June 2, 2003, at 5:OO13M at the City Administration Building, 161 N.
Section Street.
Present: Larry Green, Chairman; Dick Charles, Bob Clark, Tim Kant, Bob
Gentle, Ed Brinson, Dan McCrory. Erik Cortinas, Building Inspector, Betty
Rivenbark, Secretary. Absent: Jean Wilson, Lee Turner, Christopher
Baker, Director of Planning & Zoning.
The minutes were approved with noted corrections on motion by Dick
Charles seconded by Ed Brinson and unanimously carried.
ZC03.07 Public hearing rezone request of Dot Yeager from B3A-
Tourist Resort Lodging to B-4 Business and Professional Office for
property located at 58 Fairhope Avenue(Generally located south of
Fairhope Avenue just east of South Mobile St) Mr. Cortinas read the staff
recommendation that said they have a concern over this as spot zoning as
this is a small B4 area in the middle of a 133A district and recommended
denial. The public hearing was held and Ms. Yeager spoke questioning
133A uses and stating she only wishes to use this as an office. Jerry
Keene of 56 Fairhope Avenue spoke saying this change could negatively
impact residential neighborhood. Further discussion led to a motion by
Dick Charles to go with staff recommendation of denial and forward this to
city council. Bob Clark 2"d the motion and it carried unanimously.
SD03.30 Final Plat Approval of Jackson Place, Phase 2(Generally
located west of Cty Rd 27 just north of Windmill Road)Mr. Cortinas read
staff recommendation and noted with preliminary plat approval a decel
lane was to be constructed for the southbound traffic on Cty Rd 27.
County Engineer responded that a left turn lane could be utilized, not
install a decel lane. Staff supports this request. Also, that the final
inspection identified some corrections and cleanup that needed to be
completed. He said the engineer has been advised that these corrections
must be complete before the council considers acceptance of the public
improvements. Recommendation was to approve subject to the needed
corrections taking place and construction of the left turn lane before
council adoption of the public improvements. Discussion from developer
and commission led to a motion by Tim Kant to approve subject to staff
recommendation. Dick Charles 2"d the motion and it carried unanimously.
SD03.31 Final Plat Approval of Idlewild, Phase 7A(Generally located
south of Fairhope Avenue, west of Cty Rd 27 and east of Thompson Hall
Rd) Mr. Cortinas read the staff recommendation to approve subject to the
needed corrections taking place before council adoption of the public
improvements. John Avent was present representing the developer.

Dick Charles moved to approve subject to staff recommendations. Ed
Brinson 2"d the motion and it carried unanimously.
SD03.32 Final Plat Approval of Colony Place Phase 3(Generally
located south of Twin Beech Rd and north of Manley Road) Erik Continas
read staff recommendation which was to approve subject to Manley Road
being paved before the council considers accepting the public
improvements for maintenance. Matt Bell was present representing the
developer. A lengthy discussion followed regarding paving and
maintenance of road. The mayor said he had gotten a letter today saying
the county would pave upon passage of a resolution at the June 9 city
council meeting wherein the city accepts maintenance of the road. Dick
Charles moved to give final plat approval. Ed Brinson 2"d the motion and
it carried with one no vote by Bob Clark.
SD03.34 Preliminary Plat of Wise Acres(Generally located west of Cty
Rd 2 South of County Rd 32) Mr. Cortinas said this contains some 3.26
acres and creates 4 lots. It is located south of the city and not zoned.
Staff recommendation was to table until July so the drainage study as
required by regulations can be completed. Steve Dunnam represented
the developer. Discussion led to a motion by Dick Charles to table until
July as per staff recommendation for drainage study. Ed Brinson 2"d the
motion and it carried unanimously.
SD03.36 Site Plan Review of land condominium, Craig Dyas at 204
Oswalt Street. Mr. Cortinas read recommendation which was to approve
subject to drainage calculations and construction with the first building.
Mr. Dyas said he will gladly do whatever required. A motion was made by
Bob Gentle to approve with staff recommendation. Dick Charles 2"d the
motion and it carried unanimously.
SD03.36 Public hearing to consider an amendment to the
subdivision regulations to clarify the stub out requirements. Mr.
Cortinas stated that the commission has debated this issue in the past and
at April meeting directed staff to prepare an amendment that requires the
stubs in subdivision to be paved to the property line. He had prepared
such an amendment:

Discussion followed on proposed amendment with comments being made
forlagainst by the commission members. Outcome of discussion was to
add to proposed amendment the following wording "stub out need only go
one lot deep". Dick Charles moved to recommend approval of amendment
to subdivision regulations with wording "stub out need only go one lot
deep". Ed Brinson 2"d the motion and it carried unanimously.
There being no further business, meeting was duly adjourned at 6:OOPM
