City of Fairhope met in regular session at the City Hall, Wednesday, September 12, 1953 with the following members present: Chairman R. Roy Moyers, City Man- ager C. B. Niemeyer, A. C. Mannich and L. A. Berglin, Sr. The minutes of the previous regular meeting were read and approved as read. Motion by Mr. Mannich seconded by Mr. Berglin that the following bills be approved for payment: Western Auto Associate Store $ 9.00 Ponder Company 2.10 Wittichen Chemical Company 34.50 W. S. Dickey Clay Manufacturing Co. 31.50 Chicago Pump Company, Inc. 102.31 M & S Service Station 9.01 Green's Service Station 1.15 Standard Equipment Company 24.60 Gaston Motor Company, Inc. 3.75 Turner Supply Company 6.06 Carl L. Bloxham Agency 191.00 0. Forster and Sons 20.00 Gas Department 281.84 Motion by Mr. Mannich seconded by Mr. Berglin that Mr. Niemeyer be authorized to secure the services of Smith, Dukes, and Buckalew to make the annual audit. Motion carried. Iotion by Mr. Mannich seconded by Mr. Berglin that the Water nd Sewer Board enter into contract with Hugh Morrow, Jr. of atkins, Morrow and Company for the purchase of $,801000 Second Lien dater and Sewer Revenue Bonds, Mo-rio/v Cann/tb, It was duly moved and seconded that the meeting adjourn. Motion carried. All resolutions and indentures of trust that may be necessary in order to legally authorize, issue and sell said Revenue Bonds. 2. To furnish the approving legal opinion of Messrs. i,,hite, Bradley, Arant, All & Rose as to the legality of the issue. 3. To furnish printed bond blaLks read y for execution. 4. To pay for all legal advertising and to pay any Trustee acceptance fees. 5. To reco-mmend maturity schedules and appropriate redemption provisions. For our services and expenses, you are to pay us the sum of 5% of the principal amount of the securities issued. In the event that you wish to sell us the bonds to be issued, we agree that we will maze a legal bid for them. This agreement is to remain in effect for a period of five years or until this firm is no longer in business, whichever is shorter.
