HomeMy WebLinkAbout05-14-1952 Regular Meeting-:- STATE OFALABAMA County of Baldwin The Water and Sewer Board of the City of Fairhope met in regular session at the City Hall, Wednesday, Mayl4, 1952 with the following members present: City Manager C. B. Niemeyer, Chairman R. Roy Moyers, L. A. Berglin, Sr.,and Arthur Mannich. The minutes of the previous regular meeting were read and approved as read. Motion by Mr. Berglin seconded by Mr. Mannich that the following bills be approved for payment: Fairhope Hardware and Supply 3.60 Wittichen Chemical Company 17.63 Davis Meter Repair 13.50 Nick J. Ludwig 6.65 Gaston Motor Company 1.54 Standard Equipment Company 150.96 Simmons Feed and Seed 8.00 0. Forster and Sons 30.80 Weekly Pay Roll 742.87 George Dyson 165.00 Motion by Mr. Berglin seconded by Mr. Mannich that the water line on Delmar Street be extended from Delmar north to rear of business building in center of block between Fairhope Avenue and Church Street. Motion carried. Motion by Mr. Mannich seconded by Mr. Berglin that Mr. J. E. Wooley and Mrs Sam Dyson be granted permission to connect to City water line and extend 2" line 515 ' South on Highway 89. The Chairman of the Water and Sewer Board be authorized to enter into an agreement with Mr. Wooley and Mr. Dyson concerning the above line. Motion carried. Motion by Mr. Berglin,:seconded by Mr. Mannich that the following Resolution be adopted: WHEREAS, it appearing that this Waterworks Board of the City of Fairhope, Alabama is without the funds to pay to Layne Central Company the cost of the construction of a deep well and installation of pump and accessories in connect- ion therewith under contract dated November 14, 1951, and to pay to Donald Mills, consulting engineer, the amount of its contract with him, and is without the funds to pay to M. Dyson the cost of construction of pump house in connection with the said well and pump, under contract between the Waterworks Board and the said IM-. Dyson heretofore entered into, and this Waterworks Board having proposed to the City of Fairhope that it transfer and assign,the contract between it and the said Layne Central Company, and its contract with the said Donald Mills, consulting engineer, and its contract with the said M. Dyson, and as well its right, title and interest in and to the said deep well and pump and pump house constructed under the said contracts, and that this Waterworks Board lease the said deep well, pump and pump house from the City of Fairhope for a period of five years commencing May 10, 1952 and ending May 10, 1957, for and at the sum of $5,000.00'cash in advance, under the terms of the said lease the Waterworks Board would operate and maintain the said deep well, pump and pump house and keep the same in a good state of repair and not commit or permit waste to be committed thereon and return the well, pump and pump house in as good condition as the same is when com- pleted, reasonable wear and tear excepted, and the City of Fairhope has agreed to accept such transfer and assignment of the said contracts and. properties involved thereby and to pay the entire amounts payable thereunder by this Waterworks Board and to hold the Waterworks board free from liability and loss thereon and to make such lease of the said properties to this Waterworks Board under the aforesaid terms and conditions; e NOW THEREFORE, BE IT RESOLVED, that R. Roy Moyers as chairman of this Waterworks Board be and he is hereby authorized, directed and required to transfer and assign to the City of Fairhope the contracts of this Waterworks Board with Layne Central Company, dated November 14, 1951, this Waterworks Board's contract with Donald ":ills, consulting engineer, and this Watorworks Board's contract with M. Dyson, and as well, the properties installed and constructed there- under, and to enter into lease agreement with theCi.ty of Fairhope for the lease and use of the said properties by this Waterworks Board for the time and under the conditions and at the rentals hereinabove specified.
