Motion by Mr. Burton, seconded by Dr. Johnson that minutes be approved as corrected: "Coach Majors -announced he had ordered fill-in sets of Babe Ruth And Connie Mack Uniforms." motion carried. Motion by Dr. Johnson, seconded by Mr. Chatwood that the bills be approved as listed. Motion carried. Motion by Mr. Burton, seconded by Mr. Chatwood that the City electrical superintendent be instructed to secure twelve elec- tric poles for installation at Little League and Babe Ruth Ball Fields, at most reasonable price possible. Motion carried. Motion by Mr. Burton, Seconded by Dr. Johnson that the Recreation Board request the City Council to arrange a loan from City funds to this Board for fifteen thousand dollars ($159000.00), to be used for completion of the Babe Ruth and Little League Ball Fields, including fencing, bleachers, lighting with mercury vapor lamps, and rest rooms; said loan to be repaid at the rate of two hundred dollars (#200.00) per month. Motion carried. Bids on Little League baseball uniforms and equipment distributed and studied. Motion by Mr. Burton, seconded by Mr. Stipes, that Coach Majors be authorized to purchase needed material from low bid on bids received. Motion carried. Sketches of concession stand to be erected on Greeno Park Area,) aoq.d materials for which have been donated were displayed. Mr. Chatwood moved, Dr. Johnson that Little League organization continued use of the concession Motion carried. seconded that the minutes show always have first right to stand in Little League Park. Letter from Board of Thomas Hospital r®questing Recreation Board to remove play ground equipment from hospital grounds read. Mr. Stipes was appointed to carry out this request. Board accepted for consideration a tentative program for year round operation of Tourist and Adult Group from Mrs. Walker representing this group. Robert Nelson inquiring about girl's soft ball program was di- rected to confer with Coach Majors. Motion by Mr. Chatwood, seconded by Dr. Johnson that the Recrea- tion Board request the City of Fairhope to complete contract with West Baldwin County rater Authority for two water connections at Young Street Recreation Center. Motion carried. Motion by Mr. Burton, seconded by Mr. Chatwood that the Recreation Board request permission from the City Council to use the swimming pool for swimming classes only during this summers' recreation program. Voting aye: Mr. Chatwood, Dr. Johnson, Mr. Burton, Mr. Stipes abstaining. Insurance papers 0 WATER USERS AGREE14ENT STATE OF ALABAMA ) COUN.TffY- OF BALDWIN THIS AGREEMENT between the WEST BALDWIN COUNTY WATER (AND FIRE PROTECTION) AUTHORITY, a public corporation organized and existing under and by virtue of the laws of the State of Alabama, hereinafter called the corporation, and the undersigned water usersy hereinafter called the Water User; WITNESSETH: THAT, WTiEREAS, the Water User desires to purchase water for domestic, commercial, agricultural, industrial or other uses, from the Corporation and to enter into -a Water Users Agreement as required by the By -Laws of the Corporation, NOW, THEREFORE, in consideration of the mutual covenants, promises, and agreements herein contained, it is hereby understood and agreed: 1. The Corporation shall furnish, subject to the limitations as provided for in -the By -Laws, Service Rules and Regulations herein- after provided for, such quantity of water as the Water User may desire in connection with his occupancv of property located at , Alabama. 2. The Water User shall install and maintain at his own expense a service line which shall begin at a point designated by the Corporation at his property line and extend to the dwelling and other portions of his premises. 3. The Water User's service line shall connect with the dis- tribution system of the Corporation at the place designated by the Corporation, provided the Corporation has determined in advance that the Corporation's water system is of sufficient capacity to permit delivery of water to that point. 4. The eater User shall pay for such water at such rates, time and place as shall be determined by the Corporation: 5. The Jiater User shall pay at least a minimum bill for a period of twenty-four (24) months from date water is available even though he may not avail himself of the service: 6. The Corporation shall purchase and install a cut-off valve and a water meter, in each service, provided use of water is immediately desired. Such cut-off valve shall be installed either off the Water User's premises, or upon the plater User's property, within three (3) feet of the property line.. The Corporation shall have exclusive right to use such cut-off valve and water meter and to turn it on and off. 7. The Corporation shall make the final determination in any question of location of any service line connection to its distribution system and shall determine the allocation of water to Water Users in the event of a water shortage. 8. The Corporation may shut off the water of a Water User who allows a connection or extension to be made to his service line for the purpose of supplying water to another user. 9. The failure of a water user to pay water charges duly im- posed shall result in the automatic imposition of the following penalties: A. Nonpayment within twenty (20) days from due date will be subject to a penalty of ten percent (10%) of the de- linquent account. B. Nonpayment within forty (40) days from the date due will result in the water being shut off from the Water User's property. C. Nonpayment for sixty (60) days after original due date will allow the Corporation, in addition to all other rights and remedies, to terminate membership, and in such event, the Water User shall not be entitled to receive, nor the Corporation obligated to supply, any water under this agree- ment. 10. In the event it becomes necessary for the Corporation to shut off the water from a Water User's property for violation of the Rules and Regulations, a fee will be charged for a re -connection of the service. The foregoing notwithstanding, the Corporation reserves the right to make or amend the By -Laws or the Rules and Regulations of the System from time to time, and the Water User agrees to abide by such changes upon notice thereof. Receipt of TWENTY AND NO/100 DOLLARS ($20.00) is hereby acknow- ledged by the Corporation. In the event that for any reason the Corporation does not establish and maintain a water system, any sums not expended in investigating the water source or for other miscellaneous expenses will be refunded to the Water Users pro rata. The user understands that a refundable security deposit of Five Dollars (5.00) will be collected upon connection of service, which said Five Dollars ($5.00) shall be applicable to any unpaid balance owed by the user to the Corporation for water service rendered and not paid for.
