period provided bid meets specification as per Mr. Ruge and Mr. Kirk. Upon being put to vote the following vote was re- corded: For: Councilman: Box, Bishop, Nix and Robertson. Nay: None, Councilman Cowen abstained from voting. Motion carried. Letter from Byrd L. Moore was discussed and taken under advisement until next regular meeting of City Council. Motion by Councilman Robertson seconded by Councilman Bishop that Mayor and City Clerk be authorized to cash Street Improvement Savings Certificates in necessary amount to pay Moore Engineering Company and Contractor's Estimate No. 2 on 1970 Street Improvement. Motion carried. Motion by Councilman Cowen that the following Ordinance be introduced: ORDINANCE NO. 463 AN ORDINANCE AMENDING SECTION 13, DISTRICT BOUNDARIES ZONING ORDINANCE NO. 295. BE IT ORDAINED by the City Council of the City of Fairhope, Alabama that Section 13, District Boundaries, of Zoning Ordinance No. 295 be amended by rezoning the following described property from R-2 to B-1 as recommended by the Planning and Zoning Com- mission: Beginning at the NW corner of the NW4 of the NE4 Sec. 20-6-2, run North 300 feet; thence East 300 feet; thence South 300 feet; thence West 300 feet to point of beginning. Property is on the Northeast corner of Nichols and Young Streets. Mr. Harmon and Mr. Williams of Harmon, White and Assoc., Inc., presented their preliminary investigation of Gas system as to safety regulations set by the United States Department of Transportation and -6dministered by Alabama Public Service Commission. Motion by Councilman Bishop seconded by Councilman Box that $5,000.00 be transferred from Gas Gross Revenue Account to the Water and Sewer Account. Motion carried. Motion by Councilman Bishop seconded by Councilman Cowen that bills be approved for payment. motion carried. Motion by Councilman Bishop seconded by Councilman Robert- son that $21,000.00 note plus interest be paid from Gas Gross Revenue Account. motion carried. Council requested that Mr. George Dyson write letters to owners of vacant lots stating that lots must be cleaned. It was duly moved and seconded that the meeting adjourn. Motion carried.
