The Water and Sewer Board of the City of Fairhope met in
Regular session at the City Hall, Wednesday, December 10,
1952 with the following members present: Chairman R. Roy
Moyers, L. A. Berglin, Sr., Arthur Mannich, City Manager
C. B. Niemeyer.
The minutes of the previous regular meeting were read and
approved as read.
Motion by Mr. Berglin seconded

by Mr. Mannich that the

Motion by Mr. Berglin seconded by Mr. Mannich that the
Water and Sewer Board discontinue sewer extensions at the
present time but continue to make all necessary water
extensions within reason. Motion carried.
Motion by Mr. Mannich seconded by Mr. Berglin that the follow-
ing Resolution be adopted. Motion carried.
BE IT RESOLVED by the Water and Sewer Board that all
bills for water and sewer owing to the Board shall be due on
the first day of each calendar month, and delinquent unless
paid on or before the loth day of each calendar month and
unles.s paid on or before delinquency there shall be added to
and collected as a part of such bills and to defray the
additional cost to the City resulting from such delinquency
an additional sum of 10% of the amount of such bill, but not
less than 500 for each delinquent bill, provided however, such
penalty may be waived by the Clerk when it is shown to the
Clerk's satiifaction that the person owing such bill did not
receive the same within$ three days before the delinquency
date herein provided or, when it is shown to the Clerk's
satisfaction that such delinquent account has not theretofore
been delinquent within the six month period immediately prior
thereto, or where the remittance for such bill was mailed to
the City and post mark shows the same to have been mailed on
or before the delinquency date.
This Resolution shall apply to bills for services rendered
subsequent to the November 1952 meter readings.
BE IT FURTHER RESOLVED that all bills more than 30 days
delinquent shall bear interest at the rate of 6% per annum,
which shall be collected in addition to the amount of the
bill -and the penalty.
BE IT FURTHER RESOLVED that services shall be discontinued
to any person whose bill shall not have been paid on or before
the 15th day of the month, provided the City Clerk may at her
discretion waive such discontinuance for any cause provided
hereof for the waiver of the penalty and provided when the
City Clerk deems it proper such delinquency may be presented
to the Board for directions before services are discontinued,
but such failure to discontinue services shall be reported to
the next meeting of the Water and Sewer Board.
It was duly moved and seconded that the meetin adjourn.
