County of Baldwin
The Town Council of the Town of Fairhope met in regular
session at the Town Hall Tuesday, June 8, 1948 with the
following members present: Mayor, Howard Ruge, Council-
men: J.H. Bennett, C. A. Gaston, H. P. Kamper, W.O. Keeble
and J. 0. Stimpson.
The minutes of the previous regular meeting were read and
approved.

Councilman Gaston offered Ordinance #183 and moved.its
adoption, such motion having been seconded by Council-
man Bennett. Upon roll call, Mayor Ruge, Councilmen
Bennett, Gaston, Kamper, Keeble and Stimpson voted ajte,
voting no, None, Whereupon the Mayor declared the
Ordinance duly adopted and signed the same in approval
thereof.
Councilman Bennett offered Ordinance #184 and moved its
adoption such motion having been deconded by Councilman
Kamper. Upon roll call Mayor Ruge, Councilmen: Bennett,
Gaston, Kamper, Keeble & Stimpson voted Aye, Voting No,
None thereupon the Mayor declared the Ordinance duly adopted
and signed the same in approval thereof.
Motion by Councilman Bennett seconded by Councilman Gaston
that the Mayor be authorized to purchase for the Town the
Albert Reynolds wharf at foot of Pecan Street for $200.
Motion carried.
Motion by Councilman Gaston seconded by Councilman Stimp-
son that the application of Am. Matejka for permit to
build Garage 15 ft. from Nichols St., his residence now being
less than 10 ft. from such street, be approved. Motion
carried.
It was duly moved and seconded that the meeting adjourn.

Councilman Stimpson moved the adoption of the following
resolution seconded by Councilman H. P. Kamper.
WHEREAS, the American Legion desires to build a
wharf from the Beach in front of their property in Block 7,
Magnolia Beach Addition and such Beach is shown as Park on
the Town Map and,*
WHEREAS, it is not the purpose of the American Legion
to deny the entry of the public to the Beach of wharf,
Therefore, be it resolved that an easement be granted
for the use of the said beach and a permit given for the
erection of the wharf as per plan presented, such easement
to run at the will of the Town Council.
Motion by Councilman Gaston seconded by Councilman J.O.
Stimpson that the application of H. G. McKean to add to
present building on Lot 1, Block 6, Division 4 be allowed.
Motion carried.
Motion by Councilman Kamper seconded by Councilman Keeble
that the application of Baldwin -Niemeyer to add roof to
shed at South end of Western Auto Store building be
allowed. Motion carried.
Motion by Councilman Gaston seconded by Councilman
Stimpson that the application of Tiers. Ruth Hand for Beer
Permit at Mary Ann Cafe be allowed. Motion carried.
Motion by Councilman Keeble seconded by Councilman
Bennett that ,the Mayor be authorized to revest the
Fairhope Single Tax Colony the title to the partion of
Park land -on South Side of Fairhope Avenue opposite Knoll
Park described as follows:
From the Point of Intersection of the Center -lines
of Fairhope Avenue and Bay View Street run South 89 degrees
58 minutes West along the projected Center -line of
Fairhope Ave. 197.2 ft. to a point, thence run South no
degrees 2 minutes East 35.7 ft. to a point on the South
boundary of Fairhope Ave., for a point of beginning:
thence run South no degrees 2'minutes East 26 feet to
the north side of Stacks Gully; thence run Westerly fol-
lowing the meanderings of said Gully to a point South
89 degrees 58 minutes West 292•55 ft. and South 17 degrees
42 minutes West 60.4 feet from the Point of Intersection
of the Center -lines of Fairhope Ave. and Bay View St.;
thence run North 17 degrees 42 minutes East 45.4 ft. to a
point on the South boundary of Fairhope Ave.; then run
Easterly along the South margin of Fairhope Avenue to
the point ,of beginning, Frac'1 Section 18, Township 6
South, Range 2 East, Baldwin County, Alabama. -\
Councilman Gaston not Voting. Motion carried.
It was duly moved and seconded that the meeting adjourn.
