A STATE OF ALABAMA County of Baldwin The Water and Sewer Board of the City of Fa4rhope met in regular session at the City Hall, Wednesday, May II, 1960, with the following members presents Chairman A 1- C . Menn i ch, R. Roy Moyers, R. R. Teamer, C . B. Niemeyer, George Dyson and Frank Wiggins. Residents from across the gu l I ey in Magnolia Beach area requested the Board to run 2" water line to their property. The Board agreed to run the line providing the property owners paid for pipe, approximate cost $1,959.00/ The minutes of the previous regular meeting were read and approved. Motion by Mr. Teamer seconded by Mr. Moyers that the following bills be approved for payment: Motion carried. Western Lumber and'Supply &60 Maury Ins. BE IT RESOLVED BY THE WATER AND SEWER BOARD OF THE CITY OF FAIRHOPE, ALA. that the Merchants Nat i onaI Bank of Mob i I e as Trustee for Water and Sewer Board 4 3N&. Second; Series Bonds, be authorized to pay, when presented for payment $1:0,000.00 pri nc i pal amount Second -Series Bonds, due 1986, on a 106.50 basis to first calf date of July I, 1,963, plus accrued interest. BE IT FURTHER RESOLVED that #10,474.00 plus accrued' interest on deposit in the surplus Fund be applied toward, the redemption of the bonds and the balance of $176.00 that will be due be paid from the Water and Sewer Revenue Account. Motion by Mr. Moyers. seconded by Mr. Teamer that the Board pay expenses for George Dyson and Frank Wiggins to attend Waterworks School at Auburn on June 6,7 & 8. Motion carried. Motion by Mr. Moyers seconded by Mr. Teamer that George Dyson be authorized to extend sewer tine on Lot 19, Block 15, Volanta Subdivision. Niemeyer City Manager City of Fairhope Fairhope, Alabama Dear Brad: We are pleased to advise that we have firm in hand $10,000 City of Fairhope Water and Sewer Second Series 4 3/47o Bonds due 1986 which can be purchased at 106.50 plus accrued interest. The Indenture restricts the redemption price of bonds to less than 104.75 prior to the date that all bonds are callable from funds from any source. Accordingly, if the bonds were purchased at 106.50, the maxi— r,qum that toe Board could use out of the surplus fund would be ($10,474._QO-plus accrued interest. The difference, therefore, would"b $176.00'-,which would have to be provided from some other source. If this is acceptable, please advise and we will have the owner of the bonds send them directly to The Merchants National Bank for payment. By copy of this letter forwarded to Watkins, Morrow and Company of Birmingham we are also bringing it to their attention. You will of course recall that the provisions of Article V111, Section 8.4 (2) specify that the purchase price shall be less than the redemption price at 104 3/4. You may be sure that we will be pleased to cooperate in every way we can should it be found feasible to purchase bonds at this time.
