County of Baldwin
The Waterworks and Sewer Board met in regular session at
the Citk.. Hall on June 20, 1951 with the following members
present: Chairman R. Roy Moyers, L. A. Berglin, Sr., Arthur
Mannich, Marie Moore and City Superintendent C. B. Niemeyer.
The minutes of the previous regular meeting were read and
approved.
On motion by Mr. Mannich seconded by Mr. Berglin the follow-
ing bills were approved for payment:

Motio n by Mr. Berglin seconded by Mr. Mannich that the
Water and Sewer Fund increase their monthly payment to
the General Fund for Clerical services to $200.00.
Motion carried.
Motion by Mr. Mannich seconded by Mr. Berglin that George
Dyson's salary be increased 10%. Motion carried.
Motion by Mr. Berglin seconded by Mr*. Mannich that Mr.
Donald Mills be authorized to secure bids on cleaning out
and testing old well located on the beach. Motion carried.
It was duly moved and seconded that the meeting adjourn.

CONTRACT
THIS AGREFI�F NT made between DONALD MILLS, Consulting Engineer,
Selma, Alabama, Engineer, and the WATER WORKS BOARD, Town of
Fairhope, Alabama, Client, witnesseth that whereas the Client wishes
to construct Water Works Improvements hereinafter referred to as
'tthe project", and not having engaged other Engineers for the work,
wishes to engage the services of the Engineer in connection there-
with, the parties hereto agree as follows:
1. THE ENGINEER
(a) will make the necessary tidies, investigations and
preliminary surveys of the proposed improvements
and prepare an engineering report and preliminary
estimate of cost.
(b) will then confer with the Client regarding the
recommended improvements and will make such changes
and additions as are requested.
(c) after the Client has arranged the necessary financing
for the project, will prepare complete construction
plans, specificiations and contract documents cover-
ing the improvements decided upon and will furnish
-the client with one set bearing the approval of the
State Department of Health or other authority involved.
(d) will assist the Client in obtaining bids by circular-
izing contractors, reporting agencies and material
manufacturers in order to give the proposed construct-
ion wide publicity and thus ensure keen competition
and lower prices. He will furnish prospective
bidders with copies of the plans, specifications and
bidding documents and will be present at the bid
opening to read, tabulate and check the proposals and
to recommend contract awards.
(e) will furnish the necessary supervision during the con-
struction period and will prepare periodical estimates
of the value of the work performed and a final estimate
upon the completion of the project.
2. THE CLIENT will pay the engineer for his services in the
following manner:
(a) The sum of t100.00 upon receipt of the report and
estimate set forth in 1 (a).
(b) An amount equal to 4% of the contract price, less
the preliminary paymenti at the time the contract is
awarded, or 412% of the estimated cost, less the pre-
liminary payment, when the plans and specifications
are delivered, if the work is to be performed by day
labor.

(c) An amount equal to 3% of the cost of the completed
work, payment to be made monthly and to be based
on the cost of the work completed each month.
3. (a) In the event that the report made by the Engineer shall
result in supplying owners water needs without the
construction of new facilities, it is agreed that the
total fee to be paid for the services of the Engineer
will be the percentage of the costs thereof as herein
provided but not less than $ _
(b) It is understood and agreed that the Owner will supply
the Engineer with all available data on the existing
wells, including the chemical analyses of the water,
or will obtain such analyses for him.
IN TESTIMONY Or 1,1HIC Ii the Engineer has signed this agreement and
the Client, by an appropriate resolution, moved, seconded and
adopted at a legally authorized meeting of its governing body held
on the, day of , 1951, has authorized this agree-
ment to be executed by it Chairman and attested by its Secretary
for and on its behalf.
