FAIRHOPE PMT, AND RECREATTON BOARD
Minutes for the meeting of June 14, 1978
The Fairhope Park and Recreation Board met in regular session Wednesday,
June 14, 1978 at the City Administration Building, 387 Fairhope Avenue,
Fairhope, Alabama.. Chairman Barney Shull presided. Board Mambers, Billy
Wiggins and Stephanie Montgomery were present. Acting Program Director,
,doe Dean and Facilities Director, Phil Rutherford were also present.
The minutes of the May 10, 1978 meeting were read and approved as
recorded, All bills were approved for payment with the exception of Eastern
Shore Sporting Goods.
Guests, Henry Aaseeb, Alfred Bosby and Clarence Bosby were present to
represent the Community Minded People of Young Street Recreation Center.
They wanted a job description for Cato Jackson and Kerry Hunt. They reported
that the building was in bad shape as well as the playground equipment. The
Board explained that each year the facilities have been put in good shape
and then the kids tear it up. A.committee of parents will patrol this area
to try to keep down vandalism. Phil Rutherford is going down Thursday
morning to check on the palyground equipment. Paint was given to the committee
by Phil Rutherford to pain the trash cans and equipment. The Recreation Board
agreed to attend the Community 11inded People's meeting to help them with their
projects
Joe Dean recommended that the tennis and basketball courts be resurfaced.
Ib action was taken at this time. Joe Dean proposed that two basketball goals
be purchased for Young. Street at a cost of $115.00 each. Motion Made by
Barney Shull, seconded by Stephanie Montgomery. Motion carried.
Joe Dean present the Board with the following report on the summer programs:

A letter of resignation from the Young Street Craft Program Director
was received from Jean Smith.
Billy Wiggins submitted to the Board a letter from John Duck on the
job description of Howard Thelkeld, Tennis Pro. (see Attached copy) Mr.
Shull is going to consult with Ix. Duck on this matter.
Billy Wiggins commended Barney Shull for his presentation of the Stimpson
Field Project to the City Cduncil.
On a motion duly made. seconded and carried, the meeting adjourned.

RE: Recreation Board
Tennis Courts
Gentlemen:
Pursuant to your request, I have examined the laws of the
State of Alabama as to the use of tennis courts and other
facilities of a recreational board in a municipality.
There is no statutory law in the 1975 Code of Alabama
concerning the operation of the tennis courts, golf courses,
or other particular facits of a recreation board where
the recreation board is an appointed board and not set up
under a separate corporation as authorized by the Board.
Further, there are no particular cases cited as to the
operation of any particular facit of an appointed recreation
board.
However, we contacted the Counsel for the League of Munici-
palities in Montgomery, Alabama and he states to us that
the usual procedure is as follows:
1. That if a professional is hired by a recreation
board, and he is paid a salary by that recreation board, and
he gives private lessons and the fees for these private lessons
are turned over to the recreation board, then, in that event,
he shall have the right to make appointments and, generally,
to run the particular facility that he is hired for at his
discretion, but to the good of the municipality as a whole.
2. If the professional is not hired by the recreation
board and he is not paid a salary, and he gives private
lessons and pockets the money, then, and in that event, he
does not have the authority to control the facility that he
is operating for the recreation board and any and all citizens
have the right to use the facility at their convenience and
without any prior appointment, nor do they have to go through
the professional to play at the particular facility.

Since our Recreation Board is an appointed board by the
City of Fairhope and does not operate under a separate
corporation, it is my considered opinion that if the
professional pockets the money for fees he gets for private
lessons, then, and in that event, he can not control the
facility and all of the citizens of Fairhope shall have
equal right to_ use the same.
