September16,2024BoardofAdjustmentsMinutesRachelBall,210S.MobileStreet,Apt.28,sharedherexperienceinhighschoolwherestudentswereabletoleavecampustopurchasevapes.Ms.Ballbelievesthatthistypeofbusinessshouldnotbelocatednearahighschool.Thepublichearingwasclosedat5:18pm.CathySlagleaskedabouttheagelimitstoenterthestore.Mr.AmlehstatedthatIDswillbescannedatthestoreandarenotpermittedinthestoreifunder21.Mr.Flowersaskedifaprecedentwouldbesetiftheboarddeniedthiseventhoughgasstationsandconveniencestoressellthesetypesofproducts.Mr.Simmonsstatedthatstafflookedatwhatwasbeingsoldforthiscaseandnotedthatmanyothertypesofstoressellthesetypesofproducts.Theprecedentwouldbewhywouldthecigarshopdowntownbeallowed,butthiscasenotbeapproved.Mr.Flowersaskedaboutthecurrentbusinessesintheplazaandiftheywereconcernedwhetherthiscase,ifapproved,wouldaffecttheirbusiness.Mr.Simmonsstatedthatthestaffhasnotreceivedanycomplaintsfromnearbypropertyowners.Motion:RyanBakermadeamotiontoapproveBOA24.12.CathySlaglesecondedthemotionandthemotioncarriedwiththefollowingvote:Aye:AnilVira,CathySlagle,RyanBaker,FrankLamia,andBryanFlowersNay:NoneBOA24.13PublichearingtoconsidertherequestoftheOwners,JamesandHeatherDeLapp,forabuildingheightvariance,anaccessorystructuretobebuiltforwardoftheprincipalstructureandavariancetoretainingwallheightof4’or8’basedonplacementofprimaryhomeonpropertyzonedR-1—LowDensitySingle-FamilyResidentialDistrict.Thepropertyislocatedat23335MainStreetandisapproximately0.82acres.PPIN#:265003Mr.Bakerstatedthatheneedstorecusehimselfduetohimbeingthearchitectforthenext-doorneighbor.HunterSimmons,PlanningandZoningDirector,presentedtherequestoftheOwners,JamesandHeatherDeLapp,forabuildingheightvariance,anaccessorystructuretobebuiltforwardoftheprincipalstructureandavariancetoretainingwallheightof4’or8’basedonplacementofprimaryhomeonpropertyzonedR-1—LowDensitySingle-FamilyResidentialDistrict.Mr.Simmonssharedthezoningandaerialmapsalongwiththeexistingandproposedsiteplans.Mr.Simmonssharedtheelevationsforthelotandexplainedhowbuildingheightisdetermined.StaffsupportstherequesttomeasureFROMthenaturalelevationofthebuildingfootprintvariance.Mr.Simmonsstatedthatstaffdoesnotsupporttheheightfortheretainingwall,duetomuchofthewallsbeingabovethe4’heightlimitallowedinfrontofabuilding.Thisrequestincludesclosetoa20’retainingwall.Mr.Simmonssharedthediagramfortheaccessorystructurerequestandsharedthatiftheaccessorystructurewasattachedtothehouse,therewouldbenoneedtorequestavariance.2 September16,2024BoardofAdjustmentsMinutesRecommendation:1.Staffrecommendsapprovalforthebuildingheight.2.Staffrecommendsdenialfortheheightvariancefortheretainingwall.3.Staffrecommendsapprovalforthelocationoftheaccessorystructure.Ms.Slagleaskedaboutthepropertywiththeveryhighfence.Mr.Simmonsstatedthatistheneighbor’sfence.Ms.Slaglenotedthatthiscase’spropertyhasaverybigdip.Mr.Simmonsacknowledgedthatfact.Discussioncontinuedaboutaccesstothepropertiesinthissubdivision.Mr.Lamiaaskediftherewerewetlandsontheproperty.Mr.Simmonsstatedthattherewerenowetlandsthatheknewof.Ms.SlagleaskedaboutaletterreceivedfromacitizenaboutstairsthatwerebuiltbyMr.DeLappandwhethertherewasapermitforthatconstruction.Mr.Simmonsstatedthathewouldlookintothat.Mr.SimmonssharedaviewofthepropertyfromtheBaldwinCountyParcelViewerfortheboardtoseethestairsandboardwalk.JimDeLapp,492BoulderCreek,statedthathewouldansweranyquestions.Mr.Lamiaaskedwhatthesquarefootageofthehousewouldbe.Mr.DeLappstatedapproximately4,500squarefeet.Mr.DeLappsharedthatthesiteisachallengingsite,andthecostofconstructionisveryhighrightnow.Mr.DeLappcontinuedthattheretainingwallisalsoaconstructionwallforthehouseandalandscapingwall.Discussioncontinuedonaccesstothepropertyandratherthanputtingthehouseonstilts,Mr.DeLappischoosingtonestlehishouseintotheterrainofthepropertyusingthevariousheightsof12’,15’and17’fortheretainingwall.Mr.Lamiaaskedifthisprojectcouldbedonewithoutanyvariancerequests.Mr.DeLappstatedyesbuttheelevationonthepropertywouldrequireaheightvariance.Mr.Lamiaaskedif,asidefromtheheightvariance,ifanyattemptshadbeenmadeforthegarageandretainingwalltobebuiltwithoutrequestingvariances.Mr.DeLappstatedthatduetohalfofthehousebeingundergrade,agaragecouldnotbebuiltunderthehouse.Hetriedtogetitasclosetothehouseaspossibleandthatportionsoftheretainingwallisafoundationwall.Mr.DeLappcontinuedthatitwouldbeagreatexpensetochangethelocationofthegarage.Mr.Simmonsstatedthata17’retainingwallthatisvisiblefromthestreetandnotpartofthehouseisagainstregulations.Mr.DeLappstatedthattheonlyotherhousebuiltinthesubdivisionrightnowalsohasanapproximately20’highblockretainingwallthatholdshishouseup.Mr.Lamiaaskedifthegaragewasincorporatedintothehouse,wouldavariancebeneeded.Mr.SimmonsstatednoandsharedsomediscussionsthatwerehadwithMr.DeLapponvariationsthatcouldbemadetothehousewherevarianceswouldnotberequired.Mr.Viraaskedwhatelsecouldbedoneabouttheheightoftheretainingwall.Mr.Simmonsstatedthatthewallcanonlybe4’infrontofthehouseandanythingover30”musthaveprotectionsoyoudon’tfalloff.Mr.Simmonssuggestedterracingthewall.Mr.DeLappstatedthatfollowingthenaturalterrainisachallengewithoutaretainingwall.Mr.Lamiaaskedhowlonghehasownedtheproperty.Mr.DeLappstated2V2to3years.Mr.Viraaskediftheretainingwallwasterraced,wouldhestillneedavariance.Mr.Simmonsstatedthatpartofthewallcouldbeterracedbutstaffneverreceivedrevisedplans.Mr.Flowersaskedifthiscasecouldbetableduntilrevisedplansarereceived.Mr.DeLappstatedthatterracingthefoundationwallisnotfeasiblebecauseitwouldnotfit.Mr.Lamiastatedthattheboardshouldlookathardships.ThegarageorcarportisachoiceandaskedMr.DeLappwherethehardshipis.Thedesignofthecarportandretainingwallisachoice.Mr.DeLapprepliedthatonpage38of40showsthefrontelevationofthehouseandfittingacarportontheleftorrightdoesn’tfitduetothenarrownessandtaperingofthelot.Mr.Simmonsstatedthatheacknowledgesthelotisverysteep,butitisachoicetohavea4,500squarefoothouse.Mr.SimmonsaddedthathewouldliketoseesomevariationsinthehousedesignandifMr.DeLapp3 September16,2024BoardofAdjustmentsMinutesisnotinahurry,tablingitwouldallowstafftoreviewrevisedplans.Mr.DeLappstatedthathewouldliketobeginconstructionassoonaspossible.Mr.ViraaskedMr.DeLappifhewouldbeopentotablinghiscaseandprovidingstaffwithrevisionsbasedonthediscussions.Mr.DeLappaskedagainwhattypeofrevisionstheyarerequesting.Mr.Virastatedtheterracinganddesignonthehouse.Mr.DeLappstatedthathecouldprovidearevisionthatincludesterracingthewall.Mr.ViraaskedifthepeoplewhowrotethelettersarepartoftheHOA.Mr.DeLappwasnotawareoftheletters.Ms.BeaudreauprovidedtheletterstoMr.DeLapp,andhestatedthatnoneoftheindividualswhowrotethelettersarepartoftheHOA.Mr.LamiareiteratedthatMr.DeLappmustshowahardshipinorderforhisvariancestobegranted.Mr.DeLappstatedthatintegratingagarageintothehousewouldcreatealargerhouse.Mr.Simmonsaskedhowthatwouldcreatealargerhouse.Mr.DeLappstatedthatwhenlookingatthefrontelevationifheattachedatwo-cargarage,itwouldtakeuptheentirefrontelevationandhewouldhavetoenterthehousethroughthegarage.Mr.Flowersstatedthathebelievesthecaseshouldbetabledsostaffcanreviewanewdesign.Mr.DeLappstatedthathewouldagreetotableittoprovideanewdesign.Ms.SlaglestatedthatMr.DeLappiscreatinghisownhardshipwiththesizeofthehousebecauseheboughtthepropertyknowingthetopography.Mr.DeLappstatedthatthesubdivisionrequiresthatthehousemustbe2,500—2,800squarefeet.Themainlevelis2,500andtuckedintothehillsidewithaveryexpensiveconcretewalland2,000squarefeetisbelowgrade.Mr.Lamiaaskedforsomesketcheswiththegarageattachedtothehouseandtheterracedretainingwallthatshowswhyitwouldnotwork.Mr.Virasuggestedaddingplantingsorvinestotheretainingwalltosoftenit.ChairmanViraopenedthepublichearingat6:41pm.AmyThompson,108AlswayCourt,wasinterestedinthispropertyinthepast.Ms.Thompsonstatedthatsheandherhusbandrealizedthatthepropertywouldbeaconstructionnightmare.Sheisconcernedwithfillinginthenaturalgulleyandravine.Sheaskedtheboardtobemindfultofollowthecodesandtodenythevariances.DonDeGutz,110BlakeneyAvenue,drovetothepropertyandnoticedthenewfenceandaskedthePlanningDepartmenttoinvestigateiftherewereanycodeviolationsforthisfence.Mr.DeGutzaskedifthestepsalongtheboardwalkwillbeinvestigatedforcodeviolationsalso.Mr.Simmonsagreedtoinvestigatetheseissues.Mr.DeGutzaskediftheletterswouldbereadintotherecord.Mr.DeGutzaddedthatthesizeofthehouseshouldnotbequestioned.Mr.Simmonsstatedthatitisanappropriatequestiontoaskbecauseifthehousefit,therewouldbenoneedforavariance.Mr.Simmonsstatedthattheletterswouldbeaddedtotheagendapacketandreposted.Mr.DeLappstatedthatthissubdivisionwascreatedin2006,sixlotswerecreated.Mr.DeLappaddedthathewasthefirstpersontopurchasehislot.Thepublichearingwasclosedat6:52pm.Ms.SlagleaskediftheycouldapprovethebuildingheightatthismeetingthenheartheotherrequestsattheOctobermeeting.Mr.DeLappstatedthathewouldlikethatsothatifhecanfindsolutionstothegarageandretainingwallthatwouldnotrequirevariances,hewouldnotneedtocomebacktotheOctobermeeting.Mr.SimmonsstatedthathewouldpreferthattheboardreviewallofthevariancesagainincaseMr.DeLapp’snewdesignchangesthebuildingheight.4
